S.F. 57 Section 1. NEW SECTION . 463C.19A Sale of Honey creek 1 premier destination park. 2 1. Immediately after the effective date of this Act, the 3 Honey creek premier destination park authority shall develop a 4 plan to sell, at market value, the tract of land referred to as 5 the Honey creek premier destination park on the north shore of 6 Rathbun lake in Appanoose county. The plan shall include the 7 sale of substantial portions of the tract as soon as practical, 8 and the sale of all of the tract within a commercially 9 reasonable time. Prior to implementing the plan, the authority 10 shall submit the plan to the natural resource commission for 11 review and approval. The sale shall be handled in a manner 12 that is the most financially beneficial to the authority. 13 Appraisals conducted by the authority of the value of any 14 portion of the tract shall be made available to the public 15 immediately following the sale of that portion of the tract. 16 2. The proceeds from the sale of the property as provided 17 in subsection 1 are appropriated to and shall be used by 18 the authority to pay all outstanding bonds and satisfy all 19 outstanding obligations of the authority, including fulfilling 20 any outstanding covenants or provisions with bondholders or 21 third parties made in accordance with this chapter, and any 22 remaining proceeds are appropriated to and shall be used by the 23 natural resource commission to maintain other parks and public 24 lands under the jurisdiction of the commission. 25 3. By December 15 annually, the natural resource commission 26 shall submit a report of the activities and costs of the sale 27 of any property in accordance with subsection 1, including but 28 not limited to the use of any proceeds from the sale of the 29 property, to the general assembly in accordance with section 30 7A.11A, and to the legislative services agency, until such 31 time as the sale of the property is complete and the proceeds 32 have been expended by the authority, at which time the natural 33 resource commission shall submit a final report on the sale of 34 the property and use of the proceeds to the general assembly in 35 -1- LSB 1898XS (1) 84 av/nh 1/ 2
S.F. 57 accordance with section 7A.11A and to the legislative services 1 agency. 2 Sec. 2. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 3 immediate importance, takes effect upon enactment. 4 EXPLANATION 5 This bill requires the Honey creek premier destination 6 park authority to develop a plan to sell the Honey creek 7 premier destination park which is located on the north shore of 8 Rathbun lake in Appanoose county. The plan must be reviewed 9 and approved by the natural resource commission prior to 10 implementation. 11 Proceeds from the sale of the property are appropriated to 12 the authority to pay all outstanding bonds and satisfy all 13 outstanding obligations of the authority, including fulfilling 14 any outstanding covenants or provisions with bondholders or 15 third parties made in accordance with Code chapter 463C and any 16 remaining proceeds are appropriated to and shall be used by the 17 commission to maintain and manage other parks and public lands 18 under the jurisdiction of the commission. 19 The natural resource commission is required to submit an 20 annual report of the activities and costs of the sale of 21 the property to the general assembly and to the legislative 22 services agency, including the use of any proceeds from the 23 sale, until the sale of the property is complete and all 24 proceeds have been expended, at which time the commission shall 25 submit a final report. 26 The bill takes effect upon enactment. 27 -2- LSB 1898XS (1) 84 av/nh 2/ 2
