1.
Section
99D.7,
subsection
23,
Code

is
amended
to
read
as
follows:

23.
To
require
licensees
to
establish
a
process
to
allow

a
person
to
be
voluntarily
excluded
for
life
from
a
racetrack
4
enclosure
and
all
other
licensed
facilities
under
this
chapter
5
and
chapter
99F
as
provided
in
this
subsection.
The
process
6
shall
provide
that
an
initial
request
by
a
person
to
be
7
voluntarily
excluded
shall
be
for
a
period
of
five
years
or
8
life
and
a
subsequent
request
following
the
five-year
period
9
shall
be
for
life
.
The
process
established
shall
also
require
10
that
a
licensee
disseminate
information
regarding
persons
11
voluntarily
excluded
to
all
licensees
under
this
chapter
and
12
chapter
99F
.
The
state
and
any
licensee
under
this
chapter
or
13
chapter
99F
shall
not
be
liable
to
any
person
for
any
claim
14
which
may
arise
from
this
process.
In
addition
to
any
other
15
penalty
provided
by
law,
any
money
or
thing
of
value
that
has
16
been
obtained
by,
or
is
owed
to,
a
voluntarily
excluded
person
17
by
a
licensee
as
a
result
of
wagers
made
by
the
person
after
18
the
person
has
been
voluntarily
excluded
shall
not
be
paid
19
to
the
person
but
shall
be
credited
to
the
general
fund
of
20
the
state
and
transferred
to
the
department
of
public
health
21
for
purposes
of
the
gambling
treatment
program
established
in
22
section
135.150
.

99F.4,
subsection
22,
Code
2011,
is
amended

to
read
as
follows:

licensees

Sec.
3.
GAMBLING
SELF-EXCLUSION
——
REAPPLICATION.

1.
A
person
who
has
been
voluntarily
excluded
for
life
13
from
a
racetrack
enclosure,
an
excursion
gambling
boat,
and
14
all
other
licensed
facilities
under
Code
chapters
99D
and
99F
15
pursuant
to
the
process
established
in
Code
sections
99D.7
and
16
99F.4
prior
to
the
effective
date
of
this
Act
may
reapply
to
17
the
licensed
facilities
to
revoke
the
exclusion,
pursuant
to
a
18
process
established
by
the
licensed
facilities
in
accordance
19
with
the
requirements
of
the
racing
and
gaming
commission.
A
20
person
may
reapply
to
revoke
the
voluntary
exclusion
only
if
21
the
person
has
been
voluntarily
excluded
for
a
period
of
at
22
least
five
years.

2.
Following
a
revocation
of
a
voluntary
exclusion
24
as
provided
by
this
section,
a
subsequent
request
to
be
25
voluntarily
excluded
shall
be
for
life
as
provided
pursuant
26
to
the
process
described
in
Code
sections
99D.7
and
99F.4,
as
27
amended
by
this
Act.

EXPLANATION
29
This
bill
concerns
the
process
by
which
a
person
can
be
30
voluntarily
excluded
from
a
racetrack
enclosure
under
Code
31
chapter
99D
and
from
an
excursion
gambling
boat
and
all
other
32
licensed
facilities
under
Code
chapter
99F.
33
The
bill
provides
that
an
initial
request
to
be
voluntarily
34
excluded
shall
be
for
a
period
of
five
years
or
for
life

a
subsequent
request
by
that
person
after
the
five-year
1
period
shall
be
for
life.
Under
current
law,
a
request
to
be

voluntarily
excluded
is
for
life.

The
bill
also
provides
that
any
moneys
won
by
a
person
4
voluntarily
excluded
that
are
forfeited
and
credited
to
the
5
general
fund
shall
be
transferred
to
the
department
of
public
6
health
for
purposes
of
the
gambling
treatment
program.
7
The
bill
also
provides
that
for
a
person
who
has
been
8
voluntarily
excluded
for
life
from
a
gambling
facility
prior
to
9
the
effective
date
of
this
bill,
the
person
may
reapply
to
have
10
the
exclusion
revoked
if
the
person
has
been
excluded
for
at
11
least
five
years.
The
bill
provides
that
if
a
person
revokes
12
their
exclusion,
a
subsequent
request
for
exclusion
shall
be
13
for
life.
