H.F. _____ Section 1. Section 321.20, subsection 2, Code 2011, is 1 amended to read as follows: 2 2. Notwithstanding contrary provisions of this chapter or 3 chapter 326 regarding titling and registration by means other 4 than electronic means, the department may develop and implement 5 do all of the following: 6 a. Develop and implement a program for electronic funds 7 transfer for transactions involving vehicles subject to 8 registration. 9 b. Develop a program to allow for electronic applications, 10 titling, and registering , and electronic funds transfer for 11 vehicles subject to registration in order to improve the 12 efficiency and timeliness of the processes and to reduce costs 13 for all parties involved. The department may implement a pilot 14 project to evaluate the program developed under this paragraph. 15 c. On or after July 1, 2012, the department may implement 16 the program developed pursuant to paragraph “b” on a statewide 17 basis. 18 Sec. 2. 2010 Iowa Acts, chapter 1109, section 1, is amended 19 to read as follows: 20 SEC. 1. ELECTRONIC VEHICLE REGISTRATION AND TITLING —— 21 INTENT. It is the intent of the general assembly to establish 22 a uniform statewide system to allow electronic transactions 23 for the initial registration and titling of motor vehicles, 24 including electronic applications, electronic issuance of 25 titles, electronic registration, electronic transfer of funds, 26 electronic perfection of liens, and issuance of secure and 27 individually identifiable temporary registration cards , by 28 January 1, 2012 . 29 Sec. 3. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 30 immediate importance, takes effect upon enactment. 31 EXPLANATION 32 Under current law, the department of transportation is 33 authorized to develop and implement a program to allow for 34 electronic applications, titling, registering, and electronic 35 -1- LSB 2429YC (5) 84 dea/nh 1/ 2
H.F. _____ funds transfer for vehicles subject to registration. This 1 bill allows the department to move forward with the electronic 2 funds transfer element of the program, but temporarily limits 3 the implementation of electronic applications, titling, and 4 registration to a pilot project for purposes of evaluating the 5 program. 6 The bill authorizes the department to move forward with a 7 statewide program for electronic applications, titling, and 8 registration on or after July 1, 2012. 9 The bill amends language enacted in 2010 which expresses 10 the general assembly’s intent to establish a uniform statewide 11 system for electronic registration and titling by January 1, 12 2012, by removing the specified date. 13 The bill takes effect upon enactment. 14 -2- LSB 2429YC (5) 84 dea/nh 2/ 2
