EXPLANATION
3
This
bill
removes
a
provision
that
directs
the
director
of
4
the
department
of
education
to
require
a
school
district
that
5
has
one
or
more
attendance
centers
identified
as
a
persistently
6
lowest-achieving
school
to
negotiate
with
the
school
district’s
7
employee
organization
to
reach
a
memorandum
of
understanding
8
that
contains
an
agreement
regarding
which
of
the
four
possible
9
interventions
the
school
district
will
implement
as
required
by
10
the
U.S.
department
of
education.

Currently,
the
school
district
and
the
employee
organization
12
representing
the
school
district’s
teachers
must
meet
at
13
reasonable
times
to
negotiate
a
memorandum
of
understanding
14
that
contains
an
agreement
on
the
specific
intervention
to
15
be
implemented
and
a
provision
stating
that
the
terms
of
any
16
collective
bargaining
agreement
between
the
parties
shall
17
remain
in
effect
and
unaltered
except
as
specifically
agreed
18
to
in
the
memorandum.
If
the
parties
are
unable
to
reach
an
19
agreement
within
45
days,
they
must
select
an
impartial
and
20
disinterested
person
to
serve
as
a
mediator,
who
shall
not
21
compel
the
parties
to
agree.
If
mediation
fails
after
30
22
days,
the
school
district
shall
not
receive
any
federal
school
23
improvement
funds
for
the
attendance
center
identified
as
a
24
persistently
lowest-achieving
school.
The
memorandum
remains
25
in
effect
for
the
period
of
time
that
an
attendance
center
is
26
identified
as
a
persistently
lowest-achieving
school
unless
a
27
duration
period
is
included
in
the
memorandum
or
the
parties
28
mutually
agree
to
amend
the
memorandum.
