H.F. _____ Section 1. NEW SECTION . 137G.1 Food vendor —— motor vehicle 1 —— criminal history record check. 2 1. A business that operates a motor vehicle primarily 3 marketing the sale and dispensing of ice cream or other food 4 products from or near the motor vehicle to children may require 5 an employee, vendor, contractor, or agent of the business to 6 undergo a criminal history record check by the business. 7 2. The business may request the division of criminal 8 investigation of the department of public safety to conduct 9 a national criminal history record check through the federal 10 bureau of investigation. The screening of an employee, vendor, 11 contractor, or agent of the business through the federal bureau 12 of investigation, if conducted, shall be by submission of 13 fingerprints through the state criminal history repository to 14 the federal bureau of investigation. 15 EXPLANATION 16 This bill relates to criminal history record checks for 17 certain food vendors. 18 The bill provides that a business that operates a motor 19 vehicle primarily marketing the sale and dispensing of ice 20 cream or other food products from or near the motor vehicle to 21 children may require an employee, vendor, contractor, or agent 22 of the business to undergo a criminal history record check by 23 the business. 24 The bill further provides that the business may request the 25 division of criminal investigation of the department of public 26 safety to conduct a national criminal history record check 27 through the federal bureau of investigation.
