1.
Section
234.7,
Code
Supplement
2011,
is
amended
1
by
adding
the
following
new
subsection:

SUBSECTION
.

The
department
of
human
services
shall

establish
an
infant
safe
sleep
education
review
panel
for
4
review
and
approval
of
sudden
infant
death
syndrome
and
infant
5
safe
sleep
practices
training
curricula
for
operators
and
6
employees
of
child
care
homes
and
licensed
or
registered
child
7
care
facilities.

2.
Section
237A.3,
Code
2011,
is
amended
by
adding
the
9
following
new
subsection:

NEW
SUBSECTION
.
4.
An
operator
or
employee
of
a
child
care
11
home
shall
complete
two
hours
of
training
relating
to
sudden
12
infant
death
syndrome
and
infant
safe
sleep
practices
within
13
six
months
of
initial
operation
or
employment,
as
applicable.
14
An
operator
or
employee
shall
complete
at
least
two
hours
of
15
additional
training
relating
to
sudden
infant
death
syndrome
16
and
infant
safe
sleep
practices
every
five
years.
The
operator
17
or
employee
shall
complete
the
initial
or
additional
training
18
requirements
as
part
of
a
training
program
using
a
curriculum
19
approved
by
the
infant
safe
sleep
education
review
panel
20
established
by
the
department
of
human
services
pursuant
to
21
section
234.7,
subsection
3.

Sec.
3.
Section
237A.5,
Code
2011,
is
amended
by
adding
the
23
following
new
subsection:

NEW
SUBSECTION
.
6.
a.
An
operator
or
employee
of
a
25
licensed
or
registered
facility
shall
complete
two
hours
of
26
training
relating
to
sudden
infant
death
syndrome
and
infant
27
safe
sleep
practices
within
six
months
of
initial
operation
28
or
employment,
as
applicable.
An
operator
or
employee
shall
29
complete
at
least
two
hours
of
additional
training
relating
to
30
sudden
infant
death
syndrome
and
infant
safe
sleep
practices
31
every
five
years.
The
operator
or
employee
shall
complete
32
the
initial
or
additional
training
requirements
as
part
of
a
33
training
program
using
a
curriculum
approved
by
the
infant
safe
34
sleep
education
review
panel
established
by
the
department
of

services
pursuant
to
section
234.7,

The
department
shall
require
as
a
condition
of
renewal
2
of
a
facility’s
licensure
or
registration
that
all
operators
3
or
employees
of
the
licensed
or
registered
facility
are
in
4
compliance
with
the
training
requirements
of
this
subsection.

4.
Section
237A.26,
subsection
6,
paragraph
a,
Code
6
Supplement
2011,
is
amended
to
read
as
follows:

a.
Assist
families
in
selecting
quality
child
care.
The
8
agency
must
provide
referrals
to
registered
and
licensed
child
9
care
facilities,
and
to
persons
providing
care,
supervision,
10
and
guidance
of
a
child
which
is
not
defined
as
child
care
11
under
section
237A.1
and
may
provide
referrals
to
unregistered
12
providers
whose
operators
and
employees
have
completed
the
13
training
required
by
section
237A.3,
subsection
4
.

Sec.
5.
APPLICABILITY.
A
person
who
is
an
operator
or
15
employee
of
a
child
care
home
or
child
care
facility
on
the
16
effective
date
of
this
Act
shall
complete
the
initial
two
hours
17
of
training
required
by
this
Act
by
July
1,
2013.

EXPLANATION
19
This
bill
relates
to
mandatory
training
regarding
sudden
20
infant
death
syndrome
(SIDS)
and
infant
safe
sleep
for
21
operators
and
employees
of
child
care
homes
and
child
care
22
facilities.
The
bill
requires
operators
of
and
employees
23
at
child
care
homes
and
child
care
facilities
to
complete
24
two
hours
of
training
relating
to
SIDS
and
infant
safe
sleep
25
practices
within
six
months
of
initial
employment.
Operators
26
and
employees
must
also
complete
at
least
two
hours
of
27
additional
training
every
five
years.
The
bill
states
that
the
28
department
of
human
services
shall
condition
the
renewal
of
a
29
facility’s
license
or
registration
on
the
facility’s
operators’
30
and
employees’
compliance
with
the
training
requirements.
31
The
bill
also
provides
that
an
agency
which
receives
a
child
32
care
resource
and
referral
grant
may
provide
referrals
to
an
33
unregistered
provider
only
if
the
operators
and
employees
of
34
the
provider
have
completed
the
required
SIDS
and
infant
safe
35

training.
The
bill
provides
that
current
1
operators
and
employees
of
child
care
homes
and
facilities
must
2
complete
two
hours
of
SIDS
and
infant
safe
sleep
practices
3
training
by
July
1,
2013.
