S.F. 21 Section 1. Section 484B.4, subsection 1, Code 2011, is 1 amended to read as follows: 2 1. A person who owns or controls by lease or otherwise for 3 five or more years, a contiguous tract of land having an area 4 of not less than three hundred twenty acres, or in the case of a 5 hunting preserve for game birds only, an area of not less than 6 one hundred fifty acres, and who desires to establish a hunting 7 preserve, to propagate and sell game birds and their young 8 or unhatched eggs, and shoot game birds and ungulates on the 9 land, under this chapter or the rules of the commission, shall 10 make application to the department for an operator’s license. 11 The application shall be made under oath of the applicant or 12 under oath of one of its principal officers if the applicant 13 is an association or corporation. Under the authority of this 14 license, any property or facilities to be used for propagating, 15 holding, processing, or pasturing of game birds or ungulates 16 shall not be required to be contained within the contiguous 17 land area used for hunting purposes. The application shall 18 be accompanied by an operator’s license fee of two hundred 19 dollars. 20 Sec. 2. Section 484B.4, subsection 2, paragraph a, Code 21 2011, is amended to read as follows: 22 a. The proposed hunting preserve contains at least three 23 hundred twenty acres , or in the case of a hunting preserve for 24 game birds only, at least one hundred fifty acres, but not more 25 than two thousand five hundred sixty acres. 26 EXPLANATION 27 This bill reduces the number of contiguous acres that are 28 required for the establishment of a hunting preserve from 320 29 acres to 150 acres for hunting preserves that are for game 30 birds only. 31 -1- LSB 1148SS (3) 84 av/sc 1/ 1
