S.F. 2016 Section 1. Section 260C.14, Code 2011, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 23. Adopt rules to waive tuition and 3 mandatory fee charges for any student in good standing who is 4 a resident of Iowa; is under the age of twenty-six, or under 5 the age of thirty if the student is a qualified veteran as 6 defined in subsection 14; is not a convicted felon as defined 7 in section 910.15; and is the child of an individual who died 8 in the line of duty as determined by section 97A.6, subsection 9 16, section 97B.52, subsection 2, section 100B.31, or section 10 411.6, subsection 15. 11 Sec. 2. Section 262.9, Code Supplement 2011, is amended by 12 adding the following new subsection: 13 NEW SUBSECTION . 36. Adopt rules that require the 14 institutions of higher education under its control to waive 15 tuition and mandatory fee charges for any undergraduate student 16 in good standing who is a resident of Iowa; is under the age 17 of twenty-six, or under the age of thirty if the student is 18 a qualified veteran as defined in subsection 17; is not a 19 convicted felon as defined in section 910.15; and is the child 20 of an individual who died in the line of duty as determined by 21 section 97A.6, subsection 16, section 97B.52, subsection 2, 22 section 100B.31, or section 411.6, subsection 15. 23 Sec. 3. Section 509A.13, Code 2011, is amended to read as 24 follows: 25 509A.13 Continuation of group insurance. 26 1. If a governing body, a county board of supervisors, or a 27 city council has procured for its employees accident, health, 28 or hospitalization insurance, or a medical service plan, or has 29 contracted with a health maintenance organization authorized 30 to do business in this state, the governing body, county board 31 of supervisors, or city council shall allow do all of the 32 following: 33 a. Allow its employees who retired before attaining 34 sixty-five years of age to continue participation in the group 35 -1- LSB 5180XS (2) 84 ec/nh 1/ 3
S.F. 2016 plan or under the group contract at the employee’s own expense 1 until the employee attains sixty-five years of age. 2 b. Allow any child of an eligible deceased employee to 3 continue participation in the group plan or under the group 4 contract at the employer’s expense until the child attains 5 twenty-six years of age. For purposes of this paragraph, 6 “eligible deceased employee” means an employee who died in 7 the line of duty as determined by section 97A.6, subsection 8 16, section 97B.52, subsection 2, section 100B.31, or section 9 411.6, subsection 15. 10 2. This section applies to employees who retired on or 11 after January 1, 1981 , and to children of an eligible deceased 12 employee who died on or after July 1, 2012 . 13 Sec. 4. IMPLEMENTATION OF ACT. Section 25B.2, subsection 14 3, shall not apply to this Act. 15 EXPLANATION 16 This bill provides health care and tuition benefits to 17 children of public safety employees who died in the line of 18 duty. 19 Code section 260C.14, concerning community colleges, 20 is amended to provide that the board of directors of each 21 community college shall adopt rules to waive tuition and 22 mandatory fee charges for any student in good standing who is a 23 resident of Iowa who is under the age of 26, or under the age 24 of 30 if the student is a qualified veteran, is not a convicted 25 felon, and is the child of an individual who died in the line 26 of duty as determined by Code section 97A.6(16), Code section 27 97B.52(2), Code section 100B.31, or Code section 411.6(15). 28 Code section 262.9, concerning the board of regents, is 29 amended to provide that the board of regents shall adopt 30 rules providing that institutions of higher education under 31 its control waive tuition and mandatory fee charges for any 32 undergraduate student in good standing who is a resident of 33 Iowa, who is under the age of 26 or under the age of 30 if the 34 student is a qualified veteran, is not a convicted felon, and 35 -2- LSB 5180XS (2) 84 ec/nh 2/ 3
S.F. 2016 is the child of an individual who died in the line of duty as 1 determined by Code section 97A.6(16), Code section 97B.52(2), 2 Code section 100B.31, or Code section 411.6(15). 3 Code section 509A.13, concerning continuation of group 4 insurance for public employees, is amended to provide that 5 any child of an employee who died in the line of duty on or 6 after July 1, 2012, as determined by Code section 97A.6(16), 7 Code section 97B.52(2), Code section 100B.31, or Code section 8 411.6(15), shall be entitled to continue participation in that 9 group insurance, at the employer’s expense, until the child 10 attains 26 years of age. 11 The bill may include a state mandate as defined in Code 12 section 25B.3. The bill makes inapplicable Code section 25B.2, 13 subsection 3, which would relieve a political subdivision from 14 complying with a state mandate if funding for the cost of 15 the state mandate is not provided or specified. Therefore, 16 political subdivisions are required to comply with any state 17 mandate included in the bill. 18 -3- LSB 5180XS (2) 84 ec/nh 3/ 3
