GOALS AND ACCOUNTABILITY —— ECONOMIC DEVELOPMENT. 14 1. For the fiscal years beginning July 1, 2011, and July 15 1, 2012, the goals for the department of economic development 16 shall be to expand and stimulate the state economy, increase 17 the wealth of Iowans, and increase the population of the state. 18 2. To achieve the goals in subsection 1, the department 19 of economic development shall do all of the following for the 20 fiscal years beginning July 1, 2011, and July 1, 2012: 21 a. Concentrate its efforts on programs and activities that 22 result in commercially viable products and services. 23 b. Adopt practices and services consistent with free 24 market, private sector philosophies. 25 c. Ensure economic growth and development throughout the 26 state. 27 Sec. 3. DEPARTMENT OF ECONOMIC DEVELOPMENT. There is 28 appropriated from the general fund of the state to the 29 department of economic development for the following fiscal 30 years, the following amounts, or so much thereof as is 31 necessary, to be used for the purposes designated: 32 1. BUSINESS DEVELOPMENT DIVISION 15 a. The department shall establish a strong and aggressive 23 marketing image to showcase Iowa’s workforce, existing 24 industry, and potential. A priority shall be placed on 25 recruiting new businesses, business expansion, and retaining 26 existing Iowa businesses. Emphasis shall also be placed on 27 entrepreneurial development through helping to secure capital 28 for entrepreneurs, and developing networks and a business 29 climate conducive to entrepreneurs and small business. 30 c. A business creating jobs with economic development 31 assistance through moneys appropriated in this subsection shall 32 be subject to contract provisions stating that new and retained 33 jobs shall be filled by individuals who are citizens of the 34 United States who reside within the United States or any person 35 -3- LSB 1011XG (9) 84 tw/tm 3/ 16

S.F. _____ H.F. _____ authorized to work in the United States pursuant to federal 1 law, including legal resident aliens in the United States. Any 2 vendor who receives such public moneys shall adhere to such 3 contract provisions and provide periodic assurances as the 4 state shall require that the jobs are filled solely by citizens 5 of the United States who reside within the United States or 6 any person authorized to work in the United States pursuant 7 to federal law, including legal resident aliens in the United 8 States. A business that receives financial assistance from 9 the department from moneys appropriated in this bill shall 10 only employ individuals legally authorized to work in this 11 state. In addition to all other applicable penalties provided 12 by current law, all or a portion of the assistance received 13 by a business which is found to knowingly employ individuals 14 not legally authorized to work in this state is subject to 15 recapture by the department. 16 d. From the moneys appropriated in this subsection each 17 fiscal year, the department may provide financial assistance in 18 the form of a grant to a community economic development entity 19 for conducting a local workforce recruitment effort designed 20 to recruit former citizens of the state and former students at 21 colleges and universities in the state to meet the needs of 22 local employers. 23 e. From the moneys appropriated in this subsection each 24 fiscal year, the department may provide financial assistance 25 to early-stage industry companies being established by women 26 entrepreneurs. 27 f. From the moneys appropriated in this subsection each 28 fiscal year, the department may provide financial assistance 29 in the form of grants, loans, or forgivable loans for advanced 30 research and commercialization projects involving value-added 31 agriculture, advanced technology, or biotechnology. 32 g. Notwithstanding section 8.33 , moneys appropriated in 33 this subsection that remain unencumbered or unobligated at 34 the close of a fiscal year shall not revert but shall remain 35 -4- LSB 1011XG (9) 84 tw/tm 4/ 16

The department shall develop public-private partnerships 17 with Iowa businesses in the tourism industry, Iowa tour groups, 18 Iowa tourism organizations, and political subdivisions in this 19 state to assist in the development of advertising efforts. 20 The department shall, to the fullest extent possible, develop 21 cooperative efforts for advertising with contributions from 22 other sources. 23 d. Notwithstanding section 8.33 , moneys appropriated in 24 this subsection that remain unencumbered or unobligated at the 25 close of a fiscal year shall not revert to any fund but shall 26 remain available for expenditure for the designated purposes 27 during the succeeding fiscal year. 28 4. INSURANCE ECONOMIC DEVELOPMENT. From the moneys 18 collected by the division of insurance in excess of the 19 anticipated gross revenues under section 505.7, subsection 20 3 , during the fiscal years beginning July 1, 2011, and July 21 1, 2012, $100,000 shall be transferred each fiscal year to 22 the department of economic development for insurance economic 23 development and international insurance economic development. 24 Sec. 5. COMMUNITY DEVELOPMENT LOAN FUND. Notwithstanding 25 section 15E.120, subsection 5 , there is appropriated from the 26 Iowa community development loan fund all moneys available 27 during the fiscal years beginning July 1, 2011, and July 1, 28 2012, to the department of economic development for purposes of 29 the community development program. 30 Sec. 6. WORKFORCE DEVELOPMENT FUND. There is appropriated 31 from the workforce development fund account created in section 32 15.342A to the workforce development fund created in section 33 15.343 for the following fiscal years, the following amounts, 34 for purposes of the workforce development fund: 35 -6- LSB 1011XG (9) 84 tw/tm 6/ 16

WORKFORCE DEVELOPMENT ADMINISTRATION. From moneys 3 appropriated or transferred to or receipts credited to the 4 workforce development fund created in section 15.343 , up to 5 $400,000 for the fiscal year beginning July 1, 2011, and up 6 to $400,000 for the fiscal year beginning July 1, 2012, are 7 appropriated to the department of economic development for the 8 administration of workforce development activities including 9 salaries, support, maintenance, and miscellaneous purposes. 10 Sec. 8. JOB TRAINING FUND. Notwithstanding section 15.251 , 11 all moneys in the job training fund on July 1, 2011, and on July 12 1, 2012, and any moneys appropriated or credited to the fund 13 during the fiscal years beginning July 1, 2011, and July 1, 14 2012, shall be transferred to the workforce development fund 15 established pursuant to section 15.343 . 16 Sec. 9. IOWA STATE UNIVERSITY. 17 1. There is appropriated from the general fund of the 18 state to Iowa state university of science and technology for 19 the following fiscal years, the following amounts, or so 20 much thereof as is necessary, to be used for small business 21 development centers, the science and technology research park, 22 and the institute for physical research and technology: 23 FY 2011-2012 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 2,421,424 24 FY 2012-2013 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 2,421,424 25 2. Of the moneys appropriated in subsection 1, Iowa 26 state university of science and technology shall allocate 27 at least $944,355 each fiscal year for purposes of funding 28 small business development centers. If moneys allocated 29 pursuant to this subsection exceed the amount allocated for 30 small business centers in 2009 Iowa Acts, chapter 176, section 31 11, subsection 2, at least $100,000 of the moneys allocated 32 each fiscal year pursuant to this subsection shall be used 33 to increase the assistance to small businesses for providing 34 one-on-one business planning and marketing counseling. S.F. _____ H.F. _____ state university of science and technology may allocate moneys 1 appropriated each fiscal year in subsection 1 to the various 2 small business development centers in any manner necessary to 3 achieve the purposes of this subsection. 4 3. Iowa state university of science and technology shall do 5 all of the following: 6 a. Direct expenditures for research toward projects that 7 will provide economic stimulus for Iowa. 8 b. Provide emphasis to providing services to Iowa-based 9 companies. 10 4. It is the intent of the general assembly that the 11 industrial incentive program focus on Iowa industrial 12 sectors and seek contributions and in-kind donations from 13 businesses, industrial foundations, and trade associations, 14 and that moneys for the institute for physical research and 15 technology industrial incentive program shall be allocated 16 only for projects which are matched by private sector moneys 17 for directed contract research or for nondirected research. 18 The match required of small businesses as defined in section 19 15.102, subsection 6 , for directed contract research or for 20 nondirected research shall be $1 for each $3 of state funds. 21 The match required for other businesses for directed contract 22 research or for nondirected research shall be $1 for each $1 of 23 state funds. The match required of industrial foundations or 24 trade associations shall be $1 for each $1 of state funds. 25 Iowa state university of science and technology shall 26 report annually to the joint appropriations subcommittee on 27 economic development and the legislative services agency the 28 total amount of private contributions, the proportion of 29 contributions from small businesses and other businesses, and 30 the proportion for directed contract research and nondirected 31 research of benefit to Iowa businesses and industrial sectors. 32 5. UNIVERSITY OF NORTHERN IOWA. 24 1. BOARD OF REGENTS REPORT. The state board of 15 regents shall submit a report on the progress of regents 16 institutions in meeting the strategic plan for technology 17 transfer and economic development to the secretary of the 18 senate, the chief clerk of the house of representatives, and 19 the legislative services agency by January 15, 2012, and 20 January 15, 2013. 21 Sec. 13. DEPARTMENT OF WORKFORCE DEVELOPMENT. There 22 is appropriated from the general fund of the state to the 23 department of workforce development for the following fiscal 24 years, the following amounts, or so much thereof as is 25 necessary, for the purposes designated: 26 1. DIVISION OF LABOR SERVICES 27 a. The division of workers’ compensation shall charge a 6 $100 filing fee for workers’ compensation cases. The filing 7 fee shall be paid by the petitioner of a claim. However, the 8 fee can be taxed as a cost and paid by the losing party, except 9 in cases where it would impose an undue hardship or be unjust 10 under the circumstances. The moneys generated by the filing 11 fee allowed under this subsection are appropriated to the 12 department of workforce development to be used for purposes of 13 administering the division of workers’ compensation. 14 3. WORKFORCE DEVELOPMENT OPERATIONS 15 a. The department of workforce development shall make 23 every effort to maintain new Iowans centers that offer 24 one-stop services to deal with the multiple issues related to 25 immigration and employment. The centers shall be designed to 26 support workers, businesses, and communities with information, 27 referrals, job placement assistance, translation, language 28 training, and resettlement, as well as technical and legal 29 assistance on such issues as forms and documentation. Through 30 the coordination of local, state, and federal service 31 providers, and through the development of partnerships with 32 public, private, and nonprofit entities with established 33 records of international service, these centers shall seek to 34 provide a seamless service delivery system for new Iowans. 35 -11- LSB 1011XG (9) 84 tw/tm 11/ 16

Notwithstanding section 8.33 , moneys appropriated 15 in subsections 1 through 4 of this section that remain 16 unencumbered or unobligated at the close of a fiscal year shall 17 not revert but shall remain available for expenditure for the 18 purposes designated until the close of the succeeding fiscal 19 year. 20 Sec. 14. ACCOUNTABILITY —— AUDIT. The auditor of state 21 shall annually conduct an audit of the department of workforce 22 development and shall report the findings of such annual 23 audit, including the accountability of programs of the 24 department, to the chairpersons and ranking members of the 25 joint appropriations subcommittee on economic development. The 26 department shall pay for the costs associated with the audit. 27 Sec. 15. EMPLOYMENT SECURITY CONTINGENCY FUND —— DIVISION 28 OF WORKERS’ COMPENSATION. 29 1. IOWA FINANCE AUTHORITY —— RENT SUBSIDY 7 PROGRAM. There is appropriated from the general fund of 8 the state to the Iowa finance authority for the following 9 fiscal years, the following amounts, or so much thereof as is 10 necessary, to be used for the purposes designated: 11 For purposes of providing reimbursement for rent expenses to 12 persons eligible for assistance under the rent subsidy program: 13 FY 2011-2012 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 658,000 14 FY 2012-2013 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 658,000 15 Participation in the rent subsidy program shall be limited 16 to only those persons who meet the requirements for the 17 nursing facility level of care for home and community-based 18 services waiver services as in effect on July 1, 2011, and on 19 July 1, 2012, and to those individuals who are eligible for 20 the federal money follows the person grant program under the 21 medical assistance program. Of the moneys appropriated in this 22 section each fiscal year, not more than $35,000 may be used for 23 administrative costs. 24 Sec. 21. UNEMPLOYMENT COMPENSATION PROGRAM. Notwithstanding 25 section 96.9, subsection 4 , paragraph “a”, moneys credited to 26 the state by the secretary of the treasury of the United 27 States pursuant to section 903 of the Social Security 28 Act are appropriated to the department of workforce 29 development and shall be used by the department for the 30 administration of the unemployment compensation program only. 31 This appropriation shall not apply to any fiscal year 32 beginning after December 31, 2011. 33 EXPLANATION 34 This bill makes appropriations and transfers from the 35 -14- LSB 1011XG (9) 84 tw/tm 14/ 16

S.F. _____ H.F. _____ general fund of the state and other funds to the department of 1 cultural affairs, the department of economic development, the 2 university of Iowa, the university of northern Iowa, Iowa state 3 university, the department of workforce development, the Iowa 4 finance authority and the public employment relations board for 5 the 2011-2012 fiscal year and the 2012-2013 fiscal year. 6 The bill provides that the goals for the department of 7 economic development shall be to expand and stimulate the 8 state economy, increase the wealth of Iowans, and increase the 9 population of the state. 10 The bill transfers moneys collected by the division of 11 insurance in excess of the anticipated gross revenues to the 12 department of economic development for purposes of insurance 13 economic development and international insurance economic 14 development. 15 The bill appropriates moneys from the Iowa community 16 development loan fund to the department of economic development 17 for purposes of the community development program. 18 The bill appropriates moneys from the workforce development 19 fund account to the workforce development fund. 20 The bill provides that moneys appropriated or transferred 21 to or receipts credited to the workforce development fund are 22 appropriated to the department of economic development for 23 administration of workforce development activities. 24 The bill provides that all moneys in the job training fund on 25 July 1, 2011, and on July 1, 2012, and any moneys appropriated 26 or credited to the fund during the fiscal year beginning July 27 1, 2011, and on July 1, 2012, shall be transferred to the 28 workforce development fund. 29 The bill requires the state board of regents to submit a 30 report on the progress of regents institutions in meeting 31 the strategic plan for technology transfer and economic 32 development. 33 The bill requires the auditor of state to conduct an audit of 34 the department of workforce development. 35 -15- LSB 1011XG (9) 84 tw/tm 15/ 16
