29A.27A
Military
differential
pay.

1.
For
the
purposes
of
this
section:
2
a.
“Military
service”
means
engagement
in
federal
service,
3
state
active
duty,
or
state
military
service
for
a
period
of
at
4
least
thirty
consecutive
days.
5
b.
“Public
employee”
means
any
individual
employed
by
a
6
public
employer.
7
c.
“Public
employer”
means
the
state
of
Iowa,
its
boards,
8
commissions,
agencies
and
departments,
and
its
political
9
subdivisions
including
school
districts
and
other
special
10
purpose
districts.

2.
A
public
employer
shall
pay
a
public
employee
any
12
difference
between
the
public
employee’s
government
salary
13
and
the
public
employee’s
military
salary
for
all
periods
of
14
absence
during
military
service.
15
3.
The
department
of
administrative
services,
in
16
consultation
with
the
department
of
veterans
affairs
and
17
political
subdivisions
of
this
state,
shall
adopt
rules
for
18
implementation
of
this
section.

Sec.
2.
IMPLEMENTATION
OF
ACT.
Section
25B.2,
subsection
20
3,
shall
not
apply
to
this
Act.

EXPLANATION
22
This
bill
requires
a
public
employer
to
pay
a
public
employee
23
any
difference
between
the
public
employee’s
government
salary
24
and
the
public
employee’s
military
salary
for
all
periods
of
25
absence
while
engaged
in
federal
service,
state
active
duty,
or
26
state
military
service
for
a
period
of
at
least
30
consecutive
27
days.

The
bill
directs
the
department
of
administrative
services,
29
in
consultation
with
the
department
of
veterans
affairs
30
and
political
subdivisions
of
the
state,
to
adopt
rules
for
31
implementation
of
the
bill.

The
bill
may
include
a
state
mandate
as
defined
in
Code
33
section
25B.3.
The
bill
makes
inapplicable
Code
section
25B.2,
34
subsection
3,
which
would
relieve
a
political
subdivision
from

complying
with
a
state
mandate
if
funding
for
the
cost
of

the
state
mandate
is
not
provided
or
specified.
Therefore,

political
subdivisions
are
required
to
comply
with
any
state

mandate
included
in
the
