S.F. 344 Section 1. Section 633.635, subsection 1, Code 2011, is 1 amended by adding the following new paragraph: 2 NEW PARAGRAPH . 0f. If the guardian is the department 3 of human services and the ward is removed from the ward’s 4 residence, the department shall provide an affidavit to the 5 ward’s family concerning the department’s actions relating to 6 the removal and including a detailed inventory of the ward’s 7 clothing, furniture, vehicle, and other personal effects at the 8 time of removal and their current status. 9 Sec. 2. Section 633.641, Code 2011, is amended by adding the 10 following new unnumbered paragraph: 11 NEW UNNUMBERED PARAGRAPH . If the conservator is the 12 department of human services and the ward is removed from the 13 ward’s residence, the department shall provide an affidavit to 14 the ward’s family concerning the department’s actions relating 15 to the removal and including a detailed inventory of the ward’s 16 clothing, furniture, vehicle, and other personal effects at the 17 time of removal and their current status. 18 EXPLANATION 19 This bill relates to the duties of the department of human 20 services when serving as a guardian or conservator by amending 21 Code section 633.635, relating to the responsibilities of a 22 guardian, and Code section 633.641, relating to the duties of 23 a conservator. 24 If the department is serving as a guardian or conservator and 25 the ward is removed from the ward’s residence, the department 26 is required to provide an affidavit to the ward’s family 27 concerning the department’s actions relating to the removal 28 and including a detailed inventory of the ward’s clothing, 29 furniture, vehicle, and other personal effects at the time of 30 removal and their current status. 31 -1- LSB 2554XS (3) 84 jp/nh 1/ 1
