EARLY CHILDHOOD IOWA FUND —— GENERAL AID 4 For deposit in the school ready children grants account of 5 the early childhood Iowa fund created in section 256I.11: 6 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,386,113 7 a. From the moneys deposited in the school ready children 8 grants account for the fiscal year beginning July 1, 2011, and 9 ending June 30, 2012, not more than $265,950 is allocated for 10 the early childhood Iowa office and other technical assistance 11 activities. The early childhood Iowa state board shall direct 12 staff to work with the early childhood stakeholders alliance 13 created in section 256I.12 to inventory technical assistance 14 needs. Moneys allocated under this lettered paragraph may be 15 used by the early childhood Iowa state board for the purpose of 16 skills development and support for ongoing training of staff. 17 However, except as otherwise provided in this subsection, 18 moneys shall not be used for additional staff or for the 19 reimbursement of staff. 20 b. As a condition of receiving moneys appropriated in 21 this subsection, each early childhood Iowa area board shall 22 report to the early childhood Iowa state board progress on 23 each of the local indicators approved by the area board. Each 24 early childhood Iowa area board must also submit an annual 25 budget for the area’s comprehensive school ready children 26 grant developed for providing services for children from birth 27 through five years of age, and provide other information 28 specified by the early childhood Iowa state board, including 29 budget amendments as needed. The early childhood Iowa state 30 board shall establish a submission deadline for the annual 31 budget and any budget amendments that allow a reasonable period 32 of time for preparation by the early childhood Iowa area boards 33 and for review and approval or request for modification of 34 the materials by the early childhood Iowa state board. S.F. _____ addition, each early childhood Iowa area board must continue to 1 comply with reporting provisions and other requirements adopted 2 by the early childhood Iowa state board in implementing section 3 256I.9. 4 c. Of the amount appropriated in this subsection for 5 deposit in the school ready children grants account of the 6 early childhood Iowa fund, $2,318,018 shall be used for efforts 7 to improve the quality of early care, health, and education 8 programs. Moneys allocated pursuant to this paragraph may be 9 used for additional staff and for the reimbursement of staff. 10 The early childhood Iowa state board may reserve a portion 11 of the allocation, not to exceed $88,650, for the technical 12 assistance expenses of the early childhood Iowa state office, 13 including the reimbursement of staff, and shall distribute 14 the remainder to early childhood Iowa areas for local quality 15 improvement efforts through a methodology identified by the 16 early childhood Iowa state board to make the most productive 17 use of the funding, which may include use of the distribution 18 formula, grants, or other means. 19 d. Of the amount appropriated in this subsection for 20 deposit in the school ready children grants account of 21 the early childhood Iowa fund, $825,030 shall be used for 22 support of professional development and training activities 23 for persons working in early care, health, and education by 24 the early childhood Iowa state board in collaboration with 25 the professional development component group of the early 26 childhood Iowa stakeholders alliance maintained pursuant to 27 section 256I.12, subsection 7, paragraph “b”, and the early 28 childhood Iowa area boards. Expenditures shall be limited to 29 professional development and training activities agreed upon by 30 the parties participating in the collaboration. 31 11. EARLY CHILDHOOD IOWA FUND —— PRESCHOOL TUITION 32 ASSISTANCE 33 a. For deposit in the school ready children grants account 34 of the early childhood Iowa fund created in section 256I.11: 35 -7- LSB 2819XC (13) 84 kh/tm 7/ 82

In addition, if 8 sufficient funding is available after addressing the needs of 9 those who meet the basic income eligibility requirement, an 10 early childhood Iowa area board may provide for eligibility 11 for those with a family income in excess of the basic income 12 eligibility requirement through use of a sliding scale or other 13 copayment provisions. 14 12. EARLY CHILDHOOD IOWA FUND —— FAMILY SUPPORT AND PARENT 15 EDUCATION 16 a. ENERGY COST-SAVINGS PROJECTS —— FINANCING. For 19 the fiscal year beginning July 1, 2011, and ending June 30, 20 2012, the state board of regents may use notes, bonds, or 21 other evidences of indebtedness issued under section 262.48 to 22 finance projects that will result in energy cost savings in an 23 amount that will cause the state board to recover the cost of 24 the projects within an average of six years. 25 Sec. 11. PRESCRIPTION DRUG COSTS. Notwithstanding section 26 270.7, the department of administrative services shall pay 27 the state school for the deaf and the Iowa braille and sight 28 saving school the moneys collected from the counties during the 29 fiscal year beginning July 1, 2011, for expenses relating to 30 prescription drug costs for students attending the state school 31 for the deaf and the Iowa braille and sight saving school. 32 Sec. 12. Section 256I.9, subsection 2, Code 2011, is amended 33 to read as follows: 34 2. The state board shall provide maximum flexibility to 35 -17- LSB 2819XC (13) 84 kh/tm 17/ 82
S.F. _____ grantees for the use of the grant moneys included in a school 1 ready children grant , including but not limited to authorizing 2 an area board to use grant moneys to pay for regular audits 3 required pursuant to section 256I.5, subsection 1, if moneys 4 distributed to an area board for administrative costs are 5 insufficient to pay for the required audits . 6 Sec. 13. Section 256I.9, subsection 3, paragraph b, Code 7 2011, is amended by adding the following new unnumbered 8 paragraph: 9 NEW UNNUMBERED PARAGRAPH . It is the intent of the general 10 assembly that priority for home visitation program funding be 11 given to programs using evidence-based or promising models for 12 home visitation. 13 Sec. 14. Section 257.11, subsection 5, Code 2011, is amended 14 by striking the subsection. 15 Sec. 15. Section 261.6, subsection 2, Code 2011, is amended 16 by adding the following new paragraph: 17 NEW PARAGRAPH . d. (1) Is a resident of Iowa; is, 18 notwithstanding subsection 3, paragraph “c” , under the age of 19 twenty-six; is not a convicted felon as defined in section 20 910.15; and meets the following criteria: 21 (a) Is the child of a peace officer, as defined in section 22 97A.1, who is permanently and totally disabled and who receives 23 benefits under section 97A.6, subsection 5, or was killed in 24 the line of duty as determined by the board of trustees of the 25 Iowa department of public safety peace officers’ retirement, 26 accident, and disability system in accordance with section 27 97A.6, subsection 16. 28 (b) Is the child of a police officer or a fire fighter, 29 as defined in section 411.1, who is permanently and totally 30 disabled and who receives benefits under section 411.6, 31 subsection 5, or was killed in the line of duty as determined 32 by the statewide fire and police retirement system in 33 accordance with section 411.6, subsection 15. 34 (c) Is the child of a person described as a peace officer 35 -18- LSB 2819XC (13) 84 kh/tm 18/ 82
S.F. _____ under section 97B.49B or is the child of a sheriff or deputy 1 sheriff as defined in section 97B.49C, who is permanently and 2 totally disabled and who receives an in-service disability 3 retirement allowance under section 97B.50A, subsection 2, or 4 is killed in the line of duty as determined by the Iowa public 5 employees’ retirement system in accordance with section 97B.52, 6 subsection 2. 7 (2) If a student receives financial aid under any other 8 federal, state, or institutional scholarship or grant program, 9 the full amount of the other financial aid shall be applied to 10 the student’s expenses first and shall be considered part of 11 the student’s available financial resources in determining the 12 amount of the student’s award under this paragraph “d”. The 13 total financial aid for the student’s education, including 14 financial aid under any other program, shall not exceed the 15 student’s cost of attendance at the institution which the 16 student attends. 17 (3) For purposes of this paragraph “d” : 18 (a) “Approved postsecondary education or training program” 19 means a program offered by an Iowa community college or 20 institution of higher education governed by the state board of 21 regents. 22 (b) “Permanently and totally disabled” means the individual 23 is unable to engage in any substantial gainful activity 24 by reason of a medically determinable physical impairment 25 which can be expected to last for a continuous period or 26 can be expected to result in death. A certificate from a 27 qualified physician attesting to the individual’s permanent 28 and total disability must be submitted to the commission. The 29 certificate must include the name and address of the physician 30 and contain an acknowledgment that the certificate will be 31 used by the individual to qualify for educational assistance 32 pursuant to this section. 33 Sec. 16. Section 261.19, Code 2011, is amended to read as 34 follows: 35 -19- LSB 2819XC (13) 84 kh/tm 19/ 82
S.F. _____ 261.19 Osteopathic physician Health care professional 1 recruitment program. 2 1. A physician health care professional recruitment program 3 is established , to be administered by the college student aid 4 commission , for Des Moines university —— osteopathic medical 5 center . The program shall consist of a forgivable loan program 6 and a tuition scholarship program for students and a loan 7 repayment program for physicians health care professionals . 8 The commission shall regularly adjust the physician service 9 requirement under each aspect of the program to provide, to the 10 extent possible, an equal financial benefit for each period of 11 service required. 12 2. a. Notwithstanding the administration provisions of 13 subsection 1 , the forgivable loan program established pursuant 14 to subsection 1 shall be administered by the commission in 15 conjunction with Des Moines university —— osteopathic medical 16 center. Des Moines university —— osteopathic medical center 17 shall match on an equal basis state aid appropriated for 18 purposes of the forgivable loan program. 19 b. Des Moines university —— osteopathic medical center 20 shall provide recommendations to the commission for students 21 who meet the eligibility requirements of the forgivable loan 22 program. A forgivable loan may be awarded to a resident of 23 Iowa who is enrolled at Des Moines university —— osteopathic 24 medical center if the student agrees to practice in this state 25 for a period of time to be determined by the commission at 26 the time the loan is awarded. Forgivable loans to eligible 27 students shall not become due until after the student completes 28 a residency program. Interest on the loans shall begin to 29 accrue the day following the student’s graduation date. If 30 the student completes the period of practice established by 31 the commission and agreed to by the student, the loan amount 32 shall be forgiven. The loan amount shall not be forgiven if 33 the osteopathic physician fails to complete the required time 34 period of practice in this state or fails to satisfactorily 35 -20- LSB 2819XC (13) 84 kh/tm 20/ 82
S.F. _____ continue in the university’s program of medical education. 1 3. A student enrolled at Des Moines university —— 2 osteopathic medical center shall be eligible for a tuition 3 scholarship for the student’s study at the university. The 4 scholarship shall be for an amount not to exceed the annual 5 tuition at the university. A student who receives a tuition 6 scholarship shall not be eligible for the loan repayment 7 program provided for by this section . A student who receives 8 a tuition scholarship shall agree to practice in an eligible 9 rural community in this state for a period of time to be 10 determined by the commission at the time the scholarship is 11 awarded. The student shall repay the scholarship to the 12 commission if the student fails to practice in a medically 13 underserved rural community in this state for the required 14 period of time. 15 4. A physician health care professional shall be eligible 16 for the physician loan repayment program if the physician 17 health care professional agrees to practice in an eligible 18 rural community in this state. Des Moines university —— 19 osteopathic medical center shall recruit and place physicians 20 health care professionals in rural communities which have 21 agreed to provide additional funds for the physician’s 22 recipient’s loan repayment. The contract for the loan 23 repayment shall stipulate the time period the physician 24 recipient shall practice in an eligible rural community in this 25 state. In addition, the contract shall stipulate that the 26 physician recipient repay any funds paid on the physician’s 27 recipient’s loan by the commission if the physician recipient 28 fails to practice in an eligible rural community in this state 29 for the required period of time. 30 3. A health care professional recruitment revolving fund 31 is created in the state treasury as a separate fund under 32 the control of the commission. The commission shall deposit 33 payments made by health care professional recruitment program 34 recipients and the proceeds from the sale of osteopathic loans 35 -21- LSB 2819XC (13) 84 kh/tm 21/ 82
S.F. _____ awarded pursuant to section 261.19, subsection 2, paragraph 1 “b” , Code 2011, into the health care professional recruitment 2 revolving fund. Moneys credited to the fund shall be used to 3 supplement moneys appropriated for the health care professional 4 recruitment program, for loan repayment in accordance with this 5 section, and to pay for loan or interest repayment defaults by 6 program recipients. Notwithstanding section 8.33, any balance 7 in the fund on June 30 of any fiscal year shall not revert to 8 the general fund of the state. 9 4. For purposes of this subsection , “eligible section: 10 a. “Eligible rural community” means a medically underserved 11 rural community which agrees to match state funds provided 12 on at least a dollar-for-dollar basis for the loan repayment 13 of a physician health care professional who practices in the 14 community. 15 b. “Health care professional” means a physician, physician 16 assistant, podiatrist, or physical therapist. 17 5. The commission shall adopt rules pursuant to chapter 17A 18 to administer this section . 19 Sec. 17. Section 261.25, subsections 1 through 3, Code 2011, 20 are amended to read as follows: 21 1. There is appropriated from the general fund of the state 22 to the commission for each fiscal year the sum of forty-four 23 forty-two million thirteen three hundred fifty-two thousand 24 four six hundred forty-eight eighty-seven dollars for tuition 25 grants. 26 2. There is appropriated from the general fund of the state 27 to the commission for each fiscal year the sum of four million 28 six four hundred fifty twenty-five thousand four two hundred 29 eighty-seven forty-four dollars for tuition grants for students 30 attending for-profit accredited private institutions located in 31 Iowa. A for-profit institution which, effective March 9, 2005, 32 or effective January 8, 2010, purchased an accredited private 33 institution that was exempt from taxation under section 501(c) 34 of the Internal Revenue Code, shall be an eligible institution 35 -22- LSB 2819XC (13) 84 kh/tm 22/ 82

For purposes of the tuition 1 grant program, “for-profit accredited private institution” means 2 an accredited private institution which is not exempt from 3 taxation under section 501(c)(3) of the Internal Revenue Code 4 but which otherwise meets the requirements of section 261.9, 5 subsection 1 , paragraph “b” , and whose students were eligible 6 to receive tuition grants in the fiscal year beginning July 1, 7 2003. 8 3. There is appropriated from the general fund of the state 9 to the commission for each fiscal year the sum of two million 10 four two hundred thirteen fifty thousand nine one hundred 11 fifty-nine eighty-five dollars for vocational-technical tuition 12 grants. 13 Sec. 18. Section 261E.3, subsection 1, paragraph e, Code 14 2011, is amended to read as follows: 15 e. The student shall have demonstrated proficiency in 16 reading, mathematics, and science as evidenced by achievement 17 scores on the latest administration of the state assessment for 18 which scores are available and as defined by the department. 19 However, a student receiving competent private instruction 20 under chapter 299A may demonstrate proficiency by submitting 21 the written recommendation of the licensed practitioner 22 providing supervision to the student in accordance with section 23 299A.2; may demonstrate proficiency as evidenced by achievement 24 scores on the annual achievement evaluation required under 25 section 299A.4; or may demonstrate proficiency as evidenced by 26 a selection index, which is the sum of the critical reading, 27 mathematics, and writing skills assessments, of at least one 28 hundred forty-one on the preliminary scholastic aptitude 29 test administered by the college board; a composite score 30 of at least twenty-one on the college readiness assessment 31 administered by ACT, inc.; or a sum of the critical reading 32 and mathematics scores of at least nine hundred ninety on the 33 college readiness assessment administered by the college board. 34 If a student is not proficient in one or more of the content 35 -23- LSB 2819XC (13) 84 kh/tm 23/ 82
S.F. _____ areas listed in this paragraph , has not taken the college 1 readiness assessments identified in this paragraph, or has not 2 achieved the scores specified in this paragraph , the school 3 board may establish alternative but equivalent qualifying 4 performance measures including but not limited to additional 5 administrations of the state assessment, portfolios of student 6 work, student performance rubric, or end-of-course assessments. 7 Sec. 19. Section 261E.9, subsections 1 through 3, Code 2011, 8 are amended to read as follows: 9 1. a. A regional academy is a program established by 10 a school district to which multiple school districts send 11 students in grades nine seven through twelve , and which may 12 include internet-based coursework and courses delivered via the 13 Iowa communications network. A regional academy shall include 14 in its curriculum advanced level courses and may include in its 15 curriculum career and technical courses . A school district 16 establishing a regional academy may collaborate and partner 17 with, enter into an agreement pursuant to chapter 28E with, 18 or enter into a contract with, one or more school districts, 19 area education agencies, community colleges, accredited public 20 and private postsecondary institutions, accredited nonpublic 21 schools, businesses, and private agencies located within or 22 outside of the state. 23 b. The purpose of a regional academy established pursuant 24 to this section shall be to build a culture of innovation for 25 students and community, to diversify educational and economic 26 opportunities by engaging in learning experiences that involve 27 students in complex, real-world projects, and to develop 28 regional or global innovation networks. 29 c. If a school district establishing a regional academy in 30 accordance with this section submits a plan to the department 31 for approval that demonstrates how the regional academy will 32 increase and assess student achievement or increase and assess 33 competency-based learning opportunities for students, the 34 department may waive or modify any statutory or regulatory 35 -24- LSB 2819XC (13) 84 kh/tm 24/ 82
S.F. _____ provision applicable to school districts except the department 1 shall not waive or modify any statutory or regulatory provision 2 relating to requirements applicable to school districts under 3 chapters 11, 21, 22, 216, 216A, 256B, 279, 284, and 285; or 4 relating to contracts with and discharge of teachers and 5 administrators under chapters 20 and 279; or relating to audit 6 requirements under section 256.9, subsection 20, and section 7 279.29. 8 2. a. A regional academy course shall not qualify as a 9 concurrent enrollment course include in its curriculum advanced 10 level courses . 11 b. A regional academy may include in its curriculum virtual 12 or internet-based coursework and courses delivered via the Iowa 13 communications network, career and technical courses, core 14 curriculum coursework, courses required pursuant to section 15 256.7, subsection 26, or section 256.11, subsections 4 and 5, 16 and asynchronous learning networks. 17 3. School districts participating in regional academies are 18 eligible for supplementary weighting as provided in section 19 257.11, subsection 2 . The school districts participating in 20 the regional academy shall enter into an agreement on how the 21 funding generated by the supplementary weighting received shall 22 be used and shall submit the agreement to the department for 23 approval . 24 Sec. 20. Section 262.13, Code 2011, is amended to read as 25 follows: 26 262.13 Security Peace officers at institutions as peace 27 officers . 28 The board may authorize any institution under its control 29 to commission one or more of its employees as special security 30 peace officers. Special security officers Such officers shall 31 have the same powers , duties , privileges, and immunities of 32 as conferred on regular peace officers when acting in the 33 interests of the institution by which they are employed . 34 The board shall provide as rapidly as practicable for the 35 -25- LSB 2819XC (13) 84 kh/tm 25/ 82
S.F. _____ adequate training and certification of such special security 1 peace officers at the Iowa law enforcement academy or in 2 an equivalent at a law enforcement training program school 3 approved by the academy , unless they have the peace officers 4 are already received such training certified by the Iowa law 5 enforcement academy or by an approved law enforcement training 6 school . 7 Sec. 21. Section 263.8A, Code 2011, is amended to read as 8 follows: 9 263.8A International center for talented and gifted education 10 —— Iowa online advanced placement academy science, technology, 11 engineering, and mathematics initiative . 12 1. a. The state board of regents shall establish and 13 maintain at Iowa City as an integral part of the state 14 university of Iowa the international center for talented and 15 gifted education. The international center shall provide 16 programs to assist classroom teachers to teach gifted and 17 talented students in regular classrooms, provide programs 18 to enhance the learning experiences of gifted and talented 19 students, serve as a center for national and international 20 symposiums and policy forums for enhancing the teaching of 21 gifted and talented students, and undertake other appropriate 22 activities to enhance the programs of the center, including, 23 but not limited to, coordinating and working with the world 24 council for gifted and talented children, incorporated. 25 b. An international center endowment fund is established 26 at the state university of Iowa and gifts and grants to the 27 international center and investment earnings and returns on 28 the endowment fund shall be deposited in the fund and may be 29 expended by the state university of Iowa for the purposes for 30 which the international center was established. 31 2. The Iowa online advanced placement academy science, 32 technology, engineering, and mathematics initiative is 33 established within the international center for talented and 34 gifted education at the state university of Iowa to deliver, 35 -26- LSB 2819XC (13) 84 kh/tm 26/ 82
S.F. _____ with an emphasis on science, technology, engineering, and 1 mathematics coursework, preadvanced placement and advanced 2 placement courses to high school students throughout the state, 3 provide training opportunities for teachers to learn how to 4 teach advanced placement courses in Iowa’s high schools, and 5 provide preparation for middle school students to ensure 6 success in high school. 7 Sec. 22. Section 284.13, subsection 1, paragraphs a through 8 d, Code 2011, are amended to read as follows: 9 a. For the fiscal year beginning July 1, 2010 2011 , and 10 ending June 30, 2011 2012 , to the department of education, the 11 amount of nine six hundred sixty-four eighty-five thousand 12 dollars for the issuance of national board certification awards 13 in accordance with section 256.44 . Of the amount allocated 14 under this paragraph, not less than seventy-six eighty-five 15 thousand five hundred dollars shall be used to administer the 16 ambassador to education position in accordance with section 17 256.45 . 18 b. For the fiscal year beginning July 1, 2010 2011 , and 19 succeeding fiscal years ending June 30, 2012 , an amount 20 up to four two million one three hundred seven ninety-five 21 thousand two hundred forty one hundred fifty-seven dollars 22 for first-year and second-year beginning teachers, to the 23 department of education for distribution to school districts 24 and area education agencies for purposes of the beginning 25 teacher mentoring and induction programs. A school district or 26 area education agency shall receive one thousand three hundred 27 dollars per beginning teacher participating in the program. 28 If the funds appropriated for the program are insufficient to 29 pay mentors, school districts, and area education agencies 30 as provided in this paragraph, the department shall prorate 31 the amount distributed to school districts and area education 32 agencies based upon the amount appropriated. Moneys received 33 by a school district or area education agency pursuant to 34 this paragraph shall be expended to provide each mentor with 35 -27- LSB 2819XC (13) 84 kh/tm 27/ 82
S.F. _____ an award of five hundred dollars per semester, at a minimum, 1 for participation in the school district’s or area education 2 agency’s beginning teacher mentoring and induction program; 3 to implement the plan; and to pay any applicable costs of the 4 employer’s share of contributions to federal social security 5 and the Iowa public employees’ retirement system or a pension 6 and annuity retirement system established under chapter 294 , 7 for such amounts paid by the district or area education agency. 8 c. For the fiscal year beginning July 1, 2010 2011 , and 9 ending June 30, 2011 2012 , up to six hundred thirteen thousand 10 eight hundred seventy-eight dollars to the department for 11 purposes of implementing the professional development program 12 requirements of section 284.6 , assistance in developing model 13 evidence for teacher quality committees established pursuant to 14 section 284.4, subsection 1 , paragraph “c” , and the evaluator 15 training program in section 284.10 . A portion of the funds 16 allocated to the department for purposes of this paragraph may 17 be used by the department for administrative purposes and for 18 not more than four full-time equivalent positions. 19 d. For each the fiscal year in which funds are appropriated 20 for purposes of this chapter beginning July 1, 2011, and 21 ending June 30, 2012 , an amount up to one million six one 22 hundred twenty-nine four thousand six eight hundred forty-seven 23 forty-three dollars to the department for the establishment 24 of teacher development academies in accordance with section 25 284.6, subsection 10 . A portion of the funds allocated to 26 the department for purposes of this paragraph may be used for 27 administrative purposes. 28 Sec. 23. Section 298.3, subsection 1, paragraph c, Code 29 2011, is amended to read as follows: 30 c. The purchase, lease, or lease-purchase of a single unit 31 of equipment or technology exceeding five hundred dollars in 32 value per unit purchase, lease, or lease-purchase transaction . 33 Each transaction may include multiple equipment or technology 34 units. 35 -28- LSB 2819XC (13) 84 kh/tm 28/ 82
S.F. _____ Sec. 24. Section 299A.2, Code 2011, is amended to read as 1 follows: 2 299A.2 Competent private instruction by licensed 3 practitioner. 4 If a licensed practitioner provides competent instruction 5 to a school-age child of compulsory attendance age , the 6 practitioner shall possess a valid license or certificate which 7 has been issued by the state board of educational examiners 8 under chapter 272 and which is appropriate to the ages and 9 grade levels of the children to be taught. Competent private 10 instruction may include , but is not limited to , a home school 11 assistance program which provides instruction or instructional 12 supervision offered through an accredited nonpublic school or 13 public school district by a teacher, who is employed by the 14 accredited nonpublic school or public school district, who 15 assists and supervises a parent, guardian, or legal custodian 16 in providing instruction to a child. If competent private 17 instruction is provided through a public school district, the 18 child shall be enrolled and included in the basic enrollment 19 of the school district as provided in section 257.6 . Sections 20 299A.3 through 299A.7 do not apply to competent private 21 instruction provided by a licensed practitioner under this 22 section . However, the reporting requirement contained in 23 section 299A.3, subsection 1 , shall apply to competent private 24 instruction provided by licensed practitioners that is not 25 part of a home school assistance program offered through an 26 accredited nonpublic school or public school district. 27 Sec. 25. Section 299A.8, Code 2011, is amended to read as 28 follows: 29 299A.8 Dual enrollment. 30 If a parent, guardian, or legal custodian of a school-age 31 child who is receiving competent private instruction under 32 this chapter or a child over compulsory age who is receiving 33 private instruction submits a request, the child shall also be 34 registered in a public school for dual enrollment purposes. 35 -29- LSB 2819XC (13) 84 kh/tm 29/ 82
S.F. _____ If the child is enrolled in a public school district for 1 dual enrollment purposes, the child shall be permitted to 2 participate in any academic activities in the district and 3 shall also be permitted to participate on the same basis as 4 public school children in any extracurricular activities 5 available to children in the child’s grade or group, and the 6 parent, guardian, or legal custodian shall not be required to 7 pay the costs of any annual evaluation under this chapter . If 8 the child is enrolled for dual enrollment purposes, the child 9 shall be included in the public school’s basic enrollment 10 under section 257.6 . A pupil who is participating only in 11 extracurricular activities shall be counted under section 12 257.6, subsection 1 , paragraph “a” , subparagraph (6). A pupil 13 enrolled in grades nine through twelve under this section shall 14 be counted in the same manner as a shared-time pupil under 15 section 257.6, subsection 1 , paragraph “a” , subparagraph (3). 16 Sec. 26. Section 299A.12, subsection 1, Code 2011, is 17 amended to read as follows: 18 1. The board of directors of a school district may shall 19 expend moneys received pursuant to section 257.6, subsection 20 1 , paragraph “a” , subparagraph (5), for purposes of providing a 21 home school assistance program. 22 Sec. 27. Section 299A.12, subsection 2, paragraphs a and b, 23 Code 2011, are amended to read as follows: 24 a. Assisting Instruction for students and assisting parents 25 with instruction. 26 b. Student Support services for students and teaching-parent 27 support services teaching parents and staff support services. 28 Sec. 28. Section 299A.12, subsection 2, paragraph g, 29 unnumbered paragraph 1, Code 2011, is amended to read as 30 follows: 31 Resources, materials, computer software and hardware, and 32 supplies, and purchased services that meet the following 33 criteria: 34 Sec. 29. Section 299A.12, subsection 3, paragraphs b, c, e, 35 -30- LSB 2819XC (13) 84 kh/tm 30/ 82
S.F. _____ and f, Code 2011, are amended to read as follows: 1 b. Operational or maintenance costs in addition to the cost 2 of maintaining school district facilities other than those 3 necessary to operate and maintain the program . 4 c. Capital expenditures other than equipment or facility 5 acquisition, including the lease or rental of space to 6 supplement existing schoolhouse facilities . 7 e. Administrative costs other than the costs necessary to 8 administer the program . 9 f. Concurrent and dual enrollment program costs and 10 postsecondary enrollment options program costs. 11 Sec. 30. Section 321.89, subsection 1, paragraph c, Code 12 2011, is amended to read as follows: 13 c. “Police authority” means the state patrol, any law 14 enforcement agency of a county or city, or any special security 15 peace officer employed by the state board of regents under 16 section 262.13 . 17 Sec. 31. Section 801.4, subsection 11, paragraph f, Code 18 2011, is amended to read as follows: 19 f. Special security Peace officers employed by board of 20 regents institutions as set forth in section 262.13 . 21 Sec. 32. REPEAL. Section 261.19B, Code 2011, is repealed. 22 Sec. 33. EFFECTIVE UPON ENACTMENT AND RETROACTIVE 23 APPLICABILITY. 24 1. The section of this division of this Act appropriating 25 moneys from the general fund of the state to the college 26 student aid commission for purposes of providing national guard 27 educational assistance, being deemed of immediate importance, 28 takes effect upon enactment, and if approved by the governor on 29 or after July 1, 2011, shall apply retroactively to June 30, 30 2011. 31 2. The section of this division of this Act providing for 32 the transfer of board of educational examiners’ licensing fees 33 to the department of education, being deemed of immediate 34 importance, takes effect immediately, and if approved by the 35 -31- LSB 2819XC (13) 84 kh/tm 31/ 82
S.F. _____ governor on or after July 1, 2011, shall apply retroactively 1 to June 30, 2011. 2 3. The section of this division of this Act transferring 3 moneys appropriated pursuant to 2010 Iowa Acts, chapter 1183, 4 section 6, subsection 18, being deemed of immediate importance, 5 takes effect upon enactment, and if approved by the governor on 6 or after July 1, 2011, shall apply retroactively to June 30, 7 2011. 8 4. The section of this division of this Act amending section 9 261.6, subsection 2, being deemed of immediate importance, 10 takes effect upon enactment and if approved by the governor on 11 or after July 1, 2011, shall apply retroactively to June 30, 12 2011. 13 Sec. 34. EFFECTIVE DATE AND APPLICABILITY. The section of 14 this division of this Act amending section 261E.9, subsections 15 1 through 3, takes effect July 1, 2012, and is applicable to 16 school years beginning on or after July 1, 2012. 17 Sec. 35. APPLICABILITY. The section of this division of 18 this Act that amends section 298.3 applies to school budget 19 years beginning on or after July 1, 2011. 20 Sec. 36. RETROACTIVE APPLICABILITY. The sections of this 21 division of this Act amending sections 299A.2 and 299A.8 apply 22 retroactively to the base year beginning July 1, 2009. 23 DIVISION II 24 LIBRARY PROVISIONS 25 Sec. 37. Section 8A.454, subsection 2, Code 2011, is amended 26 to read as follows: 27 2. A monthly per contract administrative charge shall 28 be assessed by the department on all health insurance plans 29 administered by the department in which the contract holder 30 has a state employer to pay the charge. The amount of the 31 administrative charge shall be established by the general 32 assembly. The department shall collect the administrative 33 charge from each department utilizing the centralized payroll 34 system and shall deposit the proceeds in the fund. In 35 -32- LSB 2819XC (13) 84 kh/tm 32/ 82
S.F. _____ addition, the state board of regents, all library service 1 areas, the state fair board, the state department of 2 transportation, and each judicial district department of 3 correctional services shall remit the administrative charge on 4 a monthly basis to the department and shall submit a report 5 to the department containing the number and type of health 6 insurance contracts held by each of its employees whose health 7 insurance is administered by the department. 8 Sec. 38. Section 8D.2, subsection 5, paragraph a, Code 2011, 9 is amended to read as follows: 10 a. “Public agency” means a state agency, an institution 11 under the control of the board of regents, the judicial 12 branch as provided in section 8D.13, subsection 16 , a school 13 corporation, a city library, a library service area as provided 14 in chapter 256 , a county library as provided in chapter 336 , 15 or a judicial district department of correctional services 16 established in section 905.2 , to the extent provided in section 17 8D.13, subsection 14 , an agency of the federal government, or a 18 United States post office which receives a federal grant for 19 pilot and demonstration projects. 20 Sec. 39. Section 8D.9, subsection 1, Code 2011, is amended 21 to read as follows: 22 1. A private or public agency, other than a state agency, 23 local school district or nonpublic school, city library, 24 library service area, county library, judicial branch, judicial 25 district department of correctional services, agency of the 26 federal government, a hospital or physician clinic, or a 27 post office authorized to be offered access pursuant to this 28 chapter as of May 18, 1994, shall certify to the commission 29 no later than July 1, 1994, that the agency is a part of or 30 intends to become a part of the network. Upon receiving such 31 certification from an agency not a part of the network on May 32 18, 1994, the commission shall provide for the connection of 33 such agency as soon as practical. An agency which does not 34 certify to the commission that the agency is a part of or 35 -33- LSB 2819XC (13) 84 kh/tm 33/ 82
S.F. _____ intends to become a part of the network as required by this 1 subsection shall be prohibited from using the network. 2 Sec. 40. Section 8D.11, subsection 4, Code 2011, is amended 3 to read as follows: 4 4. A political subdivision receiving communications 5 services from the state as of April 1, 1986, may continue to 6 do so but communications services shall not be provided or 7 resold to additional political subdivisions other than a school 8 corporation, a city library, a library service area as provided 9 in chapter 256 , and a county library as provided in chapter 10 336 . The rates charged to the political subdivision shall be 11 the same as the rates charged to state agencies. 12 Sec. 41. Section 12C.1, subsection 1, Code 2011, is amended 13 to read as follows: 14 1. All funds held by the following officers or institutions 15 shall be deposited in one or more depositories first approved 16 by the appropriate governing body as indicated: for the 17 treasurer of state, by the executive council; for judicial 18 officers and court employees, by the supreme court; for the 19 county treasurer, recorder, auditor, and sheriff, by the board 20 of supervisors; for the city treasurer or other designated 21 financial officer of a city, by the city council; for the 22 county public hospital or merged area hospital, by the board 23 of hospital trustees; for a memorial hospital, by the memorial 24 hospital commission; for a school corporation, by the board 25 of school directors; for a city utility or combined utility 26 system established under chapter 388 , by the utility board; 27 for a library service area established under chapter 256 , 28 by the library service area board of trustees; and for an 29 electric power agency as defined in section 28F.2 or 390.9 , 30 by the governing body of the electric power agency. However, 31 the treasurer of state and the treasurer of each political 32 subdivision or the designated financial officer of a city shall 33 invest all funds not needed for current operating expenses in 34 time certificates of deposit in approved depositories pursuant 35 -34- LSB 2819XC (13) 84 kh/tm 34/ 82
S.F. _____ to this chapter or in investments permitted by section 12B.10 . 1 The list of public depositories and the amounts severally 2 deposited in the depositories are matters of public record. 3 This subsection does not limit the definition of “public funds” 4 contained in subsection 2 . Notwithstanding provisions of this 5 section to the contrary, public funds of a state government 6 deferred compensation plan established by the executive council 7 may also be invested in the investment products authorized 8 under section 509A.12 . 9 Sec. 42. Section 218.22, Code 2011, is amended to read as 10 follows: 11 218.22 Record privileged. 12 Except with the consent of the administrator in charge 13 of an institution, or on an order of a court of record, the 14 record provided in section 218.21 shall be accessible only 15 to the administrator of the division of the department of 16 human services in control of such institution, the director 17 of the department of human services and to assistants and 18 proper clerks authorized by such administrator or the 19 administrator’s director. The administrator of the division 20 of such institution is authorized to permit the division of 21 libraries and information library services of the department 22 of education and the historical division of the department of 23 cultural affairs to copy or reproduce by any photographic, 24 photostatic, microfilm, microcard or other process which 25 accurately reproduces a durable medium for reproducing the 26 original and to destroy in the manner described by law such 27 records of residents designated in section 218.21 . 28 Sec. 43. Section 256.7, unnumbered paragraph 1, Code 2011, 29 is amended to read as follows: 30 Except for the college student aid commission , the 31 commission of libraries and division of library services, and 32 the public broadcasting board and division, the state board 33 shall: 34 Sec. 44. Section 256.7, subsection 17, Code 2011, is amended 35 -35- LSB 2819XC (13) 84 kh/tm 35/ 82
S.F. _____ to read as follows: 1 17. Receive and review the budget and unified plan of 2 service submitted by the division of libraries and information 3 library services. 4 Sec. 45. Section 256.9, unnumbered paragraph 1, Code 2011, 5 is amended to read as follows: 6 Except for the college student aid commission , the 7 commission of libraries and division of library services, and 8 the public broadcasting board and division, the director shall: 9 Sec. 46. Section 256.50, subsection 2, Code 2011, is amended 10 to read as follows: 11 2. “Division” means the division of libraries and 12 information library services of the department of education. 13 Sec. 47. Section 256.51, subsection 1, unnumbered paragraph 14 1, Code 2011, is amended to read as follows: 15 The division of libraries and information library services 16 is established within attached to the department of education 17 for administrative purposes . The state librarian shall be 18 responsible for the division’s budgeting and related management 19 functions in accordance section 256.52, subsection 3. The 20 division shall do all of the following: 21 Sec. 48. Section 256.51, subsection 1, Code 2011, is amended 22 by adding the following new paragraphs: 23 NEW PARAGRAPH . 0a. Provide support services to libraries, 24 including but not limited to consulting, continuing education, 25 interlibrary loan services, and references services to assure 26 consistency of service statewide and to encourage local 27 financial support for library services. 28 NEW PARAGRAPH . l. Allow a public library that receives 29 state assistance under section 256.57, or financial support 30 from a city or county pursuant to section 256.69, to dispose 31 of, through sale, conveyance, or exchange, any library 32 materials that may be obsolete or worn out or that may no 33 longer be needed or appropriate to the mission of the public 34 library. These materials may be sold by the public library 35 -36- LSB 2819XC (13) 84 kh/tm 36/ 82
S.F. _____ directly or the governing body of the public library may 1 sell the materials by consignment to a public agency or to 2 a private agency organized to raise funds solely for support 3 of the public library. Proceeds from the sale of the library 4 materials may be remitted to the public library and may be 5 used by the public library for the purchase of books and other 6 library materials or equipment, or for the provision of library 7 services. 8 Sec. 49. Section 256.51, subsection 1, paragraph d, Code 9 2011, is amended to read as follows: 10 d. Develop, in consultation with the library service areas 11 and the area education agency media centers, a biennial unified 12 plan of service and service delivery for the division of 13 libraries and information library services. 14 Sec. 50. Section 256.51, subsection 1, paragraph j, Code 15 2011, is amended to read as follows: 16 j. Establish and administer standards for state agency 17 libraries , the library service areas, and public libraries. 18 Sec. 51. Section 256.51, subsection 1, paragraph k, Code 19 2011, is amended by striking the paragraph. 20 Sec. 52. Section 256.51, subsection 2, paragraph c, Code 21 2011, is amended to read as follows: 22 c. Accept gifts, contributions, bequests, endowments, 23 or other moneys, including but not limited to the Westgate 24 endowment fund, for any or all purposes of the division. 25 Interest earned on moneys accepted under this paragraph 26 shall be credited to the fund or funds to which the gifts, 27 contributions, bequests, endowments, or other moneys have been 28 deposited, and is available for any or all purposes of the 29 division. The division shall report annually to the director 30 commission and the general assembly regarding the gifts, 31 contributions, bequests, endowments, or other moneys accepted 32 pursuant to this paragraph and the interest earned on them. 33 Sec. 53. Section 256.52, subsection 1, Code 2011, is amended 34 to read as follows: 35 -37- LSB 2819XC (13) 84 kh/tm 37/ 82
S.F. _____ 1. a. The state commission of libraries consists of one 1 member appointed by the supreme court, the director of the 2 department of education, or the director’s designee, and six 3 the following seven members who shall be appointed by the 4 governor to serve four-year terms beginning and ending as 5 provided in section 69.19 . The governor’s appointees shall 6 (1) Two members shall be employed in the state as public 7 librarians. 8 (2) One member shall be a public library trustee. 9 (3) One member shall be employed in this state as an 10 academic librarian. 11 (4) One member shall be employed as a librarian by a school 12 district or area education agency. 13 (5) Two members shall be selected at large. 14 b. The members shall be reimbursed for their actual 15 expenditures necessitated by their official duties. Members 16 may also be eligible for compensation as provided in section 17 7E.6 . 18 Sec. 54. Section 256.52, subsection 3, paragraph b, 19 subparagraphs (1) and (4), Code 2011, are amended to read as 20 follows: 21 (1) Direct and organize the activities of Organize, staff, 22 and administer the division so as to render the greatest 23 benefit to libraries in the state . 24 (4) Appoint and approve the technical, professional, 25 excepting the law librarian, secretarial, and clerical staff 26 necessary to accomplish the purposes of the division subject 27 to chapter 8A, subchapter IV . 28 Sec. 55. Section 256.52, subsection 3, paragraph b, Code 29 2011, is amended by adding the following new subparagraph: 30 NEW SUBPARAGRAPH . (4A) (a) Assume all of the outstanding 31 obligations of the library service areas and be liable for 32 and recognize, assume, and carry out all valid contracts and 33 obligations of the library service areas that are consolidated 34 under the commission and administered by the division effective 35 -38- LSB 2819XC (13) 84 kh/tm 38/ 82
S.F. _____ beginning July 1, 2011. Each library service area shall 1 transfer, prior to July 1, 2011, its state-funded assets and 2 title to any state-funded real estate owned by the library 3 service area to the state librarian. 4 (b) This subparagraph is repealed July 1, 2015. 5 Sec. 56. Section 256.52, subsection 5, Code 2011, is amended 6 to read as follows: 7 5. The commission shall receive and approve the budget and 8 unified plan of service submitted by the division of libraries 9 and information services . 10 Sec. 57. Section 256.54, subsection 1, Code 2011, is amended 11 to read as follows: 12 1. The state library includes but is not limited to a law 13 library the library support network, the specialized library 14 services unit, and the state data center. The law library 15 shall be under the direction of the specialized library 16 services unit. 17 Sec. 58. Section 256.54, subsection 2, unnumbered paragraph 18 1, Code 2011, is amended to read as follows: 19 The law library shall be administered by a law librarian 20 appointed by the director state librarian subject to chapter 21 8A, subchapter IV , who shall do all of the following: 22 Sec. 59. Section 256.55, unnumbered paragraph 1, Code 2011, 23 is amended to read as follows: 24 A state data center is established in the department 25 of education division . The state data center shall be 26 administered by the state data center coordinator, who shall 27 do all of the following: 28 Sec. 60. NEW SECTION . 256.58 Library support network. 29 1. A library support network is established in the division 30 to offer services and programs for libraries, including but not 31 limited to individualized, locally delivered consulting and 32 training, and to facilitate resource sharing and innovation 33 through the use of technology, administer enrich Iowa programs, 34 advocate for libraries, promote excellence and innovation 35 -39- LSB 2819XC (13) 84 kh/tm 39/ 82
S.F. _____ in library services, encourage governmental subdivisions to 1 provide local financial support for local libraries, and ensure 2 the consistent availability of quality service to all libraries 3 throughout the state, regardless of location or size. 4 2. The organizational structure to deliver library support 5 network services shall include district offices. The district 6 offices shall serve as a basis for providing field services 7 to local libraries in the counties comprising the district. 8 The division shall determine which counties are served by each 9 district office. 10 Sec. 61. NEW SECTION . 256.59 Specialized library services. 11 The specialized library services unit is established in the 12 division to provide information services to the three branches 13 of state government and to offer focused information services 14 to the general public in the areas of Iowa law, Iowa state 15 documents, and Iowa history and culture. 16 Sec. 62. NEW SECTION . 256.62 Library services advisory 17 panel. 18 1. The state librarian shall convene a library services 19 advisory panel to advise and recommend to the commission and 20 the division evidence-based best practices, to assist the 21 commission and division to determine service priorities and 22 launch programs, articulate the needs and interests of Iowa 23 librarians, and share research and professional development 24 information. 25 2. The library services advisory panel shall consist of no 26 fewer than eleven members representing libraries of all sizes 27 and types, and various population levels and geographic regions 28 of the state. A simple majority of the members appointed 29 shall be appointed by the executive board of the Iowa library 30 association and the remaining members shall be appointed by 31 the state librarian. Terms of members shall begin and end 32 as provided in section 69.19. Any vacancy shall be filled 33 in the same manner as regular appointments are made for the 34 unexpired portion of the regular term. Members shall serve 35 -40- LSB 2819XC (13) 84 kh/tm 40/ 82
S.F. _____ four-year terms which are staggered at the discretion of the 1 state librarian. A member is eligible for reappointment for 2 three successive terms. The members shall elect a chairperson 3 annually. 4 3. The library services advisory panel shall meet at least 5 twice annually and shall submit its recommendations in a 6 report to the commission and the state librarian at least once 7 annually. The report shall be timely submitted to allow for 8 consideration of the recommendations prior to program planning 9 and budgeting for the following fiscal year. 10 4. Members of the library services advisory panel shall 11 receive actual and necessary expenses incurred in the 12 performance of their duties. Expenses shall be paid from funds 13 appropriated to the department for purposes of the division. 14 Sec. 63. Section 256.70, unnumbered paragraph 1, Code 2011, 15 is amended to read as follows: 16 The division of libraries and information library services 17 of the department of education is hereby authorized to enter 18 into interstate library compacts on behalf of the state of Iowa 19 with any state bordering on Iowa which legally joins therein 20 in substantially the following form and the contracting states 21 agree that: 22 Sec. 64. Section 256.71, Code 2011, is amended to read as 23 follows: 24 256.71 Administrator. 25 The administrator of the division of libraries and 26 information library services shall be the compact 27 administrator. The compact administrator shall receive copies 28 of all agreements entered into by the state or its political 29 subdivisions and other states or political subdivisions; 30 consult with, advise and aid such governmental units in the 31 formulation of such agreements; make such recommendations to 32 the governor, legislature, governmental agencies and units as 33 the administrator deems desirable to effectuate the purposes 34 of this compact and consult and co-operate cooperate with the 35 -41- LSB 2819XC (13) 84 kh/tm 41/ 82
S.F. _____ compact administrators of other party states. 1 Sec. 65. Section 273.2, subsection 4, Code 2011, is amended 2 to read as follows: 3 4. The area education agency board shall provide for special 4 education services and media services for the local school 5 districts in the area and shall encourage and assist school 6 districts in the area to establish programs for gifted and 7 talented children. The board shall assist in facilitating 8 interlibrary loans of materials between school districts and 9 other libraries. Each area education agency shall include 10 as a member of its media center advisory committee a library 11 service area trustee or library service area staff member, who 12 is appointed to the committee by the commission of libraries. 13 Sec. 66. Section 669.2, subsection 5, Code 2011, is amended 14 to read as follows: 15 5. “State agency” includes all executive departments, 16 agencies, boards, bureaus, and commissions of the state of 17 Iowa, and corporations whose primary function is to act as, and 18 while acting as, instrumentalities or agencies of the state of 19 Iowa, whether or not authorized to sue and be sued in their 20 own names. This definition does not include a contractor with 21 the state of Iowa. Soil and water conservation districts 22 as defined in section 161A.3, subsection 6 , and judicial 23 district departments of correctional services as established in 24 section 905.2 , and library service area boards of trustees as 25 established in chapter 256 are state agencies for purposes of 26 this chapter . 27 Sec. 67. Section 904.601, unnumbered paragraph 1, Code 28 2011, is amended to read as follows: 29 The director shall keep the following record of every person 30 committed to any of the department’s institutions: Name, 31 residence, sex, age, place of birth, occupation, civil 32 condition, date of entrance or commitment, date of discharge, 33 whether a discharge is final, condition of the person when 34 discharged, the name of the institutions from which and to 35 -42- LSB 2819XC (13) 84 kh/tm 42/ 82
S.F. _____ which the person has been transferred, and if the person is 1 dead, the date and cause of death. The director may permit 2 the division of libraries and information library services of 3 the department of education and the historical division of 4 the department of cultural affairs to copy or reproduce by 5 any photographic, photostatic, microfilm, microcard, or other 6 process which accurately reproduces in a durable medium and to 7 destroy in the manner described by law the records of inmates 8 required by this paragraph. 9 Sec. 68. REPEAL. Sections 256.60, 256.61, 256.66 through 10 256.68, Code 2011, are repealed. 11 Sec. 69. TRANSITION PROVISION. A governor’s appointee 12 serving on the state commission of libraries on the effective 13 date of this Act shall continue to serve as a member of the 14 commission until the appointee’s term expires. 15 Sec. 70. LIBRARY SERVICE AREA EMPLOYEES —— LENGTH OF SERVICE 16 —— TRANSFER OF PERSONNEL RECORDS. 17 1. The length of service of a permanent employee of a 18 library service area who is employed by a library service area 19 on June 30, 2011, and who is hired by the division of library 20 services on or after July 1, 2011, shall be prorated and 21 credited as state employment service for purposes of vacation 22 and sick leave accrual. 23 2. The area administrator of each library service area 24 shall submit to the division of library services the personnel 25 records of each permanent full-time employee of the library 26 service area by July 1, 2011. 27 Sec. 71. EFFECTIVE UPON ENACTMENT AND RETROACTIVE 28 APPLICABILITY. The section of this division of this Act 29 enacting section 256.52, subsection 3, paragraph “b”, 30 subparagraph (4A), being deemed of immediate importance, takes 31 effect upon enactment, and if approved by the governor on or 32 after July 1, 2011, shall apply retroactively to June 30, 2011. 33 DIVISION III 34 PATHWAYS FOR ACADEMIC CAREER AND EMPLOYMENT PROGRAM 35 -43- LSB 2819XC (13) 84 kh/tm 43/ 82
S.F. _____ Sec. 72. Section 260C.18A, subsection 2, Code 2011, is 1 amended by adding the following new paragraphs: 2 NEW PARAGRAPH . g. Development and implementation of 3 pathways for academic career and employment programs under 4 chapter 260H. 5 NEW PARAGRAPH . h. Development and implementation of 6 programs for the gap tuition assistance program under chapter 7 260I. 8 NEW PARAGRAPH . i. Entrepreneurial education, small business 9 assistance, and business incubators. 10 Sec. 73. NEW SECTION . 260H.1 Title. 11 This chapter shall be known and may be cited as the “Pathways 12 for Academic Career and Employment Act” . 13 Sec. 74. NEW SECTION . 260H.2 Pathways for academic career 14 and employment program. 15 A pathways for academic career and employment program is 16 established to provide funding to community colleges for the 17 development of projects in coordination with the department 18 of economic development, the department of education, Iowa 19 workforce development, regional advisory boards established 20 pursuant to section 84A.4, and community partners to implement 21 a simplified, streamlined, and comprehensive process, 22 along with customized support services, to enable eligible 23 participants to acquire effective academic and employment 24 training to secure gainful, quality, in-state employment. 25 Sec. 75. NEW SECTION . 260H.3 Eligibility criteria. 26 1. Projects eligible for funding for the pathways for 27 academic career and employment program shall be projects that 28 further the ability of members of target populations to secure 29 gainful, quality employment. For the purposes of this chapter, 30 “target population” includes: 31 a. Persons deemed low skilled for the purposes of attaining 32 gainful, quality, in-state employment. 33 b. Persons earning incomes at or below two hundred percent 34 of the federal poverty level as defined by the most recently 35 -44- LSB 2819XC (13) 84 kh/tm 44/ 82
S.F. _____ revised poverty income guidelines published by the United 1 States department of health and human services. 2 c. Unemployed persons. 3 d. Underemployed persons. 4 e. Dislocated workers, including workers eligible for 5 services and benefits under the federal Trade Adjustment Act of 6 2002, Pub. L. No. 107-210, as determined by the department of 7 workforce development and the federal internal revenue service. 8 2. Projects eligible for funding for the pathways for 9 academic career and employment program shall be projects that 10 further partnerships that link the community colleges to 11 industry and nonprofit organizations and projects that further 12 program outcomes as provided in section 260H.4. 13 Sec. 76. NEW SECTION . 260H.4 Program outcomes. 14 Projects eligible for funding for the pathways for academic 15 career and employment program shall be programs which further 16 the following program outcomes: 17 1. Enabling the target populations to: 18 a. Acquire and demonstrate competency in basic skills. 19 b. Acquire and demonstrate competency in a specified 20 technical field. 21 c. Complete a specified level of postsecondary education. 22 d. Earn a national career readiness certificate. 23 e. Obtain employer-validated credentials. 24 f. Secure gainful employment in high-quality, local jobs. 25 2. Satisfaction of economic and employment goals including 26 but not limited to: 27 a. Economic and workforce development requirements in each 28 region served by the community colleges as defined by regional 29 advisory boards established pursuant to section 84A.4. 30 b. Needs of industry partners in areas including but not 31 limited to: 32 (1) Information technology. 33 (2) Health care. 34 (3) Advanced manufacturing. 35 -45- LSB 2819XC (13) 84 kh/tm 45/ 82
S.F. _____ (4) Transportation and logistics. 1 c. Any other industry designated as in-demand by a regional 2 advisory board established pursuant to section 84A.4. 3 Sec. 77. NEW SECTION . 260H.5 Program component 4 requirements. 5 Program components of a pathways for academic career and 6 employment project implemented at a community college shall: 7 1. Include measurable and effective recruitment, 8 assessment, and referral activities designed for the target 9 populations. 10 2. Integrate basics skills and work-readiness training with 11 occupational skills training. 12 3. Combine customized supportive and case management 13 services with training services to help participants overcome 14 barriers to employment. 15 4. Provide training services at times, locations, and 16 through multiple, flexible modalities that are easily 17 understood and readily accessible to the target populations. 18 Such modalities shall support timeless entry, individualized 19 learning, and flexible scheduling, and may include online 20 remediation, learning lab and cohort learning communities, 21 tutoring, and modularization. 22 Sec. 78. NEW SECTION . 260H.6 Pipeline program. 23 Each community college receiving funding for the pathways 24 for academic career and employment program shall develop 25 a pipeline program in order to better serve the academic, 26 training, and employment needs of the target populations. A 27 pipeline program shall have the following goals: 28 1. To strengthen partnerships with community-based 29 organizations and industry representatives. 30 2. To improve and simplify the identification, recruitment, 31 and assessment of qualified participants. 32 3. To conduct and manage an outreach, recruitment, and 33 intake process, along with accompanying support services, 34 reflecting sensitivity to the time and financial constraints 35 -46- LSB 2819XC (13) 84 kh/tm 46/ 82
S.F. _____ and remediation needs of the target populations. 1 4. To conduct orientations for qualified participants 2 to describe regional labor market opportunities, employer 3 partners, and program requirements and expectations. 4 5. To describe the concepts of the project implemented with 5 funds from the pathways for academic career and employment 6 program and the embedded educational and support resources 7 available through such project. 8 6. To outline the basic skills participants will learn and 9 describe the credentials participants will earn. 10 7. To describe success milestones and ways in which temporal 11 and instructional barriers have been minimized or eliminated. 12 8. To review how individualized and customized service 13 strategies for participants will be developed and provided. 14 Sec. 79. NEW SECTION . 260H.7 Career pathways and bridge 15 curriculum development program. 16 Each community college receiving funding for the pathways 17 for academic career and employment program shall develop a 18 career pathways and bridge curriculum development program in 19 order to better serve the academic, training, and employment 20 needs of the target populations. A career pathways and bridge 21 curriculum development program shall have the following goals: 22 1. The articulation of courses and modules, the mapping of 23 programs within career pathways, and establishment of bridges 24 between credit and noncredit programs. 25 2. The integration and contextualization of basic skills 26 education and skills training. This process shall provide for 27 seamless progressions between adult basic education and general 28 education development programs and continuing education and 29 credit certificate, diploma, and degree programs. 30 3. The development of career pathways that support the 31 attainment of industry-recognized credentials, diplomas, and 32 degrees through stackable, modularized program delivery. 33 Sec. 80. NEW SECTION . 260H.8 Rules. 34 The department of education, in consultation with the 35 -47- LSB 2819XC (13) 84 kh/tm 47/ 82
S.F. _____ community colleges, the department of economic development, 1 and Iowa workforce development, shall adopt rules pursuant to 2 chapter 17A and this chapter to implement the provisions of 3 this chapter. Regional advisory boards established pursuant 4 to section 84A.4 shall be consulted in the development and 5 implementation of rules to be adopted pursuant to this chapter. 6 Sec. 81. NEW SECTION . 260I.1 Title. 7 This chapter shall be known and may be cited as the “Gap 8 Tuition Assistance Act” . 9 Sec. 82. NEW SECTION . 260I.2 Gap tuition assistance 10 program. 11 A gap tuition assistance program is established to provide 12 funding to community colleges for need-based tuition assistance 13 to applicants to enable completion of continuing education 14 certificate training programs for in-demand occupations. 15 Sec. 83. NEW SECTION . 260I.3 Applicants for tuition 16 assistance —— eligibility criteria. 17 1. The department of education, in consultation with the 18 department of economic development, shall adopt rules pursuant 19 to this chapter defining eligibility criteria for persons 20 applying to receive tuition assistance under this chapter. 21 2. Eligibility for tuition assistance under this chapter 22 shall be based on financial need. Criteria to be assessed in 23 determining financial need shall include but is not limited to: 24 a. The applicant’s family income for the twelve months prior 25 to the date of application. 26 b. The applicant’s family size. 27 c. The applicant’s county of residence. 28 3. a. An applicant for tuition assistance under this 29 chapter must have a demonstrated capacity to achieve the 30 following outcomes: 31 (1) The ability to complete an eligible certificate 32 program. 33 (2) The ability to enter a postsecondary certificate, 34 diploma, or degree program for credit. 35 -48- LSB 2819XC (13) 84 kh/tm 48/ 82
S.F. _____ (3) The ability to gain full-time employment. 1 (4) The ability to maintain full-time employment over time. 2 b. The community college receiving the application shall 3 only approve an applicant for tuition assistance under this 4 chapter if the community college determines the applicant 5 has a strong likelihood of achieving the outcomes described 6 in paragraph “a” after considering factors including but not 7 limited to: 8 (1) Barriers that may prevent an applicant from completing 9 the certificate program. 10 (2) Barriers that may prevent an applicant from gaining 11 employment in an in-demand occupation. 12 4. Applicants may be found eligible for partial or total 13 tuition assistance. 14 5. Tuition assistance shall not be approved when the 15 community college receiving the application determines that 16 funding for an applicant’s participation in an eligible 17 certificate program is available from any other public or 18 private funding source. 19 Sec. 84. NEW SECTION . 260I.4 Applicants for tuition 20 assistance —— additional provisions. 21 1. An applicant for tuition assistance under this 22 chapter shall provide to the community college receiving the 23 application documentation of all sources of income. 24 2. Only an applicant eligible to work in the United States 25 shall be approved for tuition assistance under this chapter. 26 3. An application shall be valid for six months from the 27 date of signature on the application. 28 4. A person shall not be approved for tuition assistance 29 under this chapter for more than one eligible certificate 30 program. 31 5. Eligibility for tuition assistance under this chapter 32 shall not be construed to guarantee enrollment in any community 33 college certificate program. 34 6. Eligibility for tuition assistance under this chapter 35 -49- LSB 2819XC (13) 84 kh/tm 49/ 82
S.F. _____ shall be limited to persons earning incomes at or below two 1 hundred percent of the federal poverty level as defined by the 2 most recently revised poverty income guidelines published by 3 the United States department of health and human services. 4 Sec. 85. NEW SECTION . 260I.5 Eligible costs. 5 Costs of a certificate program eligible for coverage by 6 tuition assistance shall include but are not limited to: 7 1. Tuition. 8 2. Direct training costs. 9 3. Required books and equipment. 10 4. Fees including but not limited to fees for industry 11 testing services and background check testing services. 12 Sec. 86. NEW SECTION . 260I.6 Eligible certificate programs. 13 For the purposes of this chapter, “eligible certificate 14 program” means a program meeting all of the following criteria: 15 1. The program is not offered for credit, but is aligned 16 with a certificate, diploma, or degree for credit, and does any 17 of the following: 18 a. Offers a state, national, or locally recognized 19 certificate. 20 b. Offers preparation for a professional examination or 21 licensure. 22 c. Provides endorsement for an existing credential or 23 license. 24 d. Represents recognized skill standards defined by an 25 industrial sector. 26 e. Offers a similar credential or training. 27 2. The program offers training or a credential in an 28 in-demand occupation. For the purposes of this chapter, 29 “in-demand occupation” includes occupations in the following 30 industries: 31 a. Information technology. 32 b. Health care. 33 c. Advanced manufacturing. 34 d. Transportation and logistics. 35 -50- LSB 2819XC (13) 84 kh/tm 50/ 82
S.F. _____ e. Any other industry designated as in-demand by a regional 1 advisory board established pursuant to section 84A.4. 2 Sec. 87. NEW SECTION . 260I.7 Initial assessment. 3 An applicant for tuition assistance under this chapter shall 4 complete an initial assessment administered by the community 5 college receiving the application to determine the applicant’s 6 readiness to complete an eligible certificate program. The 7 assessment shall include assessments for completion of a 8 national career readiness certificate, including the areas of 9 reading for information, applied mathematics, and locating 10 information. An applicant must achieve a bronze-level 11 certificate or the minimum score required for an eligible 12 certificate program, whichever is higher, in order to be 13 approved for tuition assistance. An applicant shall complete 14 any additional assessments and occupational research required 15 by an eligible certificate program. 16 Sec. 88. NEW SECTION . 260I.8 Program interview. 17 An applicant for tuition assistance under this chapter shall 18 meet with a member of the staff for an eligible certificate 19 program offered by the community college receiving the 20 application. The staff member shall discuss the relevant 21 industry, any applicable occupational research, and any 22 applicable training relating to the eligible certificate 23 program. The discussion shall include an evaluation of 24 the applicant’s capabilities, needs, family situation, work 25 history, educational background, attitude and motivation, 26 employment skills, vocational potential, and employment 27 barriers. The discussion shall also include potential start 28 dates, support needs, and other requirements for an eligible 29 certificate program. 30 Sec. 89. NEW SECTION . 260I.9 Participation requirements. 31 1. A participant in an eligible certificate program who 32 receives tuition assistance pursuant to this chapter shall do 33 all of the following: 34 a. Maintain regular contact with staff members for the 35 -51- LSB 2819XC (13) 84 kh/tm 51/ 82
S.F. _____ certificate program to document the applicant’s progress in the 1 program. 2 b. Sign a release form to provide relevant information to 3 community college faculty or case managers. 4 c. Discuss with staff members for the certificate program 5 any issues that may impact the participant’s ability to 6 complete the certificate program, obtain employment, and 7 maintain employment over time. 8 d. Attend all required courses regularly. 9 e. Meet with staff members for the certificate program to 10 develop a job search plan. 11 2. A community college may terminate tuition assistance 12 for a participant who fails to meet the requirements of this 13 section. 14 Sec. 90. NEW SECTION . 260I.10 Oversight. 15 1. The department of education, in coordination with the 16 community colleges, shall establish a steering committee. The 17 steering committee shall determine if the performance measures 18 of the gap tuition assistance program are being met and shall 19 take necessary steps to correct any deficiencies. The steering 20 committee shall meet at least quarterly to evaluate and monitor 21 the performance of the gap tuition assistance program. 22 2. The department of education, in coordination with the 23 community colleges, shall develop a common intake tracking 24 system that shall be implemented consistently by each 25 participating community college. 26 3. The department of education shall coordinate statewide 27 oversight, evaluation, and reporting efforts for the gap 28 tuition assistance program. 29 Sec. 91. NEW SECTION . 260I.11 Rules. 30 The department of education, in consultation with the 31 department of economic development and the community colleges, 32 shall adopt rules pursuant to chapter 17A and this chapter to 33 implement the provisions of this chapter. 34 DIVISION IV 35 -52- LSB 2819XC (13) 84 kh/tm 52/ 82
S.F. _____ ORGANIZATIONS REPRESENTING SCHOOL BOARDS, 1 MEMBERS, AND ADMINISTRATORS 2 Sec. 92. Section 279.38, Code 2011, is amended by striking 3 the section and inserting in lieu thereof the following: 4 279.38 Membership in organizations —— requirements. 5 1. As used in this section: 6 a. “Compensation” means the same as defined in section 8F.2, 7 subsection 2. 8 b. “Organization” means a local, state, regional, or 9 national organization which relates to the functions of 10 the board of directors of a school district or to the 11 administrators of a school district and to which a school board 12 pays monetary fees for products or services or annual dues in 13 accordance with subsection 2. “Organization” includes a related 14 for-profit or not-for-profit subsidiary of an organization. 15 2. a. The board of directors of a school district, the 16 duly elected members of the school board, and designated 17 administrators of school districts may join or participate in 18 organizations, including but not limited to organizations such 19 as the Iowa association of school boards, the urban education 20 network, Iowa school finance information services, and the 21 school administrators of Iowa. The school board may pay out 22 of funds available to the school board reasonable monetary 23 fees for products or services or annual dues for membership of 24 the school board, or a board member or administrator, in such 25 an organization. Such an organization that receives fees or 26 dues for membership from a school board shall be considered a 27 taxpayer-funded organization. 28 b. Each school board that pays monetary fees or annual dues 29 to an organization shall annually report to the local community 30 and to the department of education the amount paid in annual 31 dues, fees, or assessments for products or services received 32 from the organization, and the total amount of any revenue 33 or dividend payments received from the organization. S.F. _____ in the format specified by the department. 1 3. The financial condition and transactions of an 2 organization shall be audited as provided in section 11.6. 3 The organization shall establish an audit committee to review 4 the financial condition and transactions of the organization 5 and the report of examination conducted in accordance with 6 this subsection. The auditor conducting an examination in 7 accordance with this subsection shall have full access to the 8 audit committee and to all of the organization’s records, 9 reports, audits, tax reports, and all other documents and 10 papers issued or maintained by the organization. 11 4. An organization shall do all of the following: 12 a. Publish annually on its internet site, and in a report 13 submitted annually to the department of education, the standing 14 committees on government oversight, and the general assembly, 15 all of the following: 16 (1) A listing of the school districts that pay fees or dues 17 for membership in the organization and the moneys paid by each 18 school district. 19 (2) The total revenue the organization receives from each 20 school district resulting from the payment of monetary fees or 21 annual dues, and the total net profit from the sale of products 22 and services to the school district by the organization. 23 (3) An accounting, broken down by individual employee, 24 of the total amount of moneys expended for reimbursement of 25 expenses incurred by and compensation paid to each of the ten 26 highest paid employees of the organization as evidenced by the 27 tax forms submitted by the organization to the internal revenue 28 service. 29 (4) An accounting of all moneys expended for reimbursement 30 of expenses incurred by and compensation paid to all 31 legislative representatives and lobbyists of the organization. 32 b. Submit to the general assembly and the standing committee 33 on government oversight copies of all reports the organization 34 provides to the United States department of education relating 35 -54- LSB 2819XC (13) 84 kh/tm 54/ 82
S.F. _____ to federal grants and grant amounts that the organization 1 administers or distributes to school districts. 2 c. Provide education and training to the organization’s 3 board members in the fiduciary duties and legal 4 responsibilities of members. 5 5. An organization shall not pay an employee or officer 6 of the organization, a member of the organization’s governing 7 board, or a legislative representative or lobbyist for the 8 organization, a bonus or other consideration of any type which 9 is in addition to compensation paid and published and reported 10 as required by subsection 4. In addition, the organization 11 shall not allow any other entity to pay an employee or 12 officer of the organization, a member of the organization’s 13 governing board, or a legislative representative or lobbyist 14 for the organization for services performed on behalf of the 15 organization. However, the organization may pay an employee 16 a commission if the terms for paying the commission are in 17 writing under an agreement which is a public document and the 18 employee’s compensation, which shall list the amount of the 19 commission, is published and reported in the same manner as 20 provided in subsection 4. 21 6. a. A person who serves as the head of an organization 22 or otherwise serves in a supervisory capacity within the 23 organization shall not require an employee of the organization 24 to inform the person that the employee made a disclosure 25 of information permitted by this subsection and shall not 26 prohibit an employee of the organization from disclosing any 27 information to a member of the governing board or to any 28 public official, a law enforcement agency, a state agency, the 29 auditor of state or an auditor conducting an examination of 30 the organization in accordance with section 11.6, the office 31 of the attorney general, the office of citizens’ aide, or to a 32 committee of the general assembly if the employee reasonably 33 believes the information evidences a violation of law or rule, 34 mismanagement, a gross abuse of funds, an abuse of authority, 35 -55- LSB 2819XC (13) 84 kh/tm 55/ 82
S.F. _____ or a substantial and specific danger to public health or 1 safety. However, an employee may be required to inform the 2 person that the employee made a disclosure of information 3 permitted by this subsection if the employee represented that 4 the disclosure was the official position of the employee’s 5 immediate supervisor or employer. 6 b. A person shall not discharge an employee from or take 7 or fail to take action regarding an employee’s appointment or 8 proposed appointment to, promotion or proposed promotion to, 9 or any advantage in, a position administered by, or subject 10 to approval of, the person or the organization’s governing 11 board as a reprisal for a failure by that employee to inform 12 the person that the employee made a disclosure of information 13 permitted by this subsection, or for a disclosure of any 14 information by that employee authorized under paragraph “a” 15 if the employee reasonably believes the information evidences 16 a violation of law or rule, mismanagement, a gross abuse of 17 funds, an abuse of authority, or a substantial and specific 18 danger to public health or safety. However, an employee may 19 be required to inform the person that the employee made a 20 disclosure of information permitted by this subsection if the 21 employee represented that the disclosure was the official 22 position of the employee’s immediate supervisor or employer. 23 c. Paragraphs “a” and “b” do not apply if the disclosure of 24 the information is prohibited by statute. 25 d. A person who violates paragraph “a” or “b” commits a 26 simple misdemeanor. 27 e. Paragraph “b” may be enforced through a civil action. 28 (1) A person who violates paragraph “b” is liable to 29 an aggrieved employee for affirmative relief including 30 reinstatement, with or without back pay, or any other equitable 31 relief the court deems appropriate, including attorney fees and 32 costs. 33 (2) When a person commits, is committing, or proposes to 34 commit an act in violation of paragraph “b” , an injunction may 35 -56- LSB 2819XC (13) 84 kh/tm 56/ 82
S.F. _____ be granted through an action in district court to prohibit the 1 person from continuing such acts. The action for injunctive 2 relief may be brought by an aggrieved employee or the attorney 3 general. 4 f. A person shall not discharge an employee from or take 5 or fail to take action regarding an employee’s appointment or 6 proposed appointment to, promotion or proposed promotion to, 7 or any advantage in, a position administered by, or subject 8 to approval of, the person or the organization’s governing 9 board as a reprisal for the employee’s declining to participate 10 in contributions or donations to charities or community 11 organizations. 12 g. The person and the organization’s governing board 13 shall provide procedures for notifying the organization’s 14 new employees of the provisions of this subsection and shall 15 periodically conduct promotional campaigns to provide similar 16 information to the organization’s employees. The information 17 shall include the toll-free telephone number of the citizens’ 18 aide. 19 7. a. Except as otherwise provided in paragraph “b” , all 20 meetings of the governing board of the organization shall 21 comply with the requirements of chapter 21 and all records of 22 the governing board and the organization shall be maintained 23 in accordance with chapter 22. 24 b. The governing board of the organization may keep the 25 following records confidential and the governing board may hold 26 a closed session meeting to discuss the following matters: 27 (1) Personal information in confidential personnel records 28 maintained by the governing board of the organization and 29 required or authorized to be kept confidential by law. 30 (2) Discussions with, or the work product of, an attorney of 31 the governing board of the organization required or authorized 32 to be kept confidential by law. 33 (3) Pricing, product, service, business strategy, or 34 marketing information which if released, would give an 35 -57- LSB 2819XC (13) 84 kh/tm 57/ 82
S.F. _____ advantage to competitors, vendors, or other parties and that 1 serve no public purpose. 2 Sec. 93. REPEAL. Section 279.38A, Code 2011, is repealed. 3 Sec. 94. The early childhood Iowa state board shall direct 28 staff to work with the early childhood stakeholders alliance 29 created in section 256I.12 to inventory technical assistance 30 needs. Moneys allocated under this lettered paragraph may be 31 used by the early childhood Iowa state board for the purpose of 32 skills development and support for ongoing training of staff. 33 However, except as otherwise provided in this subsection, 34 moneys shall not be used for additional staff or for the 35 -63- LSB 2819XC (13) 84 kh/tm 63/ 82

As a condition of receiving moneys appropriated in 2 this subsection, each early childhood Iowa area board shall 3 report to the early childhood Iowa state board progress on 4 each of the local indicators approved by the area board. Each 5 early childhood Iowa area board must also submit an annual 6 budget for the area’s comprehensive school ready children 7 grant developed for providing services for children from birth 8 through five years of age, and provide other information 9 specified by the early childhood Iowa state board, including 10 budget amendments as needed. The early childhood Iowa state 11 board shall establish a submission deadline for the annual 12 budget and any budget amendments that allow a reasonable period 13 of time for preparation by the early childhood Iowa area boards 14 and for review and approval or request for modification of 15 the materials by the early childhood Iowa state board. In 16 addition, each early childhood Iowa area board must continue to 17 comply with reporting provisions and other requirements adopted 18 by the early childhood Iowa state board in implementing section 19 256I.9. 20 c. Of the amount appropriated in this subsection for 21 deposit in the school ready children grants account of the 22 early childhood Iowa fund, $1,159,009 shall be used for efforts 23 to improve the quality of early care, health, and education 24 programs. Moneys allocated pursuant to this paragraph may be 25 used for additional staff and for the reimbursement of staff. 26 The early childhood Iowa state board may reserve a portion 27 of the allocation, not to exceed $44,325, for the technical 28 assistance expenses of the early childhood Iowa state office, 29 including the reimbursement of staff, and shall distribute 30 the remainder to early childhood Iowa areas for local quality 31 improvement efforts through a methodology identified by the 32 early childhood Iowa state board to make the most productive 33 use of the funding, which may include use of the distribution 34 formula, grants, or other means. 35 -64- LSB 2819XC (13) 84 kh/tm 64/ 82

ENERGY COST-SAVINGS PROJECTS —— FINANCING. For 18 the fiscal year beginning July 1, 2012, and ending June 30, 19 2013, the state board of regents may use notes, bonds, or 20 other evidences of indebtedness issued under section 262.48 to 21 finance projects that will result in energy cost savings in an 22 amount that will cause the state board to recover the cost of 23 the projects within an average of six years. 24 Sec. 103. PRESCRIPTION DRUG COSTS. Notwithstanding section 25 270.7, the department of administrative services shall pay 26 the state school for the deaf and the Iowa braille and sight 27 saving school the moneys collected from the counties during the 28 fiscal year beginning July 1, 2012, for expenses relating to 29 prescription drug costs for students attending the state school 30 for the deaf and the Iowa braille and sight saving school. 31 DIVISION VI 32 CONDITIONAL EFFECTIVE DATE AND RETROACTIVE APPLICABILITY 33 Sec. 104. EFFECTIVE DATE AND RETROACTIVE 34 APPLICABILITY. Unless otherwise provided, this Act, if 35 -73- LSB 2819XC (13) 84 kh/tm 73/ 82
S.F. _____ approved by the governor on or after July 1, 2011, takes effect 1 upon enactment and applies retroactively to July 1, 2011. 2 EXPLANATION 3 FY 2011-2012 APPROPRIATIONS. This division of this bill 4 appropriates moneys for fiscal year 2011-2012 from the general 5 fund of the state to the college student aid commission, the 6 department for the blind, the department of education, and the 7 state board of regents and its institutions. 8 The division appropriates to the department for the blind 9 for its administration and for costs for universal access to 10 audio information. 11 The division includes appropriations to the college student 12 aid commission for general administrative purposes, student 13 aid programs, loan forgiveness for health care professionals, 14 the national guard educational assistance program, the teacher 15 shortage loan forgiveness program, the all Iowa opportunity 16 foster care grant and scholarship programs, the registered 17 nurse loan and nurse educator forgiveness program, and the 18 barber and cosmetology arts and sciences tuition grant program. 19 The division replaces the osteopathic physician recruitment 20 program with a health care professionals recruitment program, 21 and eliminates the osteopathic forgivable loan program, the 22 match requirement under the program for Des Moines university, 23 and the osteopathic tuition scholarship. 24 The division makes the children of certain peace officers, 25 police officers, sheriffs, and deputy sheriffs who are 26 permanently and totally disabled or who are killed in the line 27 of duty eligible for all Iowa opportunity foster care grants. 28 The division reduces the standing appropriations for Iowa 29 tuition and vocational-technical grants and provides that 30 a for-profit institution which, effective January 8, 2010, 31 purchased an accredited nonprofit private institution, Waldorf 32 College, shall be an eligible institution under the tuition 33 grant program. The division notwithstands the $2.75 million 34 standing appropriation for the Iowa work-study program and 35 -74- LSB 2819XC (13) 84 kh/tm 74/ 82
S.F. _____ provides that the amount appropriated for fiscal year 2011-2012 1 is zero. 2 The division appropriates moneys to the department 3 of education for purposes of the department’s general 4 administration, vocational education administration, 5 division of vocational rehabilitation services including 6 independent living and the entrepreneurs with disabilities 7 program and independent living centers, state library for 8 general administration and the enrich Iowa program, library 9 service area system, public broadcasting division, regional 10 telecommunications councils, vocational education to secondary 11 schools, school food service, early childhood Iowa fund, 12 expansion of the federal Individuals with Disabilities 13 Education Improvement Act birth through age three services, 14 textbooks for nonpublic school pupils, the student achievement 15 and teacher quality program, and community colleges. 16 The division provides for the transfer of moneys from the 17 licensing fees collected during FY 2010-2011 by the board 18 of educational examiners to the department of education for 19 purposes of vocational rehabilitation. The provision takes 20 effect upon enactment, and if approved by the governor on or 21 after July 1, 2011, applies retroactively to June 30, 2011. 22 From the appropriation made to the department of education 23 for the 2010-2011 fiscal year for purposes of the student 24 achievement and teacher quality program, the division transfers 25 specified amounts for purposes of vocational education 26 administration, reimbursement for vocational education 27 expenditures to secondary schools, and school food service 28 for the 2010-2011 fiscal year; and provides that the transfer 29 provision takes effect upon enactment, and if approved by the 30 governor on or after July 1, 2011, applies retroactively to 31 June 30, 2011. 32 The division amends statute to authorize area early 33 childhood Iowa boards to use grant moneys to pay for regular 34 audits, to add that it is the intent of the general assembly 35 -75- LSB 2819XC (13) 84 kh/tm 75/ 82
S.F. _____ that priority for home visitation program funding be given to 1 programs using evidence-based or promising models for home 2 visitation, to provide students receiving competent private 3 instruction with more options for demonstrating proficiency to 4 ensure student readiness for postsecondary coursework under 5 the senior year plus program eligibility requirements, and 6 to change the allocations under the student achievement and 7 teacher quality program. 8 The division makes statutory changes relating to regional 9 academies. Currently, a regional academy is a program 10 established by a school district to which multiple school 11 districts send students in grades 9 through 12, and which may 12 include internet-based coursework and courses delivered via 13 the Iowa communications network. The division lowers the 14 grade level limit to grades 7 through 12, and adds that a 15 school district establishing a regional academy may collaborate 16 and partner with, enter into an agreement pursuant to Code 17 chapter 28E with, or enter into a contract with, two or more 18 school districts, area education agencies, community colleges, 19 accredited public and private postsecondary institutions, 20 accredited nonpublic schools, businesses, and private agencies 21 located within or outside of the state. If a school district 22 submits a plan to the department of education for approval 23 that demonstrates how it will increase and assess student 24 achievement or increase and assess competency-based learning 25 opportunities for students, the department may waive or 26 modify certain statutory or regulatory provisions applicable 27 to school districts in order to provide the regional academy 28 additional flexibility. The division strikes language that 29 prohibits a regional academy course from qualifying as a 30 concurrent enrollment course. A regional academy may include 31 in its curriculum virtual or internet-based coursework and 32 courses delivered via the Iowa communications network, career 33 and technical courses, core curriculum coursework, courses 34 required for graduation or under the educational standards, and 35 -76- LSB 2819XC (13) 84 kh/tm 76/ 82
S.F. _____ asynchronous learning networks. Regional academies may receive 1 supplementary weighting. The division provides that the school 2 districts participating in the regional academy must enter 3 into an agreement on how the supplementary weighting received 4 shall be used and must submit the agreement to the department 5 for approval. The division eliminates an outdated provision 6 relating to supplementary weighting for regional academies. 7 These provisions take effect July 1, 2012, and are applicable 8 to school years beginning on or after that date. 9 The division amends statute to permit children to qualify 10 for school district home school assistance programs if they 11 are school age, rather than compulsory attendance age. The 12 division also requires school districts to expend moneys 13 received from weighted enrollment of children receiving 14 competent private instruction at home on home school assistance 15 programs and broadens the acceptable uses of the state 16 assistance school districts receive from additional weighting 17 for students receiving competent private instruction from 18 a licensed practitioner provided through a public school 19 district. Funds received for purposes of providing a program, 20 under the division, may be used for instructing students; for 21 equipment or facility acquisition, including the lease or 22 rental of space to supplement existing schoolhouse facilities; 23 and for operational, maintenance, or administrative costs other 24 than those costs necessary to operate, maintain, and administer 25 the program. 26 The division appropriates moneys to the state board of 27 regents for the board office, universities’ general operating 28 budgets; the southwest Iowa graduate studies center; the 29 siouxland interstate metropolitan planning council; the 30 quad-cities graduate studies center; Iowa public radio; the 31 state university of Iowa; Iowa state university of science 32 and technology; the university of northern Iowa; and for the 33 Iowa school for the deaf and the Iowa braille and sight saving 34 school, including tuition and transportation costs for students 35 -77- LSB 2819XC (13) 84 kh/tm 77/ 82
S.F. _____ residing in the schools and licensed classroom teachers. 1 The division allows the state board of regents to use 2 indebtedness to finance certain projects resulting in energy 3 savings. 4 The division also requires the department of administrative 5 services to pay the state school for the deaf and the Iowa 6 braille and sight saving school moneys collected from counties 7 for expenses related to prescription drug costs for students 8 attending the schools. 9 The division amends statute to provide that the state board 10 of regents may authorize its institutions to commission one or 11 more of its employees as peace officers, with the same powers, 12 duties, and privileges and immunities as conferred on regular 13 peace officers. The bill strikes language that limits these 14 powers and duties to actions taken when the officers are acting 15 in the interests of the institution. 16 The division also establishes within the international 17 center for talented and gifted education at the state 18 university of Iowa the Iowa online advanced placement academy 19 science, technology, engineering, and mathematics (STEM) 20 initiative, the purpose of which is to deliver preadvanced 21 placement and advanced placement courses to high school 22 students throughout the state, provide training opportunities 23 for teachers to learn how to teach advanced placement courses 24 in Iowa’s high schools, and provide preparation for middle 25 school students to ensure success in high school. 26 LIBRARY PROVISIONS. This division changes the name of the 27 division of libraries and information services within the 28 department of education to the division of library services; 29 establishes that the division is attached to the department 30 for administrative purposes only; establishes within the 31 division a library support network and a specialized library 32 services unit; expands the membership of the commission of 33 libraries; directs the state librarian to convene a library 34 services advisory panel; and eliminates the library service 35 -78- LSB 2819XC (13) 84 kh/tm 78/ 82
S.F. _____ areas effective July 1, 2011, transfers their duties to the 1 division, and directs the state librarian to assume all of the 2 outstanding obligations of the library service areas. The 3 provision directing each library service area to transfer its 4 state-funded assets and title to any state-funded real estate 5 it owns to the state librarian takes effect upon enactment, and 6 if approved by the governor on or after July 1, 2011, shall 7 apply retroactively to June 30, 2011. 8 PATHWAYS FOR ACADEMIC CAREER AND EMPLOYMENT PROGRAM. This 9 division establishes the pathways for academic career and 10 employment program and the gap tuition assistance program. 11 The pathways for academic career and employment program 12 provides funding to community colleges to develop projects 13 in coordination with public and private partners to enable 14 participants to acquire academic and employment training and 15 to secure gainful, quality, in-state employment in in-demand 16 industries. The division sets out eligibility criteria for 17 participants and projects, program outcomes, and program 18 components. 19 The gap tuition assistance program provides funding to 20 community colleges for need-based tuition assistance to 21 applicants to enable completion of continuing education 22 certificate training programs for in-demand occupations. The 23 division sets out eligibility criteria for participants and 24 certificate training programs. The division sets out program 25 components and requirements. 26 The division includes the pathways for academic career 27 and employment program, the gap tuition assistance program, 28 entrepreneurial education, small business assistance, and 29 business incubators as eligible purposes for community colleges 30 to use moneys deposited in their workforce training and 31 economic development funds pursuant to Code section 260C.18A. 32 ORGANIZATIONS REPRESENTING SCHOOL BOARDS, MEMBERS, AND 33 ADMINISTRATORS. This division strikes Code section 279.38 and 34 repeals Code section 279.38A, but combines much of the language 35 -79- LSB 2819XC (13) 84 kh/tm 79/ 82
S.F. _____ of these two Code sections to modify the statutory requirements 1 of organizations to which school boards, school board members, 2 and school district administrators may join and pay monetary 3 fees for products or services or annual dues for membership. 4 School boards, board members, and school administrators may 5 join and participate in local, state, regional, and national 6 organizations which relate to the administrator or school 7 board functions of the school district. Such organizations 8 include but are not limited to the Iowa association of school 9 boards, the urban education network, Iowa school finance 10 information services, and the school administrators of Iowa. 11 Such an organization shall be considered a taxpayer-funded 12 organization. 13 Each board that pays fees or dues must annually report the 14 local community and to the department of education the amount 15 the board pays in annual dues to the organization and the 16 amount of any fees or assessments paid, and revenue or dividend 17 payments received, for services received from the organization, 18 and the products or services received from the organization. 19 The division requires that the information be submitted to 20 the department electronically in the format specified by the 21 department. 22 The financial condition and transactions of the 23 organizations shall be audited in the same manner as school 24 districts. Under the division, the organization must establish 25 an audit committee to review the financial condition and 26 transactions of the organization and the audit report. 27 Such an organization must publish annually, on its internet 28 site and in a report submitted annually to the department of 29 education, the standing committees on government oversight, and 30 the general assembly, a listing of the school districts and the 31 fees and dues paid by each school district; the total revenue 32 the organization receives from each school district resulting 33 from the payment of membership fees or dues; the total revenue 34 received from each school district from the payment of fees 35 -80- LSB 2819XC (13) 84 kh/tm 80/ 82
S.F. _____ or dues, and the total net profit from the sale of products 1 and services to the school district by the organization; 2 the total amount of the annual compensation and expenses 3 paid to the organization’s 10 highest paid employees, broken 4 down by individual employee; and an accounting of all moneys 5 expended for reimbursement of expenses and compensation paid to 6 legislative representatives and lobbyists of the organization. 7 Under the division, the organization must also submit to 8 the general assembly copies of any report the organization 9 provides to the U.S. department of education. The organization 10 must also provide education and training to its board members 11 regarding their fiduciary duties and legal responsibilities. 12 The division prohibits an organization from paying bonuses 13 or other consideration to employees, officers, board members, 14 or lobbyists, but allows an organization to pay a commission to 15 an employee under certain circumstances. 16 The division also prohibits the head of the organization 17 from requiring an employee to inform the person that the 18 employee disclosed information, and prohibits the person 19 taking adverse employment action against an employee of the 20 organization who discloses information, about the organization 21 to a board member, any public official, a law enforcement 22 agency, a state agency, the auditor of state or an auditor 23 conducting an examination in accordance with Code section 11.6, 24 the office of the attorney general, the office of citizens’ 25 aide, or to a committee of the general assembly if the employee 26 reasonably believes the information evidences a violation 27 of law or rule, mismanagement, a gross abuse of funds, an 28 abuse of authority, or a substantial or specific danger to 29 public health or safety. The provisions do not apply if the 30 disclosure of information is prohibited by statute. A person 31 who violates the prohibitions commits a simple misdemeanor 32 and may be liable to an aggrieved employee for affirmative 33 relief. The prohibition against adverse action may be 34 enforced through a civil action, and the employee may bring an 35 -81- LSB 2819XC (13) 84 kh/tm 81/ 82
S.F. _____ action for injunctive relief by the district court. Adverse 1 action against an employee for declining to participate in 2 contributions or donations is also prohibited. The person and 3 the organization must provide employee notification procedures 4 relating to these prohibitions and remedies and must conduct 5 related promotional campaigns. 6 The organization’s governing boards meetings are subject to 7 Code chapter 21 (open meetings) and the governing board and the 8 organization’s records must be maintained in compliance with 9 Code chapter 22 (open records). 10 This division takes effect upon enactment, and if approved 11 by the governor on or after July 1, 2011, applies retroactively 12 to June 30, 2011. 13 FY 2012-2013. This division of the bill appropriates moneys 14 for fiscal year 2012-2013 from the general fund of the state 15 to the college student aid commission, the department for the 16 blind, the department of education, and the state board of 17 regents and its institutions. 18 CONDITIONAL EFFECTIVE DATE AND RETROACTIVE APPLICABILITY. 19 Unless otherwise provided, the bill, if approved by the 20 governor on or after July 1, 2011, takes effect upon enactment 21 and applies retroactively to July 1, 2011. 22 -82- LSB 2819XC (13) 84 kh/tm 82/ 82
