S.F. _____ Section 1. Section 89.3, subsection 5, paragraph a, 1 subparagraph (4), Code Supplement 2011, is amended to read as 2 follows: 3 (4) Either of the following: 4 (a) The owner or user is a participant in good standing in 5 the Iowa occupational safety and health voluntary protection 6 program and has achieved star status within the program, which 7 is administered by the division of labor in the department of 8 workforce development. 9 (b) The object is part of or integral to the continuous 10 operation of a process covered by the occupational safety 11 and health administration process safety management standard 12 contained in 29 C.F.R. § 1910.119, and the object is included 13 as process safety management process equipment in the owner of 14 the object’s process safety management program. 15 EXPLANATION 16 This bill modifies the criteria for boilers or pressure 17 vessels which must be inspected by the labor commissioner or 18 a designee at least once each year externally while under 19 pressure and at least once every four years internally while 20 not under pressure, unless the commissioner determines an 21 earlier inspection is warranted. 22 One of the criteria is that the owner or user is a 23 participant in good standing in the Iowa occupational safety 24 and health voluntary protection program administered by the 25 division of labor in the department of workforce development 26 and has achieved star status within the program. The bill 27 provides an alternative to that criterion, which is that 28 the boiler or pressure vessel is part of or integral to the 29 continuous operation of a process covered by the federal 30 occupational safety and health administration’s process 31 safety management standard contained in 29 C.F.R. § 1910.119, 32 and the object is included as process safety management 33 process equipment in the owner of the object’s process safety 34 management program. 35 -1- LSB 5599SC (3) 84 je/sc 1/ 1
