There is appropriated from the rebuild Iowa 3 infrastructure fund to the following departments and agencies 4 for the following fiscal years the following amounts, or so 5 much thereof as is necessary, to be used for the purposes 6 designated: 7 1. DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 8 a. For deposit in the agricultural drainage well water 9 quality assistance fund created in section 460.303 to be used 10 for purposes of supporting the agricultural drainage well water 11 quality assistance program as provided in section 460.304, 12 notwithstanding section 8.57, subsection 6, paragraph “c”: 13 FY 2012-2013 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 500,000 14 b. ECONOMIC DEVELOPMENT AUTHORITY —— APPROPRIATION. 8 1. For the fiscal year beginning July 1, 2013, and ending 9 June 30, 2014, there is appropriated from the rebuild Iowa 10 infrastructure fund to the economic development authority 11 $2,000,000 for the Des Moines area regional transit authority 12 (DART) to develop a bus rapid transit service including 13 the acquisition of specialty hybrid buses, construction of 14 electronic infrastructure, construction of bus stations, and 15 related improvements to develop a rapid transit service, 16 notwithstanding section 8.57, subsection 6, paragraph “c”. 17 2. This appropriation is contingent upon the authority’s 18 receipt of local funds and the receipt of a federal grant, by 19 December 31, 2013, in an amount sufficient to complete the 20 project. The authority shall notify the legislative services 21 agency and the department of management if such funds are 22 received no later than January 15, 2014. 23 Sec. 8. REVERSION. For purposes of section 8.33, unless 24 specifically provided otherwise, unencumbered or unobligated 25 moneys made from an appropriation in this division of this Act 26 shall not revert but shall remain available for expenditure for 27 the purposes designated until the close of the fiscal year that 28 ends three years after the end of the fiscal year for which the 29 appropriation is made. However, if the project or projects for 30 which such appropriation was made are completed in an earlier 31 fiscal year, unencumbered or unobligated moneys shall revert at 32 the close of that same fiscal year. 33 DIVISION V 34 DEPARTMENT OF TRANSPORTATION —— RADIOS 35 -8- LSB 5122SB (1) 84 rh/tm 8/ 17
S.F. _____ Sec. 9. DEPARTMENT OF TRANSPORTATION —— RADIOS. All 1 land mobile radio communications equipment purchased by the 2 department of transportation shall be compliant with the 3 federal communication commission’s narrowbanding mandate and 4 shall provide the maximum amount of statewide coverage and 5 interoperability, throughout all phases of migration, to the 6 department of public safety’s future statewide digital radio 7 network utilizing P-25 standards. 8 Sec. 10. EFFECTIVE UPON ENACTMENT. This division of this 9 Act, being deemed of immediate importance, takes effect upon 10 enactment. 11 Sec. 11. RETROACTIVE APPLICABILITY. This division of this 12 Act applies retroactively to July 1, 2011. 13 DIVISION VI 14 CHANGES TO PRIOR APPROPRIATIONS 15 Sec. 12. 2011 Iowa Acts, chapter 128, section 19, subsection 16 2, is amended to read as follows: 17 2. a. The mobile radios purchased by the department of 18 natural resources pursuant to subsection 1 shall be compatible 19 with a statewide public safety radio network , if created in 20 legislation enacted by the 2011 regular session of the General 21 Assembly, which may include provisions in 2011 Iowa Acts, 22 Senate File 541, if enacted 2011 Iowa Acts, ch. 133, section 3, 23 subsection 8, paragraph a . The department shall purchase the 24 mobile radios after conducting a competitive bidding process. 25 b. There is appropriated from the general fund of the state 4 for the fiscal year beginning July 1, 2012 2013 , and for each 5 subsequent fiscal year thereafter, the sum of seventeen million 6 five hundred thousand dollars to the technology reinvestment 7 fund. 8 Sec. 23. Section 8.57C, subsection 3, Code Supplement 2011, 9 is amended by adding the following new paragraph: 10 NEW PARAGRAPH . e. There is appropriated from the rebuild 11 Iowa infrastructure fund for the fiscal year beginning July 12 1, 2012, and ending June 30, 2013, the sum of fifteen million 13 dollars to the technology reinvestment fund, notwithstanding 14 section 8.57, subsection 6, paragraph “c” . 15 DIVISION VIII 16 IOWA COMMUNICATIONS NETWORK —— AUDIT 17 Sec. 24. IOWA COMMUNICATIONS NETWORK —— AUDIT. Prior to 18 the sale or lease of the Iowa communications network, the Iowa 19 communications network shall conduct a comprehensive audit 20 to include a complete inventory and estimate of the value 21 of all the components included in the network including all 22 fiber, switching stations, end user equipment, and individual 23 components the state has purchased since the creation of the 24 network. The audit should be conducted by an independent 25 auditing firm not associated with the vendor selected through a 26 competitive bidding process. The auditing firm selected shall 27 be technology-based, have extensive industry experience in 28 telecommunications, and be associated with a certified public 29 accountant. 30 EXPLANATION 31 This bill relates to and makes appropriations to state 32 departments and agencies from the rebuild Iowa infrastructure 33 fund, the technology reinvestment fund, and the FY 2009 prison 34 bonding fund, provides for related matters, and includes an 35 -14- LSB 5122SB (1) 84 rh/tm 14/ 17
S.F. _____ effective date provision. The bill is organized by divisions. 1 REBUILD IOWA INFRASTRUCTURE FUND. This division 2 appropriates project funding from the rebuild Iowa 3 infrastructure fund, including projects for FY 2012-2013 4 for the departments of agriculture and land stewardship, 5 corrections, cultural affairs, economic development authority, 6 human services, natural resources, public defense, and 7 transportation, and for the state fair authority, treasurer of 8 state, and the board of regents, and for FY 2013-2014 for the 9 departments of corrections and natural resources, and for the 10 state fair authority and the board of regents. 11 TECHNOLOGY REINVESTMENT FUND. This division appropriates 12 project funding for FY 2012-2013 from the technology 13 reinvestment fund, including projects for the departments of 14 corrections, education, human rights, and management, and for 15 the Iowa telecommunications and technology commission, and 16 board of regents. 17 FY 2009 PRISON BONDING FUND. This division appropriates 18 project funding for FY 2012-2013 from the FY 2009 prison 19 bonding fund for the department of corrections. 20 ECONOMIC DEVELOPMENT AUTHORITY —— CONTINGENT APPROPRIATION. 21 This division appropriates project funding for FY 2013-2014 22 from the rebuild Iowa infrastructure fund to the economic 23 development authority for the Des Moines area regional transit 24 authority if the authority receives local funds as well as a 25 federal grant, by December 31, 2013, in an amount sufficient 26 to complete the project. 27 DEPARTMENT OF TRANSPORTATION —— RADIOS. This division 28 requires all land mobile radio communications equipment 29 purchased by the department of transportation to be compliant 30 with the federal communication commission’s narrowbanding 31 mandate and to provide the maximum amount of statewide coverage 32 and interoperability, throughout all phases of migration, to 33 the department of public safety’s future statewide digital 34 radio network utilizing P-25 standards. 35 -15- LSB 5122SB (1) 84 rh/tm 15/ 17
S.F. _____ This division takes effect upon enactment and applies 1 retroactively to July 1, 2011. 2 CHANGES TO PRIOR APPROPRIATIONS. This division makes 3 changes to prior appropriations from the state fish and game 4 protection fund for FY 2010-2011 to the department of natural 5 resources. 6 The division makes changes to prior appropriations from 7 the rebuild Iowa infrastructure fund for FY 2011-2012 to the 8 department of veterans affairs and for the board of regents, 9 for FY 2012-2013 to the department of corrections and board of 10 regents, and for FY 2013-2014 and 2013-2014 to the department 11 of corrections and board of regents. 12 The division makes changes to prior appropriations from the 13 technology reinvestment fund for FY 2011-2012 to the department 14 of human rights and public safety and for FY 2012-2013 and FY 15 2013-2014 to the department of human services. 16 The division makes changes to prior appropriations from the 17 revenue bonds capitals fund for FY 2011-2012 to the department 18 of corrections. 19 The division takes effect upon enactment. 20 MISCELLANEOUS CODE CHANGES. This division reduces the 21 standing appropriation from the rebuild Iowa infrastructure 22 fund for FY 2012-2013 to the environment first fund from $35 23 million to $33 million. 24 The division provides a standing general fund appropriation 25 of $17.5 million to the technology reinvestment fund beginning 26 in FY 2013-2014. 27 The division appropriates $15 million from the rebuild Iowa 28 infrastructure fund to the technology reinvestment fund for FY 29 2012-2013. 30 IOWA COMMUNICATIONS NETWORK —— AUDIT.
