S.F. 461 Section 1. Section 28B.1, subsection 1, unnumbered 1 paragraph 1, Code 2011, is amended to read as follows: 2 The In accordance with a resolution adopted for this purpose 3 by the legislative council, an Iowa commission on interstate 4 cooperation is hereby established shall be appointed to address 5 the charge and other responsibilities for the commission 6 outlined in the resolution . It The commission shall consist of 7 thirteen members to be appointed as follows: 8 Sec. 2. Section 28B.4, Code 2011, is amended to read as 9 follows: 10 28B.4 Report. 11 1. The commission shall report to the governor and to 12 the legislature within fifteen days after the convening of 13 each general assembly general assembly in accordance with the 14 commission’s charge , and at may report at other times as it 15 deems deemed appropriate by the commission . 16 2. Its The commission’s members and the members of all 17 committees which it establishes shall be reimbursed for their 18 travel and other necessary expenses in carrying out their 19 obligations under this chapter and legislative members shall 20 be paid a per diem as specified in section 7E.6 for each day in 21 which engaged in the performance of their duties, the per diem 22 and legislators’ expenses to be paid from funds appropriated by 23 sections 2.10 and 2.12 . Expenses of administrative officers, 24 state officials, or state employees who are members of the Iowa 25 commission on interstate cooperation or a committee appointed 26 by the commission shall be paid from funds appropriated to 27 the agencies or departments which persons represent except as 28 may otherwise be provided by the general assembly. Expenses 29 of citizen members who may be appointed to committees of 30 the commission may be paid from funds as authorized by the 31 general assembly. Expenses of the secretary or employees 32 of the secretary and support services in connection with 33 the administration of the commission shall be paid from 34 funds appropriated to the legislative services agency 35 -1- LSB 2721SV (2) 84 jp/rj 1/ 3
S.F. 461 unless otherwise provided by the general assembly. Expenses 1 of commission members shall be paid upon approval of the 2 chairperson or the secretary of the commission. 3 Sec. 3. Section 216A.132, subsection 1, paragraph c, Code 4 2011, is amended to read as follows: 5 c. (1) The chief justice of the supreme court shall 6 designate one member who is a district judge and one member 7 who is either a district associate judge or associate juvenile 8 judge. The chairperson and ranking member of the senate 9 committee on judiciary shall be members. In alternating 10 four-year intervals, the chairperson and ranking member of 11 the house committee on judiciary or of the house committee 12 on public safety shall be members, with the chairperson and 13 ranking member of the house committee on public safety serving 14 during the initial interval. Nonlegislative The members 15 appointed pursuant to this paragraph subparagraph shall serve 16 as ex officio, nonvoting members for four-year terms beginning 17 and ending as provided in section 69.19 , unless the member 18 ceases to serve as a district court judge. 19 (2) The chairperson and ranking member of the senate 20 committee on judiciary shall be ex officio, nonvoting members. 21 In alternating two-year terms, beginning and ending as provided 22 in section 69.16B, the chairperson and ranking member of the 23 house committee on judiciary or of the house committee on 24 public safety shall be ex officio, nonvoting members, with the 25 chairperson and ranking member of the house committee on public 26 safety serving during the term beginning in January 2011. 27 Sec. 4. REPEAL. Section 249A.36, Code 2011, is repealed. 28 EXPLANATION 29 This bill relates to certain boards and commissions with 30 legislative appointments. 31 Code chapter 28B, relating to the commission on interstate 32 cooperation, is amended to provide for appointment of a 33 commission in accordance with a resolution adopted for this 34 purpose by the legislative council and to conform the per 35 -2- LSB 2721SV (2) 84 jp/rj 2/ 3
S.F. 461 diem payment provision with that applied to other legislative 1 appointments. Current law provides for the commission to be 2 appointed on an ongoing basis. 3 Code section 216A.132, relating to appointment of the 4 criminal and juvenile justice planning advisory council in 5 the department of human rights, is amended. The judicial 6 and legislative branch appointments are specified to be ex 7 officio and nonvoting positions. In addition, the terms of the 8 legislative appointments from the house of representatives are 9 conformed with other legislative appointments to begin and end 10 with the term of the general assembly biennium. 11 Code section 249A.36, establishing the medical assistance 12 quality improvement council, is repealed. The Code provision 13 establishing the council, consisting of nonlegislator members, 14 was enacted in 2008 but council members have never been 15 appointed. 16 -3- LSB 2721SV (2) 84 jp/rj 3/ 3
