S.F. 468 Section 1. Section 279.9, Code 2011, is amended to read as 1 follows: 2 279.9 Use of tobacco, alcoholic beverages, or controlled 3 substances. 4 1. The rules shall prohibit the use of tobacco , including 5 nicotine products, and the use or possession of alcoholic 6 liquor, wine, or beer or any controlled substance as defined in 7 section 124.101, subsection 5 , by any student of the schools , 8 and the or by anyone on school grounds, is prohibited. The 9 school board may suspend or expel a student for a violation 10 of a rule under this section . The school board may remove a 11 person for violation of this section and may bar the person’s 12 future presence on school grounds for such violation. 13 2. As used in this section, “nicotine product” means any 14 product containing nicotine or any other preparation of tobacco 15 not described in section 453A.1, and any product or formulation 16 of matter containing biologically active amounts of nicotine 17 that is manufactured, sold, offered for sale, or otherwise 18 distributed with the expectation that the product or matter 19 will be introduced into the human body. “Nicotine product” does 20 not include any cessation product specifically approved by the 21 United States food and drug administration for use in reducing, 22 treating, or eliminating nicotine or tobacco dependence. 23 EXPLANATION 24 This bill provides that the use of nicotine products by any 25 student, or by anyone on school grounds, is prohibited. For 26 a violation of the provision, the school board may suspend or 27 expel a student, may remove a person, and may bar the person’s 28 future presence on school grounds. 29 The bill defines “nicotine product” as any product 30 containing nicotine or any other preparation of tobacco 31 not described in Code section 453A.1, and any product or 32 formulation of matter containing biologically active amounts 33 of nicotine that is manufactured, sold, offered for sale, or 34 otherwise distributed with the expectation that the product 35 -1- LSB 2435SV (4) 84 kh/nh 1/ 2
