House Study Bill 2 - Introduced HOUSE RESOLUTION NO. _____ BY (PROPOSED COMMITTEE ON ADMINISTRATION AND RULES RESOLUTION BY CHAIRPERSON SCHULTE) A Resolution relating to permanent rules of the House 1 for the eighty-fourth general assembly. 2 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, That 3 the permanent rules of the House for the eighty-third 4 eighty-fourth general assembly be as follows: 5 DIVISION I —— GENERAL RULES 6 Rule 1 7 Call to Order and Order of Business 8 The speaker shall take the chair at the hour to 9 which the house has adjourned, and shall immediately 10 call the house to order, correct the journal of the 11 previous day’s proceedings, and proceed to other 12 business, including, but not limited to, introduction 13 of bills, reports, messages, communications, business 14 pending at adjournment, announcements, resolutions 15 and bills on their passage, and points of personal 16 privilege. 17 Rule 2 18 Quorum Call and Time of Convening 19 The house shall convene each Monday at 1:00 p.m. and 20 at 9:00 8:30 a.m. on all other legislative days, unless 21 otherwise ordered. The time of convening shall be 22 recorded in the journal. The house shall not convene 23 on Sunday during a regular or special session. 24 The speaker or a member may request a roll call to 25 determine if a quorum is present. 26 Rule 3 27 -1- LSB 1418YC (14) 84 rj/nh 1/ 42

H.R. _____ Absences from the House 1 No member shall be absent without leave while the 2 house is in session unless excused for good cause. 3 Rule 4 4 Preservation of Order 5 The speaker shall preserve order and decorum and 6 speak to points of order. Subject to an appeal to the 7 house by any member, the speaker shall decide questions 8 of order which shall not be debated. 9 The speaker may have the chamber of the house 10 cleared in case of any disturbance or disorderly 11 conduct. 12 Only past legislators, state officials, persons 13 whose presence is deemed by the speaker to be of 14 special significance to the house, and school classes 15 accompanied by teachers and seated in the galleries 16 shall be introduced in the house. 17 No person other than a member of the house shall be 18 allowed to speak from the floor of the house without 19 prior permission of the speaker. 20 The public may take photographs from the galleries 21 at any time. However, the use of flash bulbs or any 22 other artificial lighting is prohibited. 23 Members of the press may photograph from the press 24 box, but shall not use artificial lighting without 25 prior permission from the chief clerk of the house. 26 Photographs shall not be taken on the house floor when 27 the members are voting on a question put before the 28 house. H.R. _____ Photographs may be taken on the house floor at other 1 times with the consent of the subject or subjects of 2 the photography. 3 Rule 4A 4 Use of Telephonic or Electronic Devices in Chamber 5 Restricted 6 1. A person present in the house chamber while the 7 house is in order shall mute any cell phone, computer, 8 or other electronic device under the person’s control. 9 The speaker may remove from the chamber any person 10 acting in violation of this rule. 11 2. A member shall not use a cell phone or other 12 electronic device to audibly transmit or receive 13 communications while recognized by the presiding 14 officer to speak in debate. 15 Rule 5 16 Rules of Parliamentary Practice 17 The rules of parliamentary practice in Mason’s 18 Manual of Legislative Procedure shall govern the house 19 in all cases where they are not inconsistent with the 20 standing rules of the house, joint rules of the house 21 and senate, or customary practice of the house. 22 Rule 5A 23 House Budget 24 The speaker of the house shall annually prepare a 25 proposed budget for the house of representatives for 26 the payment of expenses, salaries, per diems, and other 27 items. The proposed budget shall be submitted on the 28 fourteenth day of each legislative session to the house 29 administration and rules committee, which shall approve 30 -3- LSB 1418YC (14) 84 rj/nh 3/ 42

H.R. _____ a proposed budget in house resolution form. The house 1 shall adopt a budget prior to adjournment. 2 Rule 6 3 The Speaker Pro Tempore 4 The house shall, at its pleasure, elect a speaker 5 pro tempore. When the speaker shall for any cause be 6 absent, the speaker pro tempore shall preside, except 7 when the chair is filled by appointment by either the 8 speaker or the speaker pro tempore. If a vacancy 9 occurs in the office of speaker, the speaker pro 10 tempore shall assume the duties and responsibilities of 11 the speaker until such time as the house shall elect a 12 new speaker. The speaker or the speaker pro tempore 13 shall have the right to name any member to perform the 14 duties of speaker, but such substitution shall not 15 extend beyond the adjournment. The acts of the speaker 16 pro tempore shall have the same validity as those of 17 the speaker. In the absence of both the speaker and 18 the speaker pro tempore, the house shall name a speaker 19 who shall preside over it and perform all the duties of 20 the speaker with the exception of signing bills, until 21 such time as the speaker or speaker pro tempore shall 22 be present, and the person’s acts shall have the same 23 force and validity as those of the regularly elected 24 speaker. 25 Rule 7 26 Amendment of Rules 27 A motion to change or rescind a standing rule or 28 order of the house requires one day’s notice. 29 Rule 8 30 -4- LSB 1418YC (14) 84 rj/nh 4/ 42

H.R. _____ Violation of House Rules 1 The speaker shall, or any member may, call to order 2 a member who violates the rules of the house. With 3 leave of the house, the member called to order may be 4 permitted to explain. If the case requires it, the 5 member shall be subject to censure of the house. 6 Rule 9 7 Referral of Rule Violations 8 The speaker shall, upon complaint of a member, 9 or upon the speaker’s own motion, refer any alleged 10 violation of house or joint rules by house members, 11 employees or staff to the house ethics committee upon 12 an initial finding that an investigation is warranted. 13 The ethics committee shall investigate such 14 allegations and report them back to the house with a 15 recommendation. 16 Rule 10 17 Recognition and Decorum in Debate 18 A member who wishes to speak in debate shall be 19 appropriately attired, with male members wearing coat 20 or tie. After recognition by the chair, a member 21 shall respectfully address the presiding officer 22 by saying “Mr. or Madam Speaker”. A member shall 23 confine all remarks to the question under debate, 24 shall be respectful of other members, and shall avoid 25 referencing or questioning the motives of another 26 member. 27 Rule 11 28 Limit on Debate 29 No member shall speak more than once on the same 30 -5- LSB 1418YC (14) 84 rj/nh 5/ 42

H.R. _____ question without leave of the speaker, nor more than 1 twice until every member choosing to speak has spoken, 2 except as provided in Rule 81. A member shall be 3 limited to ten minutes debate on bills, resolutions, 4 and amendments, but may be granted an extension of time 5 by consent of the house. However, the floor manager 6 of a bill or resolution and the lead sponsor of an 7 amendment may exceed the ten-minute limit on opening 8 and closing remarks. 9 Rule 12 10 Decorum During Debate 11 No member shall leave the house while the speaker 12 is putting a question. No one shall pass between the 13 speaker and a member who is speaking or two members who 14 have been recognized by the speaker. 15 Rule 13 16 Stating the Question 17 When a motion is made, it shall be stated by the 18 speaker. A motion made in writing shall be passed to 19 the speaker’s station before it is debated. 20 Rule 14 21 Putting the Question 22 Questions shall be distinctly put in this form: 23 “All those in favor of (the question) shall say ‘aye’;” 24 and after the affirmative voice is expressed, “All 25 those opposed to (the question) shall say ‘no’.” If 26 the speaker is in doubt or a member of the house 27 requests, a nonrecord roll call vote shall be taken. 28 DIVISION II —— EMPLOYEES OF THE HOUSE 29 Rule 15 30 -6- LSB 1418YC (14) 84 rj/nh 6/ 42

H.R. _____ Chief Clerk of the House 1 The chief clerk of the house shall serve as 2 parliamentarian and chief administrative officer of the 3 house under the direction of the speaker of the house. 4 The chief clerk shall supervise the chief clerk’s 5 office; be responsible for the custody and safekeeping 6 of all bills, resolutions, and amendments filed, 7 except when they are in the custody of a committee; 8 have charge of the daily journal; have control of all 9 rooms assigned for the use of the house; attest to the 10 accuracy and correctness of text and action on bills 11 and resolutions; process the handling of amendments 12 when filed and during the floor consideration of bills; 13 insert adopted amendments into bills before transmittal 14 to the senate and prior to final enrollment; supervise 15 legislative printing and the distribution of printed 16 material; and perform all other duties pertaining to 17 the office of the chief clerk. 18 Rule 16 19 Legislative and Session Days 20 For purposes of these rules, a legislative day is a 21 day when the house is called to order. A legislative 22 day that runs past midnight is not considered a new 23 legislative day. A session day is any calendar day 24 beginning with the convening of the annual regular 25 session and ending with adjournment sine die. 26 Rule 17 27 Sergeant-At-Arms 28 The sergeant-at-arms shall execute all orders 29 of the house and the presiding officer; perform all 30 -7- LSB 1418YC (14) 84 rj/nh 7/ 42

H.R. _____ assigned duties related to the policing and good order 1 of the house; supervise the entrance and exit of all 2 persons to and from the chamber; promptly execute all 3 messages, etc.; provide that the chamber is properly 4 ventilated and open for the use of the members; and 5 perform all other services pertaining to the office of 6 sergeant-at-arms. 7 Rule 18 8 Secretaries 9 Each member may hire a secretary for the legislative 10 session who shall be under the general direction of the 11 member and the chief clerk. Secretaries shall be on 12 duty at the house from 8:00 a.m. to 4:30 p.m. Monday 13 through Thursday and on other legislative days when 14 required by the chief clerk, except when excused by the 15 member for whom the secretary works. Secretaries shall 16 perform such duties as may be assigned to them by the 17 member or the chief clerk. 18 Rule 19 19 Extra Compensation of Employees 20 No employee shall receive any extra compensation, 21 except as provided by the house, or tips for services 22 performed while on duty. Any violation of this rule 23 shall be grounds for removal. 24 DIVISION III —— VISITORS AND LOBBYISTS 25 Rule 20 26 Admission to the House; Lobbying 27 The chamber of the house shall include the 28 vestibule, restrooms, bill room, lounge, visitors’ 29 galleries, and floor of the house. 30 -8- LSB 1418YC (14) 84 rj/nh 8/ 42

H.R. _____ The floor of the house shall consist of the 1 area between the north and south walls, including 2 the representatives’ desks, the press box, and the 3 speaker’s station, but excluding the visitors’ 4 galleries. 5 During a legislative day while the house is in 6 order, no member of the general assembly or legislative 7 employee or intern shall be admitted to the floor of 8 the house if attired in jeans of any color without 9 leave of the speaker. 10 During a legislative day while the house is in 11 order, and one-half hour before the house convenes and 12 one-half hour after the house recesses or adjourns, 13 no person shall be admitted to the floor of the house 14 except: 15 1. Members of the general assembly and authorized 16 legislative employees in the performance of their 17 duties. 18 2. Former members of the general assembly who are 19 not registered lobbyists. 20 3. A general assembly member’s family. 21 4. Representatives of the press, radio, and 22 television who shall go directly to and from the press 23 box. 24 5. Legislative interns registered with the chief 25 clerk who shall go directly to and from the seat of 26 their assigned representative or to be seated in the 27 perimeter seating area. 28 6. Members of the state executive council, the 1 lieutenant governor, the attorney general, the 2 governor’s executive assistants and administrative 3 assistants, and the administrative rules coordinator, 4 all of whom shall be confined to the perimeter area. 5 The current status of former members of the general 6 assembly shall govern their access to the floor under 7 these rules. 8 No other persons shall be allowed on the house floor 9 while the house is in order without permission of the 10 presiding officer of the house. When the house is not 11 in order, guests of a member of the general assembly 12 escorted by that member shall be allowed on the house 13 floor. 14 No person admitted to the floor of the house while 15 the house is in order, except members of the general 16 assembly, shall lobby or attempt to exercise any 17 influence with any member for or against any matter 18 then pending or that may thereafter be considered by 19 the house. 20 A registered lobbyist shall not be admitted to 21 the floor of the house on any legislative day except 22 for ceremonial purposes or for attendance at public 23 hearings. 24 A lobbyist who represents the position of a state 25 government agency, in which the person serves or is 26 employed as the designated representative for purposes 27 of encouraging the passage or defeat of legislation, 28 shall file with the chief clerk of the house a 29 statement of the general subjects of legislation in 30 -10- LSB 1418YC (14) 84 rj/nh 10/ 42

H.R. _____ which the lobbyist is or may be interested, but shall 1 not lobby for or against a bill, resolution, or study 2 bill unless the lobbyist does so with the written 3 authorization and on behalf of a statewide elected or 4 retained official. The written authorization shall be 5 filed with the chief clerk by the following statewide 6 elected or retained official for the following offices, 7 departments, agencies, and branch: 8 By the attorney general, auditor of state, secretary 9 of state, and treasurer of state, for their respective 10 offices. 11 By the secretary of agriculture, for the department 12 of agriculture and land stewardship. 13 By the governor, for all other executive branch 14 offices and departments. 15 By the chief justice of the supreme court, for the 16 judicial branch. 17 Each member, employee of the house, and registered 18 lobbyist shall report violations of this rule 19 immediately to the sergeant-at-arms. 20 Any person for cause may be summarily dismissed 21 from the chamber of the house, by action of the house, 22 and may forfeit that person’s right to admission 23 thereafter. 24 Rule 20A 25 Legislative Interns 26 A member may appoint one or more interns who shall 27 register with the chief clerk. Only one legislative 28 intern per member of the house is allowed on the floor 29 of the house at any one time. 30 -11- LSB 1418YC (14) 84 rj/nh 11/ 42

H.R. _____ Rule 21 1 Distribution of Literature 2 No person except a member or employee of the house 3 of representatives shall generally distribute or cause 4 to be distributed any pamphlets, material, or other 5 printed literature, or any other items to the members’ 6 desks in the house. An employee of the house shall 7 generally distribute or cause to be distributed such 8 literature or items only on behalf of the employee’s 9 office or staff. Items which are permissible gifts 10 under chapter 68B of the Code may be distributed to 11 the members’ desks with the authorization of the chief 12 clerk. 13 All copies of pamphlets, material, or printed 14 literature distributed by a member or employee of the 15 house of representatives shall bear the name of the 16 member or employee’s office or staff. 17 Other distributions of pamphlets, material, or other 18 printed literature shall bear their source of origin 19 and be distributed through the legislative post office 20 by completing a form containing a member’s or the chief 21 clerk’s authorization, with the authorization form 22 attached to one copy of the distribution. The copy 23 with the attached authorization form shall be retained 24 for a reasonable time period by the legislative post 25 office. 26 Rule 22 27 Distribution of Materials Printed by the State 28 A member of the house shall not distribute maps, 29 books, and pamphlets which have been printed by the 30 -12- LSB 1418YC (14) 84 rj/nh 12/ 42

H.R. _____ state of Iowa and upon which the name of the member 1 of the house has been affixed unless the member has 2 purchased the materials or unless the member has 3 affixed the words “Paid for by the citizens of Iowa and 4 distributed by representative (member’s name).” 5 DIVISION IV —— FORMS AND PROCEDURES FOR BILLS AND OTHER 6 DOCUMENTS 7 Rule 23 8 Documents Signed by the Speaker 9 All acts and joint resolutions shall be signed by 10 the speaker, and all writs, warrants, and subpoenas 11 issued by order of the house, shall be signed by the 12 speaker and attested by the chief clerk. The speaker 13 shall cause certificates of recognition or condolence 14 to be issued by the house which shall be signed by 15 the speaker and the chief clerk. The chief clerk 16 shall maintain a list of certificates issued including 17 the name of the requesting member of the house, the 18 name of the recipient, the reason for recognition or 19 condolence, and the date of issuance. 20 Rule 24 21 Presentation of Petitions 22 All petitions, memorials, and other papers addressed 23 to the house shall be signed by the member and filed 24 with the chief clerk. The receipt of petitions shall 25 be noted in the journal and such petitions shall be 26 available in the office of the chief clerk. 27 Rule 25 28 Consideration of Simple and Concurrent Resolutions 29 Action on a simple or concurrent resolution, except 30 -13- LSB 1418YC (14) 84 rj/nh 13/ 42

H.R. _____ a memorial resolution, shall not be taken until one day 1 after the resolution has been placed on the members’ 2 desks. After the resolution is adopted, the chief 3 clerk shall have the resolution printed in the compiled 4 journal and shall transmit certified copies of the 5 resolution as directed. 6 Rule 26 7 Unanimous Consent Calendar 8 The speaker may, upon the request of three members, 9 place on a unanimous consent calendar any house 10 resolution or concurrent resolution which does not 11 contain an appropriation and which has been laid over 12 under Rule 25. 13 If such resolution is placed on the unanimous 14 consent calendar, it may be removed only upon a written 15 request submitted to the speaker by a member of the 16 house. 17 If not removed after five legislative days, the 18 chief clerk shall call up the resolution and without 19 debate the speaker shall pronounce that it has passed 20 by unanimous consent. 21 If the resolution is removed from the unanimous 22 consent calendar, the speaker may again lay the 23 resolution over under Rule 25, place it on a different 24 calendar, or refer the resolution to any of the 25 standing committees of the house. 26 Rule 26A 27 Senate Bills and Resolutions 28 A senate bill or resolution may be referred to a 29 standing committee or passed on file. 30 -14- LSB 1418YC (14) 84 rj/nh 14/ 42

H.R. _____ Rule 27 1 Forms of Bills and Joint Resolutions 2 Every house bill shall be introduced by one or more 3 members or by any standing or specially authorized 4 committee of the house or the administrative rules 5 review committee. All bills and joint resolutions 6 introduced shall be prepared by the legislative 7 services agency with title, enacting clause, text 8 and explanation as directed by the chief clerk of the 9 house. One copy of each bill shall be presented in a 10 bill cover with the number of copies of the bill and 11 the title as directed by the chief clerk. 12 Rule 28 13 Joint and Nullification Resolutions 14 Joint resolutions shall be framed and treated as 15 bills. 16 A “nullification resolution” is a joint resolution 17 which nullifies all of an administrative rule, or 18 a severable item of an administrative rule adopted 19 pursuant to chapter 17A of the Code. A nullification 20 resolution shall not amend an administrative rule by 21 adding language or by inserting new language in lieu 22 of existing language. 23 A nullification resolution may be introduced by an 24 individual, a standing committee or the administrative 25 rules review committee, and may be referred to a 26 standing committee. A nullification resolution is 27 debatable, but cannot be amended on the floor of the 28 house. 29 Rule 29 30 -15- LSB 1418YC (14) 84 rj/nh 15/ 42

H.R. _____ Time of Introduction of Bills 1 No bill or joint resolution under individual 2 sponsorship, other than a nullification resolution, 3 shall be read for the first time after 4:30 p.m. on 4 Friday of the 6th 5th week of the first regular session 5 of the general assembly unless a formal request for 6 drafting the bill has been filed with the legislative 7 services agency before that time. 8 After adjournment of the first regular session, 9 bills may be prefiled at any time before the convening 10 of the second regular session. No bill or joint 11 resolution under individual sponsorship, other than a 12 nullification resolution, shall be read for the first 13 time after 4:30 p.m. on Friday of the second week of 14 the second regular session of the general assembly 15 unless a formal request for drafting the bill has been 16 filed with the legislative services agency before that 17 time. 18 However, bills or joint resolutions sponsored 19 by standing committees or the administrative rules 20 review committee, co-sponsored by the majority and 21 minority floor leaders, or companion bills sponsored 22 by the house majority leader and the senate majority 23 leader may be drafted and introduced at any time 24 permissible under Joint Rule 20. House, concurrent, 25 and nullification resolutions may be introduced at any 26 time. 27 Rule 30 28 Introduction and Reading of Bills 29 All bills and resolutions to be introduced in 30 -16- LSB 1418YC (14) 84 rj/nh 16/ 42

H.R. _____ the house shall be prepared in proper form and filed 1 with the chief clerk no later than 4:30 p.m. on the 2 legislative day preceding its introduction. 3 Every bill shall receive two readings but no bill 4 shall receive its first and last readings on the same 5 day. 6 A “reading of a bill” as required by these rules 7 shall consist of a reading of the title and enacting 8 clause. 9 Rule 31 10 First Reading, Commitment, and Amendment 11 1. A bill is introduced into the house by an 12 initial or “first reading of the bill”. 13 2. When the house is in session the first reading 14 shall consist of a “reading” as provided in Rule 30. 15 3. Upon a first reading of the bill, the speaker 16 shall state that it is ready for commitment or 17 amendment; and the speaker shall commit it to the 18 standing or select committee, or to a committee of the 19 whole house. If to a committee of the whole house, the 20 house shall determine on what day. 21 4. On a nonlegislative day the speaker may cause a 22 statement, which shall consist of the title, enacting 23 clause, bill number and committee to which the bill 24 is referred, to be published in the house journal. 25 This publication shall constitute a first reading and 26 commitment and shall contain the notation “read and 27 committed under Rule 31”. 28 5. All amendments offered to bills and resolutions 29 shall be accompanied by such copies as the chief clerk 30 -17- LSB 1418YC (14) 84 rj/nh 17/ 42

H.R. _____ shall direct. 1 6. Such amendments shall give the number of 2 the bill sought to amend and the chief clerk shall 3 designate each such amendment thus: Amendment to 4 House File _________, or Senate File ________, by 5 ___________. 6 7. A bill reported out by committee shall go to the 7 speaker who shall direct that the bill be placed on the 8 regular calendar unless it covers subject matter more 9 properly within the jurisdiction of some other standing 10 committee, in which case the speaker shall refer the 11 bill to the proper standing committee. In order to 12 expedite important business and set a definite time for 13 the bill’s consideration, the speaker may direct the 14 bill to be placed on the special order calendar. 15 8. No amendment to the rules of the house, to 16 any resolution or bill, except technical amendments 17 and amendments to bills substituted for by senate 18 files containing substantially identical title, 19 language, subject matter, purpose and intrasectional 20 arrangement, shall be considered by the membership 21 of the house without a copy of the amendment having 22 been filed with the chief clerk by 4:00 p.m. or within 23 one-half hour of adjournment, whichever is later, 24 on the day preceding floor debate on the amendment. 25 If the house adjourns prior to 2:00 p.m. on Friday, 26 the final deadline is two hours after adjournment. 27 However, committee amendments filed pursuant to the 28 submission of the committee report may be accepted 29 after this deadline. H.R. _____ to any proposal debated on the floor of the house 1 after the fourteenth thirteenth week of the first 2 session and the twelfth week of the second session. 3 No amendment or amendment to an amendment to a bill, 4 rule of the house, or resolution shall be considered 5 by the membership of the house without a copy of the 6 amendment being on the desks of the entire membership 7 of the house prior to consideration. However, the 8 membership of the house may consider an amendment or an 9 amendment to an amendment to a bill, rule of the house, 10 or resolution without a copy of the amendment being 11 on the desks of the entire membership of the house 12 prior to consideration if a copy of the amendment is 13 made available to the entire membership of the house 14 electronically. 15 9. An amendment to an appropriations bill 16 introduced by the appropriations committee shall not 17 be considered by the membership of the house if the 18 amendment contains only public policy proposals that 19 are not directly related to an appropriation in the 20 bill. 21 Rule 32 22 Commitment of Appropriation and Revenue Bills 23 All bills to appropriate money shall be referred to 24 the appropriations committee, and all bills pertaining 25 to the levy, assessment, or collection of taxes or fees 26 shall be referred to the committee on ways and means. 27 Rule 33 28 Regular Calendar 29 Bills, nullification resolutions, and joint 30 -19- LSB 1418YC (14) 84 rj/nh 19/ 42

H.R. _____ resolutions reported out for passage, amendment and 1 passage, or without recommendation by a committee, 2 or passed on file shall be arranged on a regular 3 calendar by the chief clerk each day and electronically 4 distributed to the members at the opening of each 5 legislative day. The regular calendar shall include 6 a list of bills, nullification resolutions, and joint 7 resolutions which have been special ordered, including 8 the date upon which debate is scheduled to begin 9 on each of them, which shall be no sooner than five 10 session days from the first date of publication on the 11 regular calendar. 12 Rule 34 13 Daily Debate Calendar 14 The majority floor leadership shall cause to 15 be prepared and distributed to the members at the 16 opening of each legislative day when floor action is 17 scheduled, a daily debate calendar consisting of bills, 18 nullification resolutions, and joint resolutions from 19 the regular calendar setting forth the number and 20 title of bills, nullification resolutions, and joint 21 resolutions for the next legislative day that floor 22 action is scheduled. 23 This rule does not apply to bills which have passed 24 both houses in different forms, reconsiderations, or 25 veto reconsiderations. 26 Rule 35 27 Substitution of Bills 28 A senate bill or resolution may be substituted 29 for an identical house bill or resolution which has 30 -20- LSB 1418YC (14) 84 rj/nh 20/ 42

An amendment to a senate 1 bill or resolution which has been substituted for an 2 identical house bill or resolution is out of order if 3 an identical amendment to the house bill or resolution 4 was considered. 5 Rule 36 6 Consideration of Committee Amendments 7 After a bill has been referred and reported back, 8 it shall be considered on its first reading after the 9 amendments of the committee have been read. 10 Rule 37 11 Amendments to Special Order Bills 12 All amendments to bills which have been special 13 ordered shall be filed at least three session days 14 prior to the date set for debate. Amendments to an 15 amendment shall be filed at least two session days 16 prior to the date set for debate. However, corrective 17 amendments and amendments sponsored by either the 18 majority floor leader or the minority floor leader may 19 be filed at any time. Rule 31, subsection 8, shall not 20 apply to these amendments. 21 A corrective amendment is an amendment which does 22 not substantively change the amendment or the bill. 23 Rule 38 24 Germaneness 25 An amendment must be germane to the subject matter 26 of the bill it seeks to amend. An amendment to an 27 amendment must be germane to both the amendment and the 28 bill it seeks to amend. H.R. _____ members, who shall include the majority and minority 1 leaders, to the speaker’s station to discuss the 2 objection. 3 Rule 39 4 Consideration of Bills 5 Bills, including committee bills, joint resolutions, 6 and nullification resolutions, reported out for 7 passage, for amendment and passage, or without 8 recommendation by the committee, are first eligible to 9 be acted upon beginning the third legislative day they 10 appear on the regular calendar. 11 Committee reports shall be printed in the journal 12 immediately after they are filed with the chief clerk. 13 Reports recommending bills, joint resolutions, and 14 nullification resolutions for passage, for amendment 15 and passage, or without recommendation shall stand 16 approved unless written objections are filed during 17 the first legislative day following their printing in 18 the journal. If objections are filed, they shall be 19 disposed of as soon as possible. 20 Rule 40 21 Consideration of Bills Upon Last Reading 22 No amendment, unless by way of correcting an error 23 or omission, shall be received to any bill on its last 24 reading, and no debate shall be allowed on it. 25 Rule 41 26 Printing of Bills and Joint Resolutions 27 Bills and joint resolutions shall be printed in form 28 as provided by law and by rule. H.R. _____ Legalizing bills of a local or private nature shall 1 be printed in bill form and placed in the files of the 2 members, the same as other bills, in the order of their 3 introduction. The cost of printing shall be deposited 4 with the treasurer of state in advance at a rate to be 5 fixed, and the newspaper publication of the bill shall 6 be without cost to the state. No legalizing act may 7 be introduced until all provisions of law have been 8 complied with. 9 Rule 42 10 Certification and Engrossment of Bills 11 The chief clerk shall certify the passage of each 12 bill and note the date of its passage. 13 In engrossing a bill, the chief clerk shall 14 correct all obvious typographical, spelling, or other 15 clerical errors and change section subunit numbers 16 and letters and internal references as required to 17 conform the original bill to any amendments which have 18 been adopted. The chief clerk shall report all such 19 corrections or changes in the journal. The engrossed 20 bill shall be placed in the bill file with the original 21 bill and amendments. 22 Rule 43 23 Rereferral 24 A bill may be rereferred by the speaker or, upon 25 motion, by the house at any time before its passage and 26 after the report of its referral to committee. 27 Rule 44 28 Effect of Indefinite Postponement 29 When a question is indefinitely postponed, it shall 30 -23- LSB 1418YC (14) 84 rj/nh 23/ 42

H.R. _____ not be acted upon again during that session. 1 Rule 45 2 Status of Bills Following First Regular Session 3 Except for those bills which have been adopted by 4 both houses in different forms, all bills which have 5 not been withdrawn, defeated or indefinitely postponed, 6 shall be rereferred to committee upon adjournment of 7 the first regular session. Within seven days after 8 the first committee meeting following convening of 9 the second regular session, the committee chair shall 10 submit the bill to the full committee for action or the 11 chair shall reassign the bill to a subcommittee. 12 DIVISION V —— COMMITTEE PROCEDURES 13 Rule 46 14 Appointment of Committees 15 All committees shall be appointed by the speaker, 16 unless otherwise especially directed by the house. 17 Minority party members of a committee shall be 18 appointed by the speaker upon recommendation of the 19 minority leader. 20 Rule 47 21 Reserved 22 Rule 48 23 Study Bills 24 A study bill is any matter which a member of 25 the house wishes to have considered by a standing 26 committee, other than appropriations, without being 27 introduced in the house by a first reading. H.R. _____ Upon taking possession of a study bill, the 1 committee chair shall notify the speaker and then 2 submit four copies of the bill to the legal counsel’s 3 office for numbering. 4 A study bill shall bear the name of the member who 5 wishes to have the bill considered. A study bill 6 submitted by a state agency or board for consideration 7 shall bear the name of the state agency or board. A 8 committee chair may submit a study bill in the name of 9 that committee. 10 Final committee action on a study bill shall not be 11 taken until one day following the notation of the study 12 bill assignment in the house journal. 13 Rule 49 14 Committee Meetings 15 No committee, except a conference committee or the 16 administrative rules review committee, shall meet 17 while the house is in session without special leave. 18 Committees with overlapping memberships shall not meet 19 at the same time without special leave. 20 Rule 50 21 Smoking Prohibited 22 Smoking shall not be permitted in the house or in 23 any area of the capitol building. 24 Rule 50A 25 Nondegradable Polystyrene Cups 26 The use of nondegradable polystyrene cups shall not 27 be permitted on the floor of the house. 28 Rule 51 29 Assignments to Subcommittee 30 -25- LSB 1418YC (14) 84 rj/nh 25/ 42
