S.F. _____ Section 1. NEW SECTION . 306.48 Highway construction 1 projects —— notice —— collaboration. 2 1. The department shall provide notice of highway 3 construction projects on primary roads over which the 4 department has sole or concurrent jurisdiction pursuant to 5 section 306.4 which are anticipated to involve excavation which 6 would be suitable for the installation of fiberoptic cable 7 or conduit. The notice shall be posted on the department’s 8 internet site at least ninety days prior to the anticipated 9 construction date. 10 2. The objective of the notice shall be to facilitate a 11 collaborative effort between the department and fiberoptic 12 cable providers such that the mutual necessity to excavate 13 dirt can be accomplished in the most minimally invasive manner 14 possible. The notice shall include a map provided by the 15 department, the dates by which construction is anticipated to 16 commence and conclude, and departmental contact information. 17 3. The department shall by rule establish procedures for the 18 required coordination of highway construction and fiberoptic 19 cable or conduit installation projects in instances where a 20 fiberoptic cable provider responds to the notice and, in the 21 department’s estimation, such coordination is practicable. 22 EXPLANATION 23 This bill encourages the coordination of construction and 24 installation projects between the department of transportation 25 and fiberoptic cable providers involving excavation projects, 26 and requires such coordination where practicable. 27 The bill directs the department to provide notice of 28 highway construction projects on primary roads over which the 29 department has sole or concurrent jurisdiction, which are 30 anticipated to involve excavation which would be suitable for 31 the installation of fiberoptic cable or conduit. The bill 32 specifies that the notice shall be provided on the department’s 33 internet site at least 90 days prior to the anticipated 34 construction date.
