S.F. 14 Section 1. NEW SECTION . 313.38 Borrow pit adjacent to 1 highway. 2 The department shall erect a high-tension cable barrier 3 along that portion of a highway within the primary road system 4 where a borrow pit is located within the highway right-of-way 5 or on property adjacent to the highway right-of-way if the 6 proximity of the borrow pit to the roadway poses a danger to 7 public safety, as determined by the department. 8 EXPLANATION 9 This bill requires the department of transportation to 10 erect a high-tension cable barrier along portions of a primary 11 highway where a borrow pit is located within the highway 12 right-of-way or on property adjacent to the right-of-way. 13 The barrier is required at locations where the department 14 determines that the proximity of a borrow pit to the roadway 15 poses a danger to public safety. 16 -1- LSB 1537XS (2) 84 dea/nh 1/ 1
