S.F. 206 Section 1. NEW SECTION . 15F.207 Waivers of matching funds 1 requirements. 2 1. An applicant for financial assistance under the 3 provisions of this subchapter may apply to the vision Iowa 4 board for a waiver of any local or private matching moneys 5 required of the applicant by the board pursuant to section 6 15F.202. 7 2. To qualify for a waiver pursuant to this section, an 8 applicant shall meet all of the following requirements: 9 a. The applicant shall be located in an area declared a 10 disaster area by the governor or by a federal official. 11 b. The applicant shall apply for the waiver within two years 12 of the date the disaster declaration was issued. 13 c. The applicant shall demonstrate that a waiver is 14 necessary as a result of the natural disaster. For the 15 purposes of this paragraph, a waiver shall be considered 16 necessary if the disaster has materially contributed to 17 difficulties in financing the applicant’s project. 18 3. The board may grant a waiver for all or a portion of the 19 amount requested to be waived pursuant to this section. 20 4. The board may place reasonable conditions or 21 requirements specific to the project on any applicant receiving 22 a waiver pursuant to this section. 23 Sec. 2. RETROACTIVE APPLICABILITY. 24 1. This Act applies retroactively to January 1, 2008, for 25 disaster declarations issued on or after that date. 26 2. Notwithstanding section 15F.207, subsection 2, paragraph 27 “b”, an applicant located in a disaster area declared during 28 calendar year 2008 may qualify for a waiver pursuant to section 29 15F.207 if the applicant applies for the waiver on or before 30 June 30, 2013. 31 EXPLANATION 32 This bill provides for waivers of the matching funds 33 requirements for applicants under the community attraction and 34 tourism program and the river enhancement community attraction 35 -1- LSB 1692SV (3) 84 tw/sc 1/ 2
S.F. 206 and tourism program if the applicants are located in declared 1 disaster areas. 2 In 2009, the general assembly passed Senate File 336 3 providing for such waivers, but only between July 1, 2009, 4 and June 30, 2010. In order to extend the availability of 5 waivers, the bill makes them a permanent part of the program. 6 The bill applies retroactively to January 1, 2008, for disaster 7 declarations issued on or after that date.
