H.F. _____ DIVISION I 1 APPROPRIATIONS 2 Section 1. FISCAL YEAR 2011-2012 TEMPORARY APPROPRIATIONS. 3 1. APPROPRIATIONS DETERMINED FROM ENROLLED BILLS. The 4 department of management, in consultation with the legislative 5 services agency, shall determine the amount of all line 6 item appropriations, standing limited appropriations, and 7 standing unlimited appropriations otherwise limited by law, 8 including appropriations from federal and nonstate funds, made 9 for the fiscal year beginning July 1, 2011, and ending June 10 30, 2012, by bills passed by both the senate and the house 11 of representatives during the 2011 Regular Session of the 12 Eighty-fourth General Assembly and enrolled for presentation 13 to the governor, as affected by any applicable provision of 14 law. The department of management, in consultation with the 15 legislative services agency, shall also identify the entities 16 to which such appropriations are so made. 17 2. TEMPORARY APPROPRIATIONS. There is appropriated 18 from the appropriate state fund or account to the entities 19 identified pursuant to subsection 1, for the period beginning 20 July 1, 2011, and ending July 31, 2011, amounts, or so much 21 thereof as is necessary, equal to one-twelfth of the amounts of 22 all line item appropriations, standing limited appropriations, 23 and standing unlimited appropriations otherwise limited by law, 24 including federal and nonstate funds, made for the fiscal year 25 beginning July 1, 2011, and ending June 30, 2012, as determined 26 pursuant to subsection 1. 27 3. CARRYFORWARDS TEMPORARILY SUPPLANTED. The amounts 28 appropriated under subsection 2 shall supplant, for only the 29 period beginning July 1, 2011, and ending July 31, 2011, any 30 appropriation carried forward from any previous fiscal year 31 into the fiscal year beginning July 1, 2011, and ending June 32 30, 2012. 33 4. H.F. _____ enrolled bill, as passed by both the senate and the house 1 of representatives during the 2011 Regular Session of the 2 Eighty-fourth General Assembly, containing the same line 3 item appropriation or limited standing appropriation for the 4 fiscal year beginning July 1, 2011, and ending June 30, 2012, 5 as made in the one-twelfth appropriation under subsection 2, 6 the one-twelfth appropriation amount shall be considered an 7 allotment of the line item appropriation or limited standing 8 appropriation for the full fiscal year beginning July 1, 2011, 9 and ending June 30, 2012. 10 Sec. 2. FISCAL YEAR 2011-2012 CONTINUING APPROPRIATIONS. 11 1. APPROPRIATIONS DETERMINED FROM 2010-2011 LINE ITEM AND 12 LIMITED STANDING APPROPRIATIONS. 13 a. For all line item appropriations, standing limited 14 appropriations, and standing unlimited appropriations otherwise 15 limited by law, including appropriations from federal and 16 nonstate funds, not included in bills passed by both the senate 17 and the house of representatives during the 2011 Regular 18 Session of the Eighty-fourth General Assembly and enrolled for 19 presentation to the governor, the department of management, 20 in consultation with the legislative services agency, shall 21 determine the amount of such line item appropriations, standing 22 limited appropriations, and standing unlimited appropriations 23 otherwise limited by law, including appropriations from federal 24 and nonstate funds, made for the fiscal year beginning July 1, 25 2010, and ending June 30, 2011, by taking into consideration 26 all of the following: 27 (1) 2011 Iowa Acts, House File 45 and Senate File 209, and 28 other 2011 Iowa Acts. 29 (2) 2010 Iowa Acts, chapter 1193, sections 27 and 28, and 30 other 2010 Iowa Acts. 31 (3) All interdepartmental and intradepartmental transfers 32 made pursuant to section 8.39 and other provisions of law. 33 (4) Other provisions of law. 34 b. H.F. _____ legislative services agency, shall also identify the entities 1 to which such appropriations were so made, or the entities’ 2 successors. 3 2. CONTINUING APPROPRIATIONS. There is appropriated 4 from the appropriate state fund or account to the entities 5 identified pursuant to subsection 1, for the period beginning 6 July 1, 2011, and ending July 31, 2011, amounts, or so much 7 thereof as is necessary, equal to one-twelfth of the amounts of 8 all line item appropriations, standing limited appropriations, 9 and standing unlimited appropriations otherwise limited by law, 10 including federal and nonstate funds, made for the fiscal year 11 beginning July 1, 2010, and ending June 30, 2011, as determined 12 pursuant to subsection 1. 13 3. DUPLICATIVE STANDING APPROPRIATIONS TEMPORARILY 14 SUPPLANTED. The amounts appropriated under subsection 2 shall 15 supplant, for only the period beginning July 1, 2011, and 16 ending July 31, 2011, any duplicative standing appropriation 17 for the fiscal year beginning July 1, 2011, and ending June 30, 18 2012. 19 4. CARRYFORWARDS TEMPORARILY SUPPLANTED. The amounts 20 appropriated under subsection 2 shall supplant, for only the 21 period beginning July 1, 2011, and ending July 31, 2011, any 22 appropriation carried forward from any previous fiscal year 23 into the fiscal year beginning July 1, 2011, and ending June 24 30, 2012. 25 5. This section of this Act does 3 not apply to appropriations for capital projects. 4 Sec. 3. EFFECTIVE DATE AND RETROACTIVE APPLICABILITY. This 5 division of this Act takes effect upon enactment and, 6 if approved by the governor after July 1, 2011, applies 7 retroactively to July 1, 2011. 8 DIVISION II 9 MISCELLANEOUS 10 Sec. 4. 2011 Iowa Acts, House File 645, section 5, 11 subsection 4, paragraph a, if enacted, is amended to read as 12 follows: 13 a. FTEs 17.00 18 29.00 19 EXPLANATION 20 APPROPRIATIONS. This division appropriates moneys for the 21 period beginning July 1, 2011, and ending July 31, 2011, to 22 entities identified as in receipt of appropriations for the 23 2010-2011 or 2011-2012 fiscal year. 24 The temporary appropriations made in the division are equal 25 to one-twelfth of the amounts of all line item appropriations, 26 standing limited appropriations, and standing unlimited 27 appropriations otherwise limited by law, including federal and 28 nonstate funds, made by enrolled bills for the 2011-2012 fiscal 29 year. The one-twelfth appropriation amounts are required to 30 be determined by the department of management, in consultation 31 with the legislative services agency, from the annual 32 appropriations made for the 2011-2012 fiscal year, by bills 33 passed by both the senate and the house of representatives 34 during the 2011 Regular Session and enrolled for presentation 35 -4- LSB 2834YC (12) 84 tm/rj 4/ 5
H.F. _____ to the governor. 1 For all line item appropriations, standing limited 2 appropriations, and standing unlimited appropriations otherwise 3 limited by law, including appropriations from federal and 4 nonstate funds, not included in bills passed by both the senate 5 and the house of representatives during the 2011 Regular 6 Session, the continuing appropriations made in the division 7 are equal to one-twelfth of the amounts of all line item 8 appropriations, standing limited appropriations, and standing 9 unlimited appropriations otherwise limited by law, including 10 federal and nonstate funds, made for the 2010-2011 fiscal year, 11 by taking into consideration all provisions of law affecting 12 such appropriations, including Acts of the general assembly and 13 interdepartmental and intradepartmental transfers. 14 For both temporary and continuing appropriations, the 15 one-twelfth appropriation amounts temporarily supplant any 16 appropriations carried forward from previous fiscal years. For 17 the continuing appropriations, the one-twelfth appropriation 18 amounts also temporarily supplant any duplicative standing 19 appropriation for the 2011-2012 fiscal year. 20 For both temporary and continuing appropriations, the 21 one-twelfth appropriation amounts become an allotment of the 22 full year appropriation amounts upon the governor’s approval of 23 the enrolled bills containing the same line item appropriations 24 or limited standing appropriations. 25 The division takes effect upon enactment. If the governor 26 signs the division after July 1, 2011, the division applies 27 retroactively to that date. 28 MISCELLANEOUS.
