1.
Section
804.29,
Code
2011,
is
amended
to
read
as
1
follows:

804.29
Confidentiality.
3
1.
All
information
filed
with
the
court
for
the
purpose
of
4
securing
a
warrant
for
an
arrest,
including
but
not
limited
to
5
a
citation
and
affidavits,
shall
be
a
confidential
record
until
6
such
time
as
a
peace
officer
has
made
the
arrest
and
has
made
7
the
officer’s
return
on
the
warrant
,
or
the
defendant
has
made
8
an
initial
appearance
in
court
.
During
the
period
of
time
that
9
information
is
confidential,
it
the
record
shall
be
sealed
by
10
the
court
and
the
information
contained
therein
in
the
record
11
shall
not
be
disseminated
to
any
person
other
than
a
peace
12
officer,
employee
of
a
county
attorney’s
office,
magistrate,
or
13
another
court
employee,
in
the
course
of
official
duties
.

However,
during
the
period
of
confidentiality
in
15
subsection
1,
the
information
in
the
record
may
be
disseminated
16
during
the
course
of
official
duties
to
the
following
persons:
17
a.
A
peace
officer.
18
b.
An
employee
of
the
county
attorney’s
office.
19
c.
A
judicial
officer
or
other
court
employees.
20
d.
An
employee
of
the
department
of
corrections
or
judicial
21
district
department
of
correctional
services,
if
authorized
by
22
the
director
of
the
department
of
corrections.

EXPLANATION
24
This
bill
relates
to
the
confidentiality
of
an
arrest
25
warrant.

The
bill
specifies
that
information
relating
to
an
arrest
27
warrant
shall
not
be
confidential
if
the
defendant
has
made
an
28
initial
appearance
in
court
even
if
the
arresting
peace
officer
29
has
not
returned
the
warrant.
30
The
bill
authorizes
an
employee
of
the
department
of
31
corrections
or
judicial
district
department
of
correctional
32
services,
if
authorized
by
the
director
of
the
department
of
33
corrections,
to
receive
confidential
information
filed
with
34
the
court
relating
to
an
arrest
warrant
during
the
course
of

official
duties
of
the
employee.

Current
law
authorizes
a
peace
officer,
an
employee
of

the
county
attorney’s
office,
a
judicial
officer,
or
court

employees
to
receive
confidential
information
relating
to
an

arrest
warrant
during
the
course
of
official
duties.
