For the fiscal year beginning July 1, 2012, the goals for 35 -2- LSB 5105XG (11) 84 ad/tm 2/ 18

To achieve the goals in subsection 1, the department of 4 economic development authority shall do all of the following 5 for the fiscal year beginning July 1, 2012: 6 a. Concentrate its efforts on programs and activities that 7 result in commercially viable products and services. 8 b. Adopt practices and services consistent with free 9 market, private sector philosophies. 10 c. Ensure economic growth and development throughout the 11 state. 12 d. Work with businesses and communities to continually 13 improve the economic development climate along with the 14 economic well-being and quality of life for Iowans. 15 e. Coordinate with other state agencies to ensure that they 16 are attentive to the needs of an entrepreneurial culture. 17 f. Establish a strong and aggressive marketing image to 18 showcase Iowa’s workforce, existing industry, and potential. 19 A priority shall be placed on recruiting new businesses, 20 business expansion, and retaining existing Iowa businesses. 21 Emphasis shall be placed on entrepreneurial development through 22 helping entrepreneurs secure capital, and developing networks 23 and a business climate conducive to entrepreneurs and small 24 businesses. 25 g. Encourage the development of communities and quality of 26 life to foster economic growth. 27 h. Prepare communities for future growth and development 28 through development, expansion, and modernization of 29 infrastructure. 30 i. Develop public-private partnerships with Iowa businesses 31 in the tourism industry, Iowa tour groups, Iowa tourism 32 organizations, and political subdivisions in this state to 33 assist in the development of advertising efforts. 34 j. The full-time equivalent positions authorized under this 19 section shall be funded, in whole or in part, by the moneys 20 appropriated under subsection 1 or by other moneys received by 21 the department authority , including certain federal moneys. 22 c. For business development operations and programs, the 23 film office, international trade, export assistance, workforce 24 recruitment, and the partner state program. 25 d. For transfer to the strategic investment fund created in 26 section 15.313. 27 e. For community economic development programs, tourism 28 operations, community assistance, plans for Iowa green corps 29 and summer youth programs, the mainstreet and rural mainstreet 30 programs, the school-to-career program, the community 31 development block grant, and housing and shelter-related 32 programs. 33 f. NONREVERSION 1 Notwithstanding section 8.33, moneys appropriated in 2 subsection 1 that remain unencumbered or unobligated at the 3 close of the fiscal year shall not revert but shall remain 4 available for expenditure for the purposes designated in 5 subsection 2 until the close of the succeeding fiscal year. 6 4. FINANCIAL ASSISTANCE RESTRICTIONS 7 a. A business creating jobs through moneys appropriated in 8 this section shall be subject to contract provisions requiring 9 new and retained jobs to be filled by individuals who are 10 citizens of the United States who reside within the United 11 States or any person authorized to work in the United States 12 pursuant to federal law, including legal resident aliens in the 13 United States. 14 b. Any vendor who receives moneys appropriated in this 15 section shall adhere to such contract provisions and provide 16 periodic assurances as the state shall require that the jobs 17 are filled solely by citizens of the United States who reside 18 within the United States or any person authorized to work in 19 the United States pursuant to federal law, including legal 20 resident aliens in the United States. 21 c. A business that receives financial assistance from the 22 department authority from moneys appropriated in this section 23 shall only employ individuals legally authorized to work in 24 this state. In addition to all other applicable penalties 25 provided by current law, all or a portion of the assistance 26 received by a business which is found to knowingly employ 27 individuals not legally authorized to work in this state is 28 subject to recapture by the department. 29 5. USES OF APPROPRIATIONS 30 a. From the moneys appropriated in this section, the 31 department authority may provide financial assistance in the 32 form of a grant to a community economic development entity for 33 conducting a local workforce recruitment effort designed to 34 recruit former citizens of the state and former students at 35 -5- LSB 5105XG (11) 84 ad/tm 5/ 18

S.F. _____ H.F. _____ colleges and universities in the state to meet the needs of 1 local employers. 2 b. From the moneys appropriated in this section, the 3 department authority may provide financial assistance to 4 early stage industry companies being established by women 5 entrepreneurs. 6 c. From the moneys appropriated in this section, the 7 department authority may provide financial assistance in 8 the form of grants, loans, or forgivable loans for advanced 9 research and commercialization projects involving value-added 10 agriculture, advanced technology, or biotechnology. 11 d. The department authority shall not use any moneys 12 appropriated in this section for purposes of providing 13 financial assistance for the Iowa green streets pilot 14 project or for any other program or project that involves the 15 installation of geothermal systems for melting snow and ice 16 from streets or sidewalks. 17 6. INSURANCE ECONOMIC DEVELOPMENT. From the moneys 8 collected by the division of insurance in excess of the 9 anticipated gross revenues under section 505.7, subsection 10 3 , during the fiscal year beginning July 1, 2012, $100,000 11 shall be transferred to the department of economic development 12 authority for insurance economic development and international 13 insurance economic development. 14 Sec. 5. 2011 Iowa Acts, chapter 130, section 53, is amended 15 to read as follows: 16 SEC. 53. COMMUNITY DEVELOPMENT LOAN FUND. Notwithstanding 17 section 15E.120, subsection 5 , there is appropriated from the 18 Iowa community development loan fund all moneys available 19 during the fiscal year beginning July 1, 2012, and ending June 20 30, 2013, to the department of economic development authority 21 for purposes of the community development program. 22 Sec. 6. 2011 Iowa Acts, chapter 130, is amended by adding 23 the following new section: 24 SEC. 53A. INCENTIVE FUND. Iowa state university of science and technology shall do 4 all of the following: 5 a. Direct expenditures for research toward projects that 6 will provide economic stimulus for Iowa. 7 b. Provide emphasis to providing services to Iowa-based 8 companies. 9 4. It is the intent of the general assembly that the 10 industrial incentive program focus on Iowa industrial 11 sectors and seek contributions and in-kind donations from 12 businesses, industrial foundations, and trade associations, 13 and that moneys for the institute for physical research and 14 technology industrial incentive program shall be allocated 15 only for projects which are matched by private sector moneys 16 for directed contract research or for nondirected research. 17 The match required of small businesses as defined in section 18 15.102, subsection 6 , for directed contract research or for 19 nondirected research shall be $1 for each $3 of state funds. 20 The match required for other businesses for directed contract 21 research or for nondirected research shall be $1 for each $1 of 22 state funds. The match required of industrial foundations or 23 trade associations shall be $1 for each $1 of state funds. 24 Iowa state university of science and technology shall 25 report annually to the joint appropriations subcommittee on 26 economic development and the legislative services agency the 27 total amount of private contributions, the proportion of 28 contributions from small businesses and other businesses, and 29 the proportion for directed contract research and nondirected 30 research of benefit to Iowa businesses and industrial sectors. 31 5. Notwithstanding section 8.33 , moneys appropriated in 32 this section that remain unencumbered or unobligated at the 33 close of the fiscal year shall not revert but shall remain 34 available for expenditure for the purposes designated until the 35 -9- LSB 5105XG (11) 84 ad/tm 9/ 18

However, the 9 fee can be taxed as a cost and paid by the losing party, except 10 in cases where it would impose an undue hardship or be unjust 11 under the circumstances. Section 2.48, subsection 3, paragraph c, 24 subparagraph (5), Code 2011, is amended by striking the 25 subparagraph. 26 Sec. 22. Section 15.119, subsection 2, paragraph b, Code 27 Supplement 2011, is amended by striking the paragraph. 28 Sec. 23. Section 303.1, subsection 4, Code 2011, is amended 29 by adding the following new paragraph: 30 NEW PARAGRAPH . e. Film office. 31 Sec. 24. NEW SECTION . 303.95 Film office establishment and 32 purpose. 33 The department shall establish and administer a film office. 34 The purpose of the film office is to assist legitimate film, 35 -15- LSB 5105XG (11) 84 ad/tm 15/ 18

Section 422.33, subsections 23 and 24, Code 7 Supplement 2011, are amended by striking the subsections. 8 Sec. 27. TRANSITIONAL PROVISIONS —— EMERGENCY 18 ADMINISTRATIVE RULEMAKING. The department of cultural affairs 19 may adopt emergency rules under section 17A.4, subsection 3, 20 and section 17A.5, subsection 2, paragraph “b”, to implement 21 the provisions of this Act relating to a film office in 22 the department of cultural affairs, and the rules shall be 23 effective January 1, 2013, unless a later date is specified in 24 the rules. Any rules adopted in accordance with this section 25 shall also be published as a notice of intended action as 26 provided in section 17A.4. 27 Sec. 32. APPLICABILITY. The sections of this division of 28 this Act amending sections 2.48, 15.119, 422.7, 422.33, 422.35, 29 422.60, and 533.329, and repealing sections 15.391, 15.392, 30 15.393, 422.11T, 422.11U, 432.12J, and 432.12K do not apply to 31 contracts or agreements entered into on or before the effective 32 date of this division of this Act. 33 Sec. 33.
