use
of
an
amount
of
the
capacity
of
the

facilities,

the
joint
agreement
so
provides.
“Own”

case

transmission
facilities,
including

and
associated
facilities,
does
not
may
include

those
which
are
located
in
states
which
are
not
contiguous
to

Transmission
facility

In
addition
to
the
powers
conferred
upon
a
city
or
electric
15
power
agency
elsewhere
in
this
chapter,
a
city
or
electric
16
power
agency
may
acquire
ownership
interest
in
a
transmission
17
facility,
including
ownership
of
the
capacity
of
such
facility,
18
within
this
state
or
in
any
other
state
for
the
purpose
19
of
participating
with
other
utilities
in
transmission
to
20
be
operated
by
a
regional
transmission
organization
or
an
21
independent
transmission
operator
approved
by
the
federal
22
energy
regulatory
commission.
For
purposes
of
this
section,
23
“electric
power
agency”
means
the
same
as
defined
in
section
24
390.9.

EXPLANATION
26
This
bill
expands
the
definition
of
“ownership”
of
27
transmission
facilities
subject
to
a
joint
agreement
between
28
participants,
which
may
include
a
city,
electric
cooperative,
29
or
privately
owned
utility
company,
to
include
facilities
30
located
outside
the
state
of
Iowa.
Currently,
Code
section
31
390.1,
subsection
9,
restricts
ownership
to
facilities
which
32
are
located
within
Iowa
or
in
states
contiguous
to
Iowa.

The
bill
provides
that
in
addition
to
other
powers
34
conferred
upon
a
city
or
electric
power
agency,
a
city
or
