Section 724.4C, Code 2011, is amended to read as 1 follows: 2 724.4C Possession or carrying of firearms while under the 3 influence Permit to carry —— validity . 4 A permit issued under this chapter is invalid if the person 5 to whom the permit is issued is or does any of the following: 6 1. is Is in an intoxicated condition as provided in section 7 321J.2, subsection 1 . 8 2. Enters an establishment where alcoholic liquor, wine, or 9 beer is sold or consumed under authority of a liquor control 10 license, wine permit, or beer permit. 11 Sec. 2. Section 724.9, subsection 2, unnumbered paragraph 12 1, Code 2011, is amended to read as follows: 13 Evidence of qualification under this section subsection 1 14 may be documented by any of the following: 15 Sec. 3. Section 724.9, Code 2011, is amended by adding the 16 following new subsections: 17 NEW SUBSECTION . 2A. In addition to the firearm safety 18 requirement in subsection 1, an applicant for a permit to 19 carry weapons shall qualify on a firing range under the 20 supervision of an instructor certified by the national rifle 21 association or the department of public safety or another 22 state’s department of public safety, state police department, 23 or similar certifying body. 24 NEW SUBSECTION . 2B. Firearm training courses offered 25 through the internet do not satisfy the training requirements 26 set forth in this section. 27 Sec. 4. Section 724.11, subsection 1, Code 2011, is amended 28 to read as follows: 29 1. Applications for permits to carry weapons shall be made 30 to the sheriff of the county in which the applicant resides. 31 Applications for professional permits to carry weapons for 32 persons who are nonresidents of the state, or whose need to 33 go armed arises out of employment by the state, shall be made 34 to the commissioner of public safety. S.F. _____ sheriff or commissioner, before issuing the permit, shall 1 determine that the requirements of sections 724.6 to 724.10 2 have been satisfied. However, for An applicant for renewal of 3 a permit the shall also satisfy, within the twelve-month period 4 prior to the expiration of the applicant’s current permit, the 5 training program and qualification requirements in section 6 724.9 , subsection 1 , shall apply or the renewal applicant may 7 choose to qualify on a firing range under the supervision of an 8 instructor certified by the national rifle association or the 9 department of public safety or another state’s department of 10 public safety, state police department, or similar certifying 11 body . Such training or qualification must occur within the 12 twelve-month period prior to the expiration of the applicant’s 13 current permit. 14 Sec. 5. Section 724.21A, subsection 4, Code 2011, is amended 15 to read as follows: 16 4. Upon conclusion of the hearing, the administrative law 17 judge shall order that the denial, suspension, or revocation of 18 the permit be either rescinded or sustained. An unsuccessful 19 applicant or permit holder shall pay the costs associated 20 with the administrative appeal. An applicant, permit holder, 21 or issuing officer aggrieved by the final judgment of the 22 administrative law judge shall have the right to judicial 23 review in accordance with the terms of the Iowa administrative 24 procedure Act, chapter 17A . 25 EXPLANATION 26 This bill relates to permits to carry weapons and annual 27 permits to acquire pistols and revolvers. 28 The bill provides that a permit to carry weapons issued under 29 Code chapter 724 is invalid if the person to whom the permit is 30 issued enters an establishment where alcoholic liquor, wine, or 31 beer is sold and consumed under authority of a liquor control 32 license, wine permit, or beer permit. 33 The bill amends current firearm training requirements an 34 applicant for a permit to carry weapons must satisfy to be 35 -2- LSB 1849XC (5) 84 rh/rj 2/ 3
S.F. _____ issued a permit to carry weapons under Code chapter 724 to 1 include the requirement that such applicant qualify on a firing 2 range under the supervision of an instructor certified by the 3 national rifle association or the department of public safety 4 or another state’s department of public safety, state police 5 department, or similar certifying body. This requirement 6 applies to both new applicants and renewal applicants. The 7 bill specifies that internet firearm training courses do not 8 satisfy the firearm training requirements in Code section 9 724.9. 10 The bill requires an unsuccessful applicant or permit holder 11 who appeals a denial of an application for or the suspension or 12 revocation of a permit to carry weapons or an annual permit to 13 acquire pistols or revolvers to pay the costs associated with 14 the administrative appeal. 15 -3- LSB 1849XC (5) 84 rh/rj 3/ 3
