GOALS AND ACCOUNTABILITY —— ECONOMIC DEVELOPMENT. 13 1. For the fiscal year beginning July 1, 2011, the goals for 14 the department of economic development shall be to expand and 15 stimulate the state economy, increase the wealth of Iowans, and 16 increase the population of the state. 17 2. To achieve the goals in subsection 1, the department 18 of economic development shall do all of the following for the 19 fiscal year beginning July 1, 2011: 20 a. Concentrate its efforts on programs and activities that 21 result in commercially viable products and services. 22 b. Adopt practices and services consistent with free 23 market, private sector philosophies. 24 c. Ensure economic growth and development throughout the 25 state. 26 d. Work with businesses and communities to continually 27 improve the economic development climate along with the 28 economic well-being and quality of life for Iowans. 29 e. Coordinate with other state agencies to ensure that they 30 are attentive to the needs of an entrepreneurial culture. 31 f. Establish a strong and aggressive marketing image to 32 showcase Iowa’s workforce, existing industry, and potential. 33 A priority shall be placed on recruiting new businesses, 34 business expansion, and retaining existing Iowa businesses. 35 -2- LSB 1002SB (3) 84 tw/tm 2/ 17
S.F. _____ Emphasis shall be placed on entrepreneurial development through 1 helping entrepreneurs secure capital, and developing networks 2 and a business climate conducive to entrepreneurs and small 3 businesses. 4 g. Encourage the development of communities and quality of 5 life to foster economic growth. 6 h. Prepare communities for future growth and development 7 through development, expansion, and modernization of 8 infrastructure. 9 i. Develop public-private partnerships with Iowa businesses 10 in the tourism industry, Iowa tour groups, Iowa tourism 11 organizations, and political subdivisions in this state to 12 assist in the development of advertising efforts. 13 j. Develop, to the fullest extent possible, cooperative 14 efforts for advertising with contributions from other sources. 15 Sec. 3. DEPARTMENT OF ECONOMIC DEVELOPMENT. 16 1. APPROPRIATION 17 There is appropriated from the general fund of the state 18 to the department of economic development for the fiscal year 19 beginning July 1, 2011, and ending June 30, 2012, the following 20 amounts, or so much thereof as is necessary, to be used for the 21 purposes designated in subsection 2, and for not more than the 22 following full-time equivalent positions: 23 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 10,047,229 24 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . For salaries, support, miscellaneous purposes, programs, 27 and the maintenance of an administration division, a business 28 development division, and a community development division. 29 b. The full-time equivalent positions authorized under this 30 section shall be funded, in whole or in part, by the moneys 31 appropriated under subsection 1 or by other moneys received by 32 the department, including certain federal moneys. 33 c. For business development operations and programs, the 34 film office, international trade, export assistance, workforce 35 -3- LSB 1002SB (3) 84 tw/tm 3/ 17
S.F. _____ recruitment, and the partner state program. 1 d. For transfer to the strategic investment fund created in 2 section 15.313. 3 e. For transfer to the grow Iowa values fund created in 4 section 15G.111. 5 f. For community economic development programs, tourism 6 operations, community assistance, plans for Iowa green corps 7 and summer youth programs, the mainstreet and rural mainstreet 8 programs, the school-to-career program, the community 9 development block grant, and housing and shelter-related 10 programs. 11 g. For achieving the goals and accountability, and 12 fulfilling the requirements and duties required under this Act. 13 3. NONREVERSION 14 Notwithstanding section 8.33, moneys appropriated in 15 subsection 1 that remain unencumbered or unobligated at the 16 close of the fiscal year shall not revert but shall remain 17 available for expenditure for the purposes designated in 18 subsection 2 until the close of the succeeding fiscal year. 19 4. FINANCIAL ASSISTANCE RESTRICTIONS 20 a. A business creating jobs through moneys appropriated in 21 this section shall be subject to contract provisions requiring 22 new and retained jobs to be filled by individuals who are 23 citizens of the United States who reside within the United 24 States or any person authorized to work in the United States 25 pursuant to federal law, including legal resident aliens in the 26 United States. 27 b. Any vendor who receives moneys appropriated in this 28 section shall adhere to such contract provisions and provide 29 periodic assurances as the state shall require that the jobs 30 are filled solely by citizens of the United States who reside 31 within the United States or any person authorized to work in 32 the United States pursuant to federal law, including legal 33 resident aliens in the United States. 34 c. A business that receives financial assistance from the 35 -4- LSB 1002SB (3) 84 tw/tm 4/ 17
S.F. _____ department from moneys appropriated in this section shall 1 only employ individuals legally authorized to work in this 2 state. In addition to all other applicable penalties provided 3 by current law, all or a portion of the assistance received 4 by a business which is found to knowingly employ individuals 5 not legally authorized to work in this state is subject to 6 recapture by the department. 7 5. USES OF APPROPRIATIONS 8 a. From the moneys appropriated in this section, the 9 department may provide financial assistance in the form of a 10 grant to a community economic development entity for conducting 11 a local workforce recruitment effort designed to recruit former 12 citizens of the state and former students at colleges and 13 universities in the state to meet the needs of local employers. 14 b. From the moneys appropriated in this section, the 15 department may provide financial assistance to early stage 16 industry companies being established by women entrepreneurs. 17 c. From the moneys appropriated in this section, the 18 department may provide financial assistance in the form of 19 grants, loans, or forgivable loans for advanced research and 20 commercialization projects involving value-added agriculture, 21 advanced technology, or biotechnology. 22 6. WORLD FOOD PRIZE 23 For allocating moneys for the world food prize and 24 notwithstanding the standing appropriation in section 15.368, 25 subsection 1 : 26 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 650,000 27 7. FTEs 7.00 9 Of the moneys appropriated in this subsection, the 10 department shall allocate $75,000 for purposes of the Iowa 11 state commission grant program and $103,133 for purposes of the 12 Iowa’s promise and mentoring partnership programs. 13 Notwithstanding section 8.33 , moneys appropriated in this 14 subsection that remain unencumbered or unobligated at the close 15 of the fiscal year shall not revert but shall remain available 16 for expenditure for the purposes designated until the close of 17 the succeeding fiscal year. 18 Sec. 4. VISION IOWA PROGRAM —— FTE AUTHORIZATION. For 19 purposes of administrative duties associated with the vision 20 Iowa program, the department of economic development is 21 authorized an additional 2.25 FTEs above those otherwise 22 authorized in this Act. 23 Sec. 5. INSURANCE ECONOMIC DEVELOPMENT. From the moneys 24 collected by the division of insurance in excess of the 25 anticipated gross revenues under section 505.7, subsection 3 , 26 during the fiscal year beginning July 1, 2011, $100,000 shall 27 be transferred to the department of economic development for 28 insurance economic development and international insurance 29 economic development. 30 Sec. 6. COMMUNITY DEVELOPMENT LOAN FUND. Notwithstanding 31 section 15E.120, subsection 5 , there is appropriated from the 32 Iowa community development loan fund all moneys available 33 during the fiscal year beginning July 1, 2011, and ending 34 June 30, 2012, to the department of economic development for 35 -6- LSB 1002SB (3) 84 tw/tm 6/ 17
S.F. _____ purposes of the community development program. 1 Sec. 7. WORKFORCE DEVELOPMENT FUND. There is appropriated 2 from the workforce development fund account created in section 3 15.342A to the workforce development fund created in section 4 15.343 for the fiscal year beginning July 1, 2011, and ending 5 June 30, 2012, the following amount, for purposes of the 6 workforce development fund: 7 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 4,000,000 8 Sec. 8. WORKFORCE DEVELOPMENT ADMINISTRATION. From moneys 9 appropriated or transferred to or receipts credited to the 10 workforce development fund created in section 15.343 , up to 11 $400,000 for the fiscal year beginning July 1, 2011, and ending 12 June 30, 2012, are appropriated to the department of economic 13 development for the administration of workforce development 14 activities including salaries, support, maintenance, and 15 miscellaneous purposes, and for not more than the following 16 full-time equivalent positions: 17 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . FTEs 4.00 18 Sec. 9. JOB TRAINING FUND. Notwithstanding section 15.251 , 19 all moneys in the job training fund on July 1, 2011, and any 20 moneys appropriated or credited to the fund during the fiscal 21 year beginning July 1, 2011, shall be transferred to the 22 workforce development fund established pursuant to section 23 15.343 . 24 Sec. 10. IOWA STATE UNIVERSITY. 25 1. There is appropriated from the general fund of the state 26 to Iowa state university of science and technology for the 27 fiscal year beginning July 1, 2011, and ending June 30, 2012, 28 the following amount, or so much thereof as is necessary, to 29 be used for small business development centers, the science 30 and technology research park, and the institute for physical 31 research and technology, and for not more than the following 32 full-time equivalent positions: 33 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 2,575,983 34 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . Of the moneys appropriated in subsection 1, Iowa state 1 university of science and technology shall allocate at least 2 $994,929 for purposes of funding small business development 3 centers. Iowa state university of science and technology may 4 allocate moneys appropriated in subsection 1 to the various 5 small business development centers in any manner necessary to 6 achieve the purposes of this subsection. 7 3. Iowa state university of science and technology shall do 8 all of the following: 9 a. Direct expenditures for research toward projects that 10 will provide economic stimulus for Iowa. 11 b. Provide emphasis to providing services to Iowa-based 12 companies. 13 4. It is the intent of the general assembly that the 14 industrial incentive program focus on Iowa industrial 15 sectors and seek contributions and in-kind donations from 16 businesses, industrial foundations, and trade associations, 17 and that moneys for the institute for physical research and 18 technology industrial incentive program shall be allocated 19 only for projects which are matched by private sector moneys 20 for directed contract research or for nondirected research. 21 The match required of small businesses as defined in section 22 15.102, subsection 6 , for directed contract research or for 23 nondirected research shall be $1 for each $3 of state funds. 24 The match required for other businesses for directed contract 25 research or for nondirected research shall be $1 for each $1 of 26 state funds. The match required of industrial foundations or 27 trade associations shall be $1 for each $1 of state funds. 28 Iowa state university of science and technology shall 29 report annually to the joint appropriations subcommittee on 30 economic development and the legislative services agency the 31 total amount of private contributions, the proportion of 32 contributions from small businesses and other businesses, and 33 the proportion for directed contract research and nondirected 34 research of benefit to Iowa businesses and industrial sectors. 35 -8- LSB 1002SB (3) 84 tw/tm 8/ 17

UNIVERSITY OF IOWA. 6 1. Notwithstanding section 8.33 , moneys appropriated in 24 this section that remain unencumbered or unobligated at the 25 close of the fiscal year shall not revert but shall remain 26 available for expenditure for the purposes designated until the 27 close of the succeeding fiscal year. 28 Sec. 12. UNIVERSITY OF NORTHERN IOWA. 29 1. There is appropriated from the general fund of the 30 state to the university of northern Iowa for the fiscal year 31 beginning July 1, 2011, and ending June 30, 2012, the following 32 amount, or so much thereof as is necessary, to be used for the 33 metal casting institute, the MyEntreNet internet application, 34 and the institute of decision making, including salaries, 35 -9- LSB 1002SB (3) 84 tw/tm 9/ 17

Of the moneys appropriated pursuant to subsection 1, the 5 university of northern Iowa shall allocate at least $290,494 6 for purposes of expanded support of entrepreneurs through the 7 university’s regional business center. 8 3. The university of northern Iowa shall do all of the 9 following: 10 a. Direct expenditures for research toward projects that 11 will provide economic stimulus for Iowa. 12 b. Provide emphasis to providing services to Iowa-based 13 companies. 14 4. Notwithstanding section 8.33 , moneys appropriated in 15 this section that remain unencumbered or unobligated at the 16 close of the fiscal year shall not revert but shall remain 17 available for expenditure for the purposes designated until the 18 close of the succeeding fiscal year. 19 Sec. 13. BOARD OF REGENTS REPORT. The state board of 20 regents shall submit a report on the progress of regents 21 institutions in meeting the strategic plan for technology 22 transfer and economic development to the secretary of the 23 senate, the chief clerk of the house of representatives, and 24 the legislative services agency by January 15, 2012. 25 Sec. 14. DEPARTMENT OF WORKFORCE DEVELOPMENT. There 26 is appropriated from the general fund of the state to the 27 department of workforce development for the fiscal year 28 beginning July 1, 2011, and ending June 30, 2012, the following 29 amounts, or so much thereof as is necessary, for the purposes 30 designated: 31 1. DIVISION OF LABOR SERVICES 32 a. FTEs 30.00 12 b. The division of workers’ compensation shall charge a 13 $100 filing fee for workers’ compensation cases. The filing 14 fee shall be paid by the petitioner of a claim. However, the 15 fee can be taxed as a cost and paid by the losing party, except 16 in cases where it would impose an undue hardship or be unjust 17 under the circumstances. The moneys generated by the filing 18 fee allowed under this subsection are appropriated to the 19 department of workforce development to be used for purposes of 20 administering the division of workers’ compensation. 21 3. WORKFORCE DEVELOPMENT OPERATIONS 22 a. The department shall not reduce the number of field 31 offices below the number of field offices being operated as of 32 January 1, 2009. 33 4. OFFENDER REENTRY PROGRAM 34 a. The department shall partner with the department of 6 corrections to provide staff within the correctional facilities 7 to improve offenders’ abilities to find and retain productive 8 employment. 9 5. Notwithstanding section 8.33 , moneys appropriated in 10 this section that remain unencumbered or unobligated at the 11 close of the fiscal year shall not revert but shall remain 12 available for expenditure for the purposes designated until the 13 close of the succeeding fiscal year. 14 Sec. 15. ACCOUNTABILITY —— AUDIT. The auditor of state 15 shall annually conduct an audit of the department of workforce 16 development and shall report the findings of such annual 17 audit, including the accountability of programs of the 18 department, to the chairpersons and ranking members of the 19 joint appropriations subcommittee on economic development. The 20 department shall pay for the costs associated with the audit. 21 Sec. 16. EMPLOYMENT SECURITY CONTINGENCY FUND. 22 1. There is appropriated from the special employment 23 security contingency fund to the department of workforce 24 development for the fiscal year beginning July 1, 2011, and 25 ending June 30, 2012, the following amounts, or so much thereof 26 as is necessary, for the purposes designated: 27 a. There is appropriated from the general fund of the state 3 to the Iowa finance authority for the fiscal year beginning 4 July 1, 2011, and ending June 30, 2012, the following amount, 5 or so much thereof as is necessary, to be used to provide 6 reimbursement for rent expenses to eligible persons under the 7 rent subsidy program: 8 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 658,000 9 2. Participation in the rent subsidy program shall be 10 limited to only those persons who meet the requirements for the 11 nursing facility level of care for home and community-based 12 services waiver services as in effect on July 1, 2011, and 13 to those individuals who are eligible for the federal money 14 follows the person grant program under the medical assistance 15 program. Of the moneys appropriated in this section, not more 16 than $35,000 may be used for administrative costs. 17 Sec. 21. IOWA FINANCE AUTHORITY AUDIT. The auditor of state 18 is requested to review the audit of the Iowa finance authority 19 performed by the auditor hired by the authority. 20 Sec. 22. UNEMPLOYMENT COMPENSATION PROGRAM. Notwithstanding 21 section 96.9, subsection 4 , paragraph “a”, moneys credited to 22 the state by the secretary of the treasury of the United 23 States pursuant to section 903 of the Social Security 24 Act are appropriated to the department of workforce 25 development and shall be used by the department for the 26 administration of the unemployment compensation program only. 27 This appropriation shall not apply to any fiscal year 28 beginning after December 31, 2011. 29 Sec. 23. 2010 Iowa Acts, chapter 1184, section 37, is 30 amended by adding the following new unnumbered paragraph: 31 NEW UNNUMBERED PARAGRAPH . Notwithstanding section 8.33, 32 moneys appropriated in this section shall not revert at the 33 close of the fiscal year for which they are appropriated but 34 shall remain available for the purposes designated until 35 -14- LSB 1002SB (3) 84 tw/tm 14/ 17

The 1 full-time equivalent position authorized in this section shall 2 continue to be authorized until the close of the fiscal year 3 that begins July 1, 2011. 4 Sec. 24. 2010 Iowa Acts, chapter 1193, section 88, is 5 amended to read as follows: 6 SEC. 88. TAIWAN TRADE OFFICE —— IOWA COMPREHENSIVE 7 PETROLEUM UNDERGROUND STORAGE TANK FUND. There is appropriated 8 from the Iowa comprehensive petroleum underground storage tank 9 fund to the department of economic development for the fiscal 10 year beginning July 1, 2010, and ending June 30, 2011, the 11 following amount, or so much thereof as is necessary, to be 12 used for the purposes designated: 13 Notwithstanding section 455G.3, subsection 1 , for 14 establishing a trade office in Taipei, Taiwan: 15 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 100,000 16 Notwithstanding section 8.33, moneys appropriated in this 17 section shall not revert at the close of the fiscal year for 18 which they are appropriated but shall remain available for the 19 purposes designated until the close of the fiscal year that 20 begins July 1, 2011. 21 If the department cannot arrange for matching moneys from 22 another source by June 30, 2012, in an amount at least equal to 23 the appropriation made in this section, the moneys appropriated 24 in this section shall revert to the Iowa comprehensive 25 petroleum underground storage tank fund. 26 Sec. 25. 2008 Iowa Acts, chapter 1190, section 30, 27 subsection 3, is amended to read as follows: 28 3. As part of the plan, the department of workforce 29 development shall set a goal of having at least one certified 30 one-stop center in each of the fifteen workforce regions by the 31 year 2012 2014 . 32 Sec. 26. EFFECTIVE UPON ENACTMENT. The sections of this 33 Act amending 2010 Iowa Acts, chapter 1184, 2010 Iowa Acts, 34 chapter 1193, and 2008 Iowa Acts, chapter 1190, being deemed of 35 -15- LSB 1002SB (3) 84 tw/tm 15/ 17
S.F. _____ immediate importance, take effect upon enactment. 1 EXPLANATION 2 This bill makes appropriations and transfers from the 3 general fund of the state and other funds to the department of 4 cultural affairs, the department of economic development, the 5 university of Iowa, the university of northern Iowa, Iowa state 6 university, the department of workforce development, the Iowa 7 finance authority, and the public employment relations board 8 for the 2011-2012 fiscal year. 9 The bill provides that the goals for the department of 10 economic development shall be to expand and stimulate the 11 state economy, increase the wealth of Iowans, and increase the 12 population of the state. 13 The bill transfers moneys collected by the division of 14 insurance in excess of the anticipated gross revenues to the 15 department of economic development for purposes of insurance 16 economic development and international insurance economic 17 development. 18 The bill appropriates moneys from the Iowa community 19 development loan fund to the department of economic development 20 for purposes of the community development program. 21 The bill appropriates moneys from the workforce development 22 fund account to the workforce development fund. 23 The bill provides that moneys appropriated or transferred 24 to or receipts credited to the workforce development fund are 25 appropriated to the department of economic development for 26 administration of workforce development activities. 27 The bill provides that all moneys in the job training fund on 28 July 1, 2010, and any moneys appropriated or credited to the 29 fund during the fiscal year beginning July 1, 2010, shall be 30 transferred to the workforce development fund. 31 The bill requires the state board of regents to submit a 32 report on the progress of regents institutions in meeting 33 the strategic plan for technology transfer and economic 34 development. 35 -16- LSB 1002SB (3) 84 tw/tm 16/ 17
