House Study Bill 61 - Introduced HOUSE RESOLUTION NO. _____ BY (PROPOSED COMMITTEE ON COMMERCE RESOLUTION BY CHAIRPERSON SODERBERG) A Resolution opposing regulation of greenhouse gases 1 pursuant to the federal Clean Air Act. 2 WHEREAS, the Environmental Protection Agency (EPA) 3 has released an advance notice of proposed rulemaking 4 which describes a nationwide scheme to regulate 5 greenhouse gases under the Clean Air Act; and 6 WHEREAS, if the EPA pursues such regulation, 7 it should require additional action from Congress 8 clarifying and specifying the EPA’s legal and 9 regulatory obligations with respect to greenhouse 10 gases; and 11 WHEREAS, the EPA’s plan to regulate greenhouse 12 gases is very expansive in scope, envisioning a 13 nationwide cap and trade program for greenhouse gases, 14 additional motor vehicle regulations, and economy-wide 15 restrictions impacting a wide range of industries 16 including dairy and beef operations, office buildings, 17 hospitals, schools, large homes, houses of worship, and 18 even regulating the greenhouse gas emissions from lawn 19 mowers, among other things; and 20 WHEREAS, the United States Court of Appeals for the 21 District of Columbia has recently ruled that the EPA 22 does not have authority to carry out a cap and trade 23 plan under the Clean Air Act; and 24 WHEREAS, the EPA’s plan constitutes policymaking, 25 which is the prerogative of the legislative branch of 26 government; and 27 -1- LSB 2073YC (5) 84 rn/nh 1/ 2

H.R. _____ WHEREAS, climate change is a global issue, not a 1 local or regional pollution issue which the Clean Air 2 Act was designed to address; and 3 WHEREAS, the EPA’s plan would impose a massive 4 economic burden on this country without appreciably 5 reducing worldwide concentrations of greenhouse 6 gases; NOW THEREFORE, 7 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, That 8 the House of Representatives is opposed to the EPA 9 making an endangerment finding for greenhouse gases or 10 pursuing regulation of greenhouse gases; and 11 BE IT FURTHER RESOLVED, That copies of this 12 Resolution shall be sent to the members of Iowa’s 13 congressional delegation and to the administrator of 14 the EPA. 15 -2- LSB 2073YC (5) 84 rn/nh 2/ 2
