S.F. _____ Section 1. Section 453A.42, Code 2011, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 01. “Blunt wrap” means an individual 3 tobacco wrapper that is made wholly or in part from tobacco, 4 including reconstituted tobacco, whether in the form of tobacco 5 leaf, sheet, or tube, if such a wrap is designed to be sold to 6 individuals. 7 Sec. 2. NEW SECTION . 453A.48A Blunt wraps prohibited —— 8 penalty. 9 1. A person shall not manufacture, distribute, or sell blunt 10 wraps in this state. 11 2. Notwithstanding any provision of this division to the 12 contrary, a person who violates this section is subject only to 13 the civil penalties specified in section 453A.50, subsection 14 3, paragraph “a” . 15 EXPLANATION 16 This bill prohibits a person from manufacturing, selling, 17 or distributing blunt wraps in the state. The bill defines 18 a “blunt wrap” as an individual tobacco wrapper that is 19 made wholly or in part from tobacco, including reconstituted 20 tobacco, whether in the form of tobacco leaf, sheet, or tube, 21 if such a wrap is designed to be sold to individuals. A person 22 who violates the bill is subject only to the civil penalties 23 specified for other tobacco-related violations as follows: a 24 $200 penalty for the first violation; a $500 penalty for a 25 second violation within three years of the first violation; and 26 a $1,000 penalty for a third or subsequent violation within 27 three years of the first violation. 28 -1- LSB 1936XC (7) 84 pf/nh 1/ 1
