S.F. 2266 Section 1. Section 331.461, subsection 2, Code 2011, is 1 amended by adding the following new paragraph: 2 NEW PARAGRAPH . h. Natural gasworks to serve customers 3 within the county, including natural gas transmission 4 and distribution systems, the acquisition, establishment, 5 construction, purchase, equipment, improvement, extension, 6 operation, maintenance, reconstruction, and repair of works 7 and facilities within or without the limits of the county, 8 investment in works and facilities to be owned by public 9 utilities and interstate pipeline companies, and works and 10 facilities to be jointly used by the county and other political 11 subdivisions, but excluding the acquisition of property or 12 facilities of a public utility or interstate pipeline company 13 by condemnation. 14 EXPLANATION 15 This bill amends the definition of “county enterprise” under 16 Code section 331.461 to include natural gasworks to serve 17 customers within the county, including natural gas transmission 18 and distribution systems, the acquisition, establishment, 19 construction, purchase, equipment, improvement, extension, 20 operation, maintenance, reconstruction, and repair of works 21 and facilities within or without the limits of the county, 22 investment in works and facilities to be owned by public 23 utilities and interstate pipeline companies, and works and 24 facilities to be jointly used by the county and other political 25 subdivisions, but excluding the acquisition of property or 26 facilities of a public utility or interstate pipeline company 27 by condemnation. 28 Code chapter 331 authorizes a county to undertake a county 29 enterprise and provides as part of such authorization the 30 ability to issue revenue bonds, establish rates, collect 31 charges for services provided by the county enterprise, and 32 enter into specified contracts and leases. 33 -1- LSB 5767SV (2) 84 md/sc 1/ 1
