S.F. 141 Section 1. Section 261.1, subsection 2, paragraph c, 1 subparagraphs (1) and (2), Code 2011, are amended to read as 2 follows: 3 (1) Two members One member of the senate, one to be 4 appointed by the president of the senate and one to be 5 appointed by after consultation with the majority leader and 6 the minority leader of the senate, to serve as an ex officio, 7 nonvoting members member . 8 (2) Two members One member of the house of representatives, 9 one to be appointed by the speaker of the house of 10 representatives and one to be appointed by after consultation 11 with the majority leader and the minority leader of the house 12 of representatives, to serve as an ex officio, nonvoting 13 members member . 14 Sec. 2. Section 261.1, subsection 2, paragraph c, Code 2011, 15 is amended by adding the following new subparagraph: 16 NEW SUBPARAGRAPH . (4) The two legislative members of the 17 commission shall not be members of the same political party. 18 The president of the senate and the speaker of the house of 19 representatives shall consult with one another prior to any 20 appointment made pursuant to this paragraph ā€œcā€ to ensure the 21 requirement in this subparagraph is met. 22 Sec. 3. APPLICABILITY. This Act applies to the appointment 23 of legislative members of the college student aid commission 24 for the term beginning upon the convening of the Eighty-fifth 25 General Assembly. 26 EXPLANATION 27 Under current law, there are four ex officio, nonvoting 28 legislative members of the college student aid commission. Two 29 members are from the senate, one appointed by the president 30 of the senate and one appointed by the minority leader of the 31 senate. Two members are from the house of representatives, 32 one appointed by the speaker of the house of representatives 33 and one appointed by the minority leader of the house of 34 representatives. 35 -1- LSB 1984XS (3) 84 je/nh 1/ 2
S.F. 141 This bill provides that there shall be two ex officio, 1 nonvoting legislative members of the college student aid 2 commission. One shall be from the senate, appointed by the 3 president of the senate after consultation with the majority 4 leader and the minority leader of the senate, and one shall be 5 from the house of representatives, appointed by the speaker 6 of the house of representatives after consultation with 7 the majority leader and the minority leader of the house of 8 representatives. 9 The bill provides that the two legislative members of the 10 commission shall not be members of the same political party. 11 The bill directs the president of the senate and the speaker of 12 the house of representatives to consult with one another prior 13 to any appointment made pursuant to the bill to carry out that 14 requirement. 15 The bill applies to the appointment of legislative members 16 of the college student aid commission for the term beginning 17 upon the convening of the Eighty-fifth General Assembly. 18 -2- LSB 1984XS (3) 84 je/nh 2/ 2
