H.F. _____ Section 1. Section 384.84, subsection 4, paragraph a, 1 subparagraph (1), Code 2011, is amended to read as follows: 2 (1) Except as provided in paragraph “d” , all rates or 3 charges for the services of sewer systems, storm water drainage 4 systems, sewage treatment, solid waste collection, water, 5 solid waste disposal, or any of these services, if not paid 6 as provided by ordinance of the council or resolution of the 7 trustees, are a lien upon the property or premises served 8 by any of these services upon certification to the county 9 treasurer that the rates or charges are due. The governing 10 body of a city utility may, by resolution, delegate to a 11 designee named in the resolution the city utility’s authority 12 to certify unpaid rates or charges to the county treasurer. 13 The city council of a city that is contracting with a city 14 utility for joint billing or collection or both pursuant to 15 chapter 28E may, by ordinance, delegate to such city utility, 16 or the city utility’s designee, the city’s authority to certify 17 unpaid rates or charges to the county treasurer. 18 EXPLANATION 19 This bill relates to the certification to a county treasurer 20 of unpaid rates or charges due for the services of sewer 21 systems, storm water drainage systems, sewage treatment, solid 22 waste collection, water, or solid waste disposal. 23 The bill would allow for a city utility to delegate its 24 certification authority to a designee by a resolution of the 25 utility’s governing board. The bill also allows for a city 26 council to delegate its certification authority, by ordinance 27 of the city council, to a city utility if it has contracted 28 with the city utility under Code chapter 28E for joint billing 29 or collection services, or to that utility’s designee. 30 -1- LSB 2136HC (2) 84 aw/sc 1/ 1
