35A.13,
subsection
4,
Code
Supplement

is
amended
to
read
as
follows:

The
minimum
balance
of
the
trust
fund
required
prior

to
expenditure
of
moneys
from
the
trust
fund
is
five
million
4
dollars.
Once
the
minimum
balance
is
reached,
the
interest
and
5
earnings
on
the
fund
and
any
moneys
received
under
subsection
6
2
,
paragraph
“a”
,
are
appropriated
to
the
commission
to
be
7
used
to
achieve
the
purposes
of
this
section
.
However,
four
8
percent
of
the
balance
in
the
trust
fund
at
the
beginning
9
of
each
calendar
year,
or
so
much
thereof
as
is
necessary,
10
is
appropriated
to
the
department
to
be
used
to
achieve
the
11
purposes
of
this
section,
as
approved
by
the
commission.
It
12
is
the
intent
of
the
general
assembly
that
the
balance
in
the
13
trust
fund
reach
fifty
million
dollars.

Sec.
2.
EFFECTIVE
DATE.
This
Act,
being
deemed
of
immediate
15
importance,
takes
effect
upon
enactment.

Sec.
3.
RETROACTIVE
APPLICABILITY.
This
Act
applies
17
retroactively
to
January
1,
2012,
for
the
purpose
of
the
2012
18
calendar
year
appropriation
of
four
percent
of
the
balance
of
19
the
trust
fund.

EXPLANATION
21
This
bill
relates
to
the
use
of
moneys
in
the
veterans
trust
22
fund.
23
Current
law
provides
that
only
the
interest
and
earnings
24
on
the
fund
and
certain
other
moneys
received
by
the
veterans
25
trust
fund
are
appropriated
to
the
commission
of
veterans
26
affairs
to
achieve
the
purposes
of
the
trust
fund.
27
The
bill
amends
Code
section
35A.13(4)
to
limit
the
current
28
appropriation
to
the
commission
to
only
the
interest
and
29
earnings
on
the
minimum
balance
of
the
trust
fund
and
to
30
appropriate
up
to
4
percent
of
the
balance
of
the
trust
fund
31
at
the
beginning
of
each
calendar
year
to
the
department
of
32
veterans
affairs
to
be
used
to
achieve
the
purposes
of
the
33
trust
fund,
as
approved
by
the
commission.

The
bill
takes
effect
upon
enactment
and
applies
