S.F. 382 Section 1. SCHOOL DISTRICT SERVICES AND FUNDING —— PILOT 1 PROGRAM 2 1. a. The department of education shall establish a pilot 3 program for school districts to provide special education 4 support services, media services, and educational services in 5 accordance with this section. A school district interested 6 in participating in the pilot program shall prepare a plan 7 for providing such services and submit the plan along with 8 an application to the department of education, on a form 9 prescribed by the department, not later than February 1, 2012. 10 The department shall not approve more than ten applications 11 for participation in the pilot program, and not more than two 12 applications may be approved for school districts located 13 within the same area education agency. 14 b. Notwithstanding any provision of chapter 257 to the 15 contrary, for school budget years beginning on July 1, 2012, 16 July 1, 2013, and July 1, 2014, the state aid funding for 17 special education support services, media services, and 18 educational services, as calculated under chapter 257, shall be 19 paid directly to the applicable school districts approved under 20 paragraph “a”. 21 2. A school district approved by the department of education 22 and receiving funding under subsection 1 shall choose one of 23 the following options: 24 a. A school district may provide its own special education 25 services, media services, and educational services, as those 26 services are described in chapter 273. However, the school 27 district shall not receive funding for its costs that exceeds 28 the amount determined under subsection 1, except for funds 29 received from another school district for providing special 30 education services, media services, or educational services to 31 such other school district. 32 b. A school district may contract with organizations, 33 including other school districts and area education agencies, 34 to provide special education services, media services, and 35 -1- LSB 2314XS (4) 84 md/sc 1/ 4
S.F. 382 educational services, as those services are described in 1 chapter 273. However, the school district contracting for such 2 services shall not receive funding for its costs that exceeds 3 the amount determined under subsection 1. 4 3. The department of education shall distribute the 5 appropriate amount of area education agency professional 6 development supplement and area education agency teacher salary 7 supplement funding to a school district if an area education 8 agency contracts to provide the services. 9 4. Notwithstanding any provision of chapter 273 to the 10 contrary, for school budget years beginning on July 1, 11 2012, July 1, 2013, and July 1, 2014, an area education 12 agency or other organization shall receive state aid funding 13 for providing special education support services, media 14 services, and educational services from the school districts 15 participating in the pilot program and for which the area 16 education agency or organization has contracted to provide such 17 services. Area education agencies and other organizations 18 may submit bids for providing special education support 19 services, media services, and educational services to the 20 participating school districts in a process to be determined by 21 the department of education by rule under chapter 17A. 22 5. School districts approved to participate in the pilot 23 program shall provide such special education support services, 24 media services, and educational services in accordance with 25 this section and rules adopted by the department of education 26 for the school budget years beginning on July 1, 2012, July 1, 27 2013, and July 1, 2014. For school budget years beginning on 28 or after July 1, 2015, the participating school districts shall 29 provide such services according to chapters 257 and 273. 30 6. The department of education shall review and analyze 31 the pilot program and submit a report to the general assembly 32 on or before October 1, 2015. S.F. 382 EXPLANATION 1 This bill establishes a pilot program which directs 2 state aid funding for special education support services, 3 media services, educational services, area education agency 4 professional development supplement, and area education agency 5 teacher salary supplement to the applicable school districts 6 approved for participation in the pilot program by the 7 department of education. 8 A school district interested in participating in the pilot 9 program is required to prepare a plan for providing special 10 education support services, media services, and educational 11 services, and submit the plan along with an application to 12 the department of education not later than February 1, 2012. 13 The department shall not approve more than ten applications 14 for participation in the pilot program, and not more than two 15 applications may be approved for school districts located 16 within the same area education agency. 17 The bill allows a participating school district to provide 18 its own services. A school district may also bid to provide 19 services to participating school districts. A participating 20 school district may also contract with organizations to receive 21 these services. If a school district provides its own special 22 education support services, media services, or educational 23 services, it shall not receive funding that exceeds the amount 24 determined under Code chapter 257. An area education agency 25 (AEA) or organization that successfully contracts to provide 26 these services to a participating school district will receive 27 the appropriate amount of funding from the school district 28 with which the organization has contracted. The department of 29 education is tasked with developing a bid process by rule. 30 Under the pilot program, participating school districts 31 shall provide such special education support services, media 32 services, and educational services in accordance with the bill 33 for the school budget years beginning on July 1, 2012, July 1, 34 2013, and July 1, 2014.
