S.F. _____ Section 1. Section 717.1A, unnumbered paragraph 1, Code 1 2011, is amended to read as follows: 2 A person is guilty of livestock abuse if the person 3 intentionally injures or destroys livestock owned by another 4 person, in any manner, including, but not limited to, 5 intentionally doing any of the following: administering drugs 6 or poisons to the livestock, or disabling the livestock by 7 using a firearm or trap. A person guilty of livestock abuse 8 commits an aggravated misdemeanor. However, a person who is 9 guilty of livestock abuse and who also produces a recording of 10 the livestock abuse commits a class “D” felony. This section 11 shall not apply to any of the following: 12 EXPLANATION 13 Code section 717.1A provides that a person commits livestock 14 abuse by intentionally injuring or destroying livestock owned 15 by another person. A person who commits the offense is guilty 16 of an aggravated misdemeanor. 17 This bill provides that a person who commits livestock 18 abuse and who also produces a recording of the livestock abuse 19 commits a class “D” felony. 20 Livestock is defined to include cattle, goats, horses, 21 sheep, or swine, or related species; ostriches, rheas, or 22 emus; farm deer; or poultry. The Code section includes a 23 number of exceptions, including when acting with the consent 24 of the livestock owner, acting under court order, practicing 25 veterinary medicine, acting to carry out a provision of law, or 26 acting to protect life or property. 27 An aggravated misdemeanor is punishable by confinement for 28 no more than two years and a fine of at least $625 but not more 29 than $6,250.
