H.F. _____ Section 1. Section 331.302, Code 2011, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 17. A county shall not adopt or enforce 3 an ordinance that creates different classes of persons 4 within the ordinance to distinguish between persons living in 5 owner-occupied housing and persons living in rental properties 6 or that creates different classes of residential property based 7 on whether the property is owner-occupied or is leased to a 8 person who does not own the property. 9 Sec. 2. Section 364.3, Code 2011, is amended by adding the 10 following new subsection: 11 NEW SUBSECTION . 11. A city shall not adopt or enforce an 12 ordinance that creates different classes of persons within 13 the ordinance to distinguish between persons living in 14 owner-occupied housing and persons living in rental properties 15 or that creates different classes of residential property based 16 on whether the property is owner-occupied or is leased to a 17 person who does not own the property. 18 EXPLANATION 19 This bill restricts the ability of cities and counties to 20 adopt and enforce ordinances which distinguish between persons 21 living in owner-occupied housing and persons living in rental 22 properties or which distinguishes residential property based on 23 whether it is owner-occupied or leased. 24 -1- LSB 2707YC (2) 84 aw/sc 1/ 1
