H.F. _____ Section 1. Section 257.8, subsections 1 and 2, Code 1 Supplement 2011, are amended to read as follows: 2 1. State percent of growth. The state percent of growth 3 for the budget year beginning July 1, 2010, is two percent. 4 The state percent of growth for the budget year beginning 5 July 1, 2012, is two percent. The state percent of growth 6 for each subsequent budget year years shall be established by 7 statute which shall be enacted in each odd-numbered year and 8 shall include the state percent of growth for the budget year 9 beginning July 1 of the calendar year in which the statute is 10 enacted and the state percent of growth for the budget year 11 beginning July 1 of the calendar year following the calendar 12 year in which the statute is enacted. The statute establishing 13 the state percent of growth for both such years shall be 14 enacted within thirty days of the submission in the year 15 preceding the base year of the governor’s budget under section 16 8.21 in each odd-numbered year . The establishment of the state 17 percent of growth for a budget year both such years pursuant to 18 this subsection shall be the only subject matter of the bill 19 which enacts the state percent of growth for a budget year . 20 2. Categorical state percent of growth. The categorical 21 state percent of growth for the budget year beginning July 22 1, 2010, is two percent. The categorical state percent of 23 growth for the budget year beginning July 1, 2012, is two 24 percent. The categorical state percent of growth for each 25 subsequent budget year years shall be established by statute 26 which shall be enacted in each odd-numbered year and shall 27 include the categorical state percent of growth for the budget 28 year beginning July 1 of the calendar year in which the statute 29 is enacted and the categorical state percent of growth for the 30 budget year beginning July 1 of the calendar year following the 31 calendar year in which the statute is enacted. The statute 32 establishing the state percent of growth for both such years 33 shall be enacted within thirty days of the submission in the 34 year preceding the base year of the governor’s budget under 35 -1- LSB 6029YC (2) 84 md/sc 1/ 2

The establishment 1 of the categorical state percent of growth for a budget year 2 both such years pursuant to this subsection shall be the only 3 subject matter of the bill which enacts the categorical state 4 percent of growth for a budget year . The categorical state 5 percent of growth may include state percents of growth for 6 the teacher salary supplement, the professional development 7 supplement, and the early intervention supplement. 8 Sec. 2. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 9 immediate importance, takes effect upon enactment. 10 EXPLANATION 11 This bill modifies the requirements for enacting the state 12 percent of growth and the categorical state percent of growth 13 under Code section 257.8. 14 Current law requires the state percent of growth and the 15 categorical state percent of growth to be established by 16 statute within 30 days of the submission of the governor’s 17 budget in the year preceding the base year. 18 The bill requires the state percent of growth and the 19 categorical state percent of growth to be established by 20 statute in each odd-numbered year for the budget year beginning 21 July 1 of the calendar year in which the statute is enacted 22 and for the budget year beginning July 1 of the calendar year 23 following the calendar year in which the statute is enacted. 24 The bill also requires that the statute establishing such 25 percents of growth be enacted within 30 days of the submission 26 of the governor’s budget in each odd-numbered year. 27 The bill takes effect upon enactment. 28 -2- LSB 6029YC (2) 84 md/sc 2/ 2
