ELIMINATION OF CHIEF AND ASSISTANT CHIEF OF 21 THE LAW ENFORCEMENT BUREAU OF THE DEPARTMENT OF NATURAL 22 RESOURCES. Effective July 1, 2011, the positions of chief and 23 assistant chief of the law enforcement bureau of the department 24 of natural resources are eliminated. 25 Sec. 12. USE OF MONEYS SAVED FROM THE ELIMINATION OF 26 POSITIONS —— ADDITIONAL CONSERVATION OFFICERS. For the 27 fiscal year beginning July 1, 2011, and ending June 30, 2012, 28 the department of natural resources shall use moneys saved 29 by the elimination of the positions of chief and assistant 30 chief of the law enforcement bureau of the department of 31 natural resources as provided in this division for purposes 32 of supporting two additional full-time equivalent positions 33 including salaries, support, maintenance, and miscellaneous 34 purposes. Iowa state university of science and technology 16 shall not reduce the amount that it allocates to support the 17 college of veterinary medicine from any other source due to the 18 appropriation made in this section. 19 b. Paragraph “a” does not apply to a reduction made to 20 support the college of veterinary medicine, if the same 21 percentage of reduction imposed on the college of veterinary 22 medicine is also imposed on all of Iowa state university’s 23 budget units. 24 3. If by June 30, 2012, Iowa state university of science and 25 technology fails to allocate the moneys appropriated in this 26 section to the college of veterinary medicine in accordance 27 with this section, the moneys appropriated in this section for 28 that fiscal year shall revert to the general fund of the state. 29 DIVISION V 30 ENVIRONMENT FIRST FUND —— GENERAL APPROPRIATIONS 31 Sec. 14. DEPARTMENT OF AGRICULTURE AND LAND 32 STEWARDSHIP. There is appropriated from the environment first 33 fund created in section 8.57A to the department of agriculture 34 and land stewardship for the fiscal year beginning July 1, 35 -6- LSB 1001SB (1) 84 da/jp 6/ 14

REVERSION. Notwithstanding section 8.33, 23 moneys appropriated for the fiscal year beginning July 1, 24 2011, in this division of this Act that remain unencumbered 25 or unobligated at the close of the fiscal year shall not 26 revert but shall remain available to be used for the purposes 27 designated until the close of the fiscal year beginning July 1, 28 2012, or until the project for which the appropriation was made 29 is completed, whichever is earlier. 30 DIVISION VI 31 RESOURCES ENHANCEMENT 32 AND PROTECTION (REAP) FUND 33 Sec. 17. ENVIRONMENT FIRST FUND. Notwithstanding the 34 amount of the standing appropriation from the general fund of 35 -10- LSB 1001SB (1) 84 da/jp 10/ 14
S.F. _____ the state to the Iowa resources enhancement and protection 1 fund as provided in section 455A.18, there is appropriated 2 from the environment first fund created in section 8.57A to 3 the Iowa resources enhancement and protection fund, in lieu of 4 the appropriation made in section 455A.18, for the fiscal year 5 beginning July 1, 2011, and ending June 30, 2012, the following 6 amount, to be allocated as provided in section 455A.19: 7 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 12,375,000 8 DIVISION VII 9 RELATED MISCELLANEOUS PROVISIONS 10 Sec. 18. AGRICULTURAL DRAINAGE WELL CLOSURE —— REPORT. The 11 department of agriculture and land stewardship shall prepare 12 a report regarding agricultural drainage wells that have not 13 been closed as provided in chapter 460. The report shall 14 include an inventory of agricultural drainage wells that remain 15 unclosed, a projected timeline for closing the agricultural 16 drainage wells, and an estimate of the costs for closing each 17 agricultural drainage well. The department shall submit the 18 report to the governor and fiscal services division of the 19 legislative services agency not later than November 15, 2011. 20 DIVISION VIII 21 RELATED STATUTORY CHANGES 22 Sec. 19. Section 455G.3, subsections 6 and 7, Code 2011, are 23 amended to read as follows: 24 6. a. For the fiscal year beginning July 1, 2010, and each 25 fiscal year thereafter, there is appropriated from the Iowa 26 comprehensive petroleum underground storage tank fund to the 27 department of natural resources two hundred thousand dollars 28 for purposes of technical review support to be conducted by 29 nongovernmental entities for leaking underground storage tank 30 assessments. 31 b. Notwithstanding section 8.33, moneys appropriated in this 32 subsection that remain unencumbered or unobligated at the close 33 of the fiscal year shall not revert but shall remain available 34 for expenditure for the purposes designated until the close of 35 -11- LSB 1001SB (1) 84 da/jp 11/ 14

For the fiscal year beginning July 1, 2010, there is 2 appropriated from the Iowa comprehensive petroleum underground 3 storage tank fund to the department of natural resources one 4 hundred thousand dollars for purposes of database modifications 5 necessary to accept batched external data regarding underground 6 storage tank inspections conducted by nongovernmental entities. 7 b. Notwithstanding section 8.33, moneys appropriated in this 8 subsection that remain unencumbered or unobligated at the close 9 of the fiscal year shall not revert but shall remain available 10 for expenditure for the purposes designated until the close of 11 the succeeding fiscal year. 12 Sec. 20. EFFECTIVE UPON ENACTMENT. This division of this 13 Act, being deemed of immediate importance, takes effect upon 14 enactment. 15 EXPLANATION 16 GENERAL. For the department of 6 natural resources, moneys are appropriated from the general 7 fund in order to support its divisions. 8 The bill makes appropriations from other funds. The bill 9 appropriates moneys to the department of natural resources from 10 the state fish and game protection fund to support programs 11 related to fish and wildlife. The bill appropriates moneys 12 from the groundwater protection fund to support groundwater 13 quality. The bill appropriates moneys from the snowmobile fund 14 to the department for snowmobile programs. 15 The bill includes miscellaneous provisions. An 16 appropriation is made from the unassigned revenue fund 17 administered by the Iowa comprehensive underground storage 18 tank fund board to the department of natural resources for 19 administration and expenses of the underground storage tank 20 section. 21 The bill provides that the department of natural 22 resources may use additional funds for staffing to reduce the 23 department’s floodplain permit backlog and implementing the 24 federal maximum daily load program. 25 ELIMINATION OF POSITIONS AND EXPENDITURE OF MONEYS. The 26 bill eliminates the chief and assistant chief of the law 27 enforcement bureau of the department of natural resources. It 28 authorizes the department of natural resources to use savings 29 from the elimination to support two conservation officers. 30 IOWA STATE UNIVERSITY. The bill appropriates moneys from 31 the general fund of the state for the operation of the Iowa 32 state university’s veterinary diagnostic laboratory. 33 IOWA RESOURCES ENHANCEMENT AND PROTECTION FUND. The bill also appropriates moneys from the 3 environment first fund to the Iowa resources enhancement and 4 protection fund in lieu of the $20 million appropriated by Code 5 section 455A.18 from the general fund of the state. 6 RELATED MISCELLANEOUS PROVISIONS. The department of 7 agriculture and land stewardship must submit a report to 8 the governor and general assembly inventorying agricultural 9 drainage wells that remain unclosed. 10 RELATED STATUTORY CHANGES. The bill amends a provision 11 in Code section 455G.3 establishing an Iowa comprehensive 12 petroleum underground storage tank fund and provides an annual 13 standing limited appropriation from the fund to the department 14 of natural resources to support technical reviews of leaking 15 underground storage tank assessments. The bill also addresses 16 a one-time appropriation for database modifications regarding 17 inspections conducted by nongovernmental entities.
