H.F. _____ Section 1. Section 708.6, Code 2011, is amended by striking 1 the section and inserting in lieu thereof the following: 2 708.6 Intimidation with a dangerous weapon or motor vehicle. 3 1. A person commits intimidation with a dangerous weapon 4 when the person shoots, throws, launches, or discharges a 5 dangerous weapon at, into, or in a building, vehicle, airplane, 6 railroad engine, railroad car, or boat, occupied by another 7 person, or within an assembly of people, and thereby places 8 the occupants or people in reasonable apprehension of serious 9 injury or threatens to commit such an act under circumstances 10 raising a reasonable expectation that the threat will be 11 carried out. 12 2. A person commits intimidation with a motor vehicle 13 when the person drives a motor vehicle at or into a building, 14 vehicle, airplane, railroad engine, railroad car, or boat, 15 occupied by another person, or at or into an assembly 16 of people, and thereby places the occupants or people in 17 reasonable apprehension of serious injury or threatens to 18 commit such an act under circumstances raising a reasonable 19 expectation that the threat will be carried out. 20 3. a. A person who commits intimidation with a dangerous 21 weapon is guilty of a class “D” felony. 22 b. A person who commits intimidation with a motor vehicle is 23 guilty of a class “D” felony. 24 4. a. A person who commits intimidation with a dangerous 25 weapon with the intent to injure or provoke fear or anger in 26 another is guilty of a class “C” felony. 27 b. A person who commits intimidation with a motor vehicle 28 with the intent to injure or provoke fear or anger in another 29 is guilty of a class “C” felony. 30 EXPLANATION 31 This bill relates to the criminal offense of intimidation 32 with a dangerous weapon or motor vehicle. 33 The bill reorganizes Code section 708.6 and creates the 34 criminal offense of intimidation with a motor vehicle. 35 -1- LSB 2208YC (1) 84 jm/nh 1/ 2
H.F. _____ The bill does not modify the existing criminal offense of 1 intimidation with a dangerous weapon. 2 Under the bill, a person commits intimidation with a motor 3 vehicle if the person drives a motor vehicle at or into a 4 building, vehicle, airplane, railroad engine, railroad car, or 5 boat, occupied by another person, or at or into an assembly 6 of people, placing the occupants or people in reasonable 7 apprehension of serious injury or threatens to commit such an 8 act under circumstances raising a reasonable expectation that 9 the threat will be carried out. 10 A person who commits intimidation with a motor vehicle is 11 guilty of a class “D” felony. 12 A person who commits intimidation with a motor vehicle with 13 the intent to injure or provoke fear or anger in another is 14 guilty of a class “C” felony. 15 A class “D” felony is punishable by confinement for no more 16 than five years and a fine of at least $750 but not more than 17 $7,500.
