S.J.R. 2001 Section 1. 571 Iowa administrative code, rule 97.6, 1 is nullified to read as follows: 2 571——97.6 (481A) Dove season. Open season for hunting 3 mourning doves and Eurasian collared-doves shall 4 begin on September 1 and continue for 70 consecutive 5 days. Shooting hours shall be from one-half hour 6 before sunrise to sunset each day. Daily bag limit 7 is 15; possession limit is 30. The entire state is 8 open. No person shall take a mourning dove or Eurasian 9 collared-dove on any land or water of the state of 10 Iowa while having in one’s possession any shot other 11 than nontoxic approved by the United States Fish and 12 Wildlife Service. 13 Sec. 2. EFFECTIVE DATE. This joint resolution, 14 being deemed of immediate importance, takes effect upon 15 enactment. 16 EXPLANATION 17 This joint resolution nullifies 571 IAC, rule 18 97.6, fifth sentence, in which the natural resource 19 commission prohibits the use of lead shot for hunting 20 mourning doves. Iowa Code sections 481A.38 and 481A.39 21 authorize the natural resource commission to regulate 22 methods of take in the hunting of authorized species. 23 The effective date of this portion of the rule was 24 delayed until the end of the 2012 session of the 25 general assembly by the administrative rules review 26 committee at its meeting on August 16, 2011. 27 The joint resolution takes effect upon enactment. 28 -1- LSB 5021RS (4) 84 je/rj 1/ 1
