Senate Resolution 104 - Introduced SENATE RESOLUTION NO. 104 BY FEENSTRA A Resolution to preserve habeas corpus and civil 1 liberties. 2 WHEREAS, one of our most fundamental rights as 3 American citizens is to be free from unreasonable 4 detention without due process of law, a right afforded 5 to us by our founding fathers and guaranteed to us by 6 over two centuries of sacrifice by our men and women in 7 the armed forces whom we daily recognize and honor; and 8 WHEREAS, on behalf of the citizens of Iowa, the 9 Senate opposes any and all laws, regulations, and 10 executive orders, which amount to an overreach of the 11 federal government and which effectively take away 12 civil liberties; and 13 WHEREAS, in accordance with the Constitution of the 14 State of Iowa, Article III, section 32, all members 15 of the General Assembly are mandated to “support the 16 Constitution of the United States, and the Constitution 17 of the State of Iowa,”; and 18 WHEREAS, the members of the Senate believe that any 19 laws, regulations, or executive orders going against 20 habeas corpus or the civil liberties of Iowa citizens 21 granted under the Constitution of the United States 22 and Bill of Rights are invalid and should not be 23 recognized; NOW THEREFORE, 24 BE IT RESOLVED BY THE SENATE, That the Senate urges 25 the members of the United States Congress to resist 26 any attempt to curtail or restrict the right of due 27 process and the right to habeas corpus as guaranteed in 28 -1- LSB 5718XS (3) 84 jr/rj 1/ 2
