Section 249A.38, subsection 1, unnumbered 1 paragraph 1, Code Supplement 2011, is amended to read as 2 follows: 3 The following conditions shall apply to an individual who 4 is an inmate of a public institution as defined in 42 C.F.R. § 5 435.1010, who is enrolled in the medical assistance program at 6 the time of commitment to the public institution, and who is 7 remains eligible for medical assistance by reason of disability 8 or being sixty-five years of age or older as an individual 9 except for the individual’s institutional status : 10 EXPLANATION 11 This bill specifies that the suspension of Medicaid for an 12 inmate of a public institution who is enrolled in the medical 13 assistance program at the time of commitment to the public 14 institution is expanded to include not only those eligible 15 by reason of disability or being 65 years of age or older, 16 but instead any individual who remains eligible for medical 17 assistance except for the individual’s institutional status. 18 -1- LSB 5286XD (2) 84 pf/nh 1/ 1
