S.F. 171 Section 1. FUNDING FOR TEACHER LIBRARIANS, GUIDANCE 1 COUNSELORS, AND SCHOOL NURSES. Notwithstanding any provision 2 of a collective bargaining agreement entered into pursuant to 3 chapter 20, and any provision of section 256.11, subsections 9, 4 9A, and 9B, to the contrary, school districts are not required 5 to have a teacher librarian, guidance counselor, or school 6 nurse for any school budget year commencing during the fiscal 7 period beginning July 1, 2010, and ending June 30, 2013. Any 8 funds not expended due to this section may be expended for 9 school district general fund purposes. 10 Sec. 2. FUNDING FOR EXPANDED PHYSICAL EDUCATION 11 PROGRAMS AND CARDIOPULMONARY RESUSCITATION CERTIFICATION 12 COURSES. Notwithstanding any provision of section 256.11, 13 subsection 6, to the contrary, school districts may suspend 14 expanded physical education programs and cardiopulmonary 15 resuscitation certification courses for any school budget year 16 commencing during the fiscal period beginning July 1, 2010, and 17 ending June 30, 2013. 18 Sec. 3. FUNDING FOR THE STATEWIDE PRESCHOOL PROGRAM. 19 Notwithstanding any provision of chapter 256C to the contrary, 20 preschool foundation aid payments under chapter 256C shall 21 be distributed to all school districts based on a school 22 district’s budget enrollment compared to the statewide total 23 budget enrollment for the school budget year beginning July 1, 24 2010, for any school budget year commencing during the fiscal 25 period beginning July 1, 2010, and ending June 30, 2013, to 26 be used for chapter 256C purposes, if applicable, or school 27 district general fund purposes. 28 Sec. 4. FUNDING FOR TEACHER SALARY SUPPLEMENT. 29 Notwithstanding any provision of a collective bargaining 30 agreement entered into pursuant to chapter 20 and any provision 31 of section 257.10, subsection 9, to the contrary, school 32 districts may expend teacher salary supplement funding for 33 school district general fund purposes for any school budget 34 year commencing during the fiscal period beginning July 1, 35 -1- LSB 1395XS (2) 84 md/sc 1/ 3
S.F. 171 2010, and ending June 30, 2013. 1 Sec. 5. FUNDING FOR THE PROFESSIONAL DEVELOPMENT 2 SUPPLEMENT. Notwithstanding any provision of a collective 3 bargaining agreement entered into pursuant to chapter 20 4 and any provision of section 257.10, subsection 10, to the 5 contrary, school districts may expend professional development 6 supplement funding for school district general fund purposes 7 for any school budget year commencing during the fiscal period 8 beginning July 1, 2010, and ending June 30, 2013. 9 Sec. 6. FUNDING FOR THE EARLY INTERVENTION SUPPLEMENT. 10 Notwithstanding any provision of a collective bargaining 11 agreement entered into pursuant to chapter 20 and any provision 12 of section 257.10, subsection 11, to the contrary, school 13 districts may expend early intervention supplement funding for 14 school district general fund purposes for any school budget 15 year commencing during the fiscal period beginning July 1, 16 2010, and ending June 30, 2013. 17 Sec. 7. FUNDING FOR INSTRUCTIONAL SUPPORT. Notwithstanding 18 any provision of section 257.19, to the contrary, school 19 districts may additionally expend instructional support funds 20 for funding purposes under sections 257.41 and 257.46 for 21 any school budget year commencing during the fiscal period 22 beginning July 1, 2010, and ending June 30, 2013. 23 Sec. 8. EFFECTIVE UPON ENACTMENT AND APPLICABILITY. This 24 Act, being deemed of immediate importance, takes effect upon 25 enactment and applies to the expenditure of funds by school 26 districts on and after that date. 27 EXPLANATION 28 This bill suspends several program and financial mandates 29 and restrictions for school districts for any school budget 30 year commencing during the fiscal period beginning July 1, 31 2010, and ending June 30, 2013. 32 The bill suspends requirements in Code section 256.11(9), 33 (9A), and (9B), so that school districts are not required 34 during these budget years to have a teacher librarian, a 35 -2- LSB 1395XS (2) 84 md/sc 2/ 3
S.F. 171 guidance counselor, or school nurse. The bill states that any 1 contrary provision of a collective bargaining agreement is also 2 suspended. 3 School districts may suspend expansion of physical education 4 programs and cardiopulmonary resuscitation certification 5 courses under Code section 256.11(6). 6 The bill pools the statewide preschool program funding in 7 Code chapter 256C and redistributes it to all school districts 8 based on a district’s budget enrollment as compared to the 9 statewide total budget enrollment, using the enrollment counts 10 from the school budget year beginning July 1, 2010. The 11 redistributed funds may be used for Code chapter 256C purposes, 12 if applicable, or school district general fund purposes. 13 Categorical allowable growth funds, including supplemental 14 funding for teacher salaries under Code section 257.10(9), 15 professional development under Code section 257.10(10), and 16 early intervention programs under Code section 257.10(11), are 17 made expendable for school district general fund purposes. 18 The bill states that any contrary provision of a collective 19 bargaining agreement pertaining to this action is suspended. 20 The bill also removes restrictions on instructional support 21 funds in Code section 257.19 so that the funds may be used for 22 funding dropout prevention programs under Code section 257.41, 23 and gifted and talented programs under Code section 257.46. 24 The bill takes effect upon enactment and applies on and after 25 the date of enactment. Any funds referenced in the bill that 26 are not yet expended on the effective date of the bill for the 27 school budget year beginning July 1, 2010, are affected. 28 -3- LSB 1395XS (2) 84 md/sc 3/ 3
