positions

to
the
restrictions
imposed
in

paragraph
“c”
.

Code
2011,
is
amended
by
adding
the

following
new
subsection:

implement
a
policy
restricting

equivalent
positions

the
restrictions
imposed
in
section
8.36A,

subsection
2,
paragraph

Sec.

Section
8.36A,
subsection
2,
Code
2011,
is
amended

by
adding
the
following
new
paragraph:

c.
(1)
A
department
or
establishment
shall
16
not
create
new
or
fill
vacant
existing
full-time
equivalent
17
positions
except
as
specifically
authorized
by
this
section.

(2)
A
department
or
establishment,
including
the
regents
19
universities,
may
establish
new
or
fill
vacant
existing
20
full-time
equivalent
positions,
if
a
corresponding
reduction
in
21
full-time
equivalent
positions
is
made
within
the
department
or
22
establishment,
or
within
another
department
or
establishment.

(3)
A
department’s
or
establishment’s
hiring
requirements
24
that
are
directly
related
to
the
following
activities
are
25
exempt
from
the
restrictions
of
subparagraph
(1):

(a)
Direct
custody,
supervision,
and
patient
care
in
27
corrections,
juvenile
rehabilitation,
institutional
care
of
28
veterans,
the
mentally
ill,
and
the
developmentally
disabled,
29
state
hospitals,
the
glenwood
state
resource
center,
the
30
woodward
state
resource
center,
the
state
mental
health
31
institutes,
the
Iowa
braille
and
sight
saving
school,
and
the
32
state
school
for
the
deaf.
33
(b)
Direct
protective
services
to
children
and
other
34
vulnerable
populations
in
the
department
of
human
services.

is
amended
by
adding

the

new
subsection:

The
state
court
administrator
under

the
direction
of
the
supreme
court
shall
establish
a
policy
19
restricting
the
creation
and
filling
of
full-time
equivalent
20
positions
comparable
to
the
restrictions
imposed
in
section
21
8.36A,
subsection
2,
paragraph
“c”
.

Sec.
6.
EFFECTIVE
UPON
ENACTMENT.
This
Act,
being
deemed
of
23
immediate
importance,
takes
effect
upon
enactment.

EXPLANATION
25
This
bill
places
a
hiring
freeze
on
state
employment
within
26
the
executive,
legislative,
and
judicial
branches.
The
hiring
27
freeze
extends
to
the
regents
institutions.
28
The
bill
prohibits
the
creation
of
new
full-time
equivalent
29
positions.
The
bill
also
prohibits
hiring
in
order
to
fill
30
existing
vacant
positions.
31
The
bill
provides
that
a
state
agency
may
establish
new
or
32
fill
vacant
existing
positions
if
matching
reductions
are
made
33
in
equivalent
positions
elsewhere
within
the
agency,
or
within
34
another
state
agency.

bill
allows
for
hiring
when
the
position
relates
1
to
certain
activities
not
subject
to
the
hiring
freeze.

Activities
directly
related
to
custody,
supervision
and
3
patient
care
in
corrections;
juvenile
rehabilitation;
4
veterans
institutional
care;
care
for
the
mentally
ill
or
5
developmentally
disabled;
state
hospitals;
schools
for
the
6
blind
or
the
deaf;
and
special
mental
health
centers.
Also
7
exempted
are
activities
related
to
direct
child
and
vulnerable
8
population
protective
services;
those
occurring
within
certain
9
divisions
of
the
department
of
public
safety;
those
related
10
to
hazardous
materials
response
and
cleanup;
those
related
to
11
emergency
public
health;
those
related
to
military
operations
12
and
emergency
management
under
the
department
of
public
13
defense;
and
those
related
to
fire
fighting.
14
The
bill
takes
effect
upon
enactment.
