House Resolution 130 - Introduced HOUSE RESOLUTION NO. 130 BY COMMITTEE ON ADMINISTRATION AND RULES (SUCCESSOR TO HSB 664) A Resolution amending the permanent rules of the House 1 of Representatives. 2 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, 3 That Rule 4, unnumbered paragraph 6 of the Rules of 4 the House, as adopted by the House of Representatives 5 during the 2011 Session in House Resolution 11, is 6 amended to read as follows: 7 Members of the press may photograph from the press 8 box, but shall not use artificial lighting without 9 prior permission from the chief clerk of the house. 10 Photographs shall not be taken on the house floor when 11 the members are voting on a question put before the 12 house. Photographs or video recordings of the voting 13 boards shall not be taken while a nonrecord roll call 14 vote is displayed. Photographs may be taken on the 15 house floor at other times with the consent of the 16 subject or subjects of the photography. 17 BE IT FURTHER RESOLVED, That Rule 4A of the Rules of 18 the House, as adopted by the House of Representatives 19 during the 2011 Session in House Resolution 11, is 20 amended to read as follows: 21 Rule 4A 22 Use of Telephonic or Electronic Devices and Video 23 Streaming in Chamber Restricted 24 1. H.R. 130 The speaker may remove from the chamber any person 1 acting in violation of this rule. 2 2. A member shall not use a cell phone or other 3 electronic device to audibly transmit or receive 4 communications while recognized by the presiding 5 officer to speak in debate. 6 3. The speaker shall control the time, place, 7 and manner of use of the house’s internet video 8 streaming system on the floor of the house and in the 9 visitors’ galleries. However, the speaker shall not 10 edit, censor, or shut off the house’s internet video 11 streaming system during debate on the floor of the 12 house. 13 BE IT FURTHER RESOLVED, That Rule 20, unnumbered 14 paragraph 15 of the Rules of the House, as adopted by 15 the House of Representatives during the 2011 Session in 16 House Resolution 11, is amended to read as follows: 17 Each member, employee of the house, and registered 18 lobbyist shall may report violations of this rule 19 immediately to the sergeant-at-arms or the chief clerk . 20 BE IT FURTHER RESOLVED, That Rule 21 of the Rules of 21 the House, as adopted by the House of Representatives 22 during the 2011 Session in House Resolution 11, is 23 amended to read as follows: 24 Rule 21 25 Distribution of Literature and Other Items 26 No person except a member or employee of the house 27 of representatives shall generally distribute or 28 cause to be distributed any pamphlets, material, or 29 other printed literature, or any other items to the 30 -2- LSB 6077HV (1) 84 rj/nh 2/ 4
H.R. 130 members’ desks in the house without authorization . An 1 employee of the house shall generally distribute or 2 cause to be distributed such literature or items only 3 on behalf of the employee’s office or staff. Items 4 which are permissible gifts under chapter 68B of the 5 Code may be distributed to the members’ desks with the 6 authorization of the chief clerk. 7 All copies of pamphlets, material, or printed 8 literature distributed by a member or employee of the 9 house of representatives shall bear the name of the 10 member or employee’s office or staff. 11 Other distributions of pamphlets, material, or 12 other printed literature shall bear their source of 13 origin and be distributed through the legislative 14 post office or to the members’ desks by completing 15 a form containing a member’s or the chief clerk’s 16 authorization, with the authorization form attached 17 to one copy of the distribution filed with the chief 18 clerk . The copy with the attached authorization form 19 shall be retained for a reasonable time period by the 20 legislative post office chief clerk . 21 BE IT FURTHER RESOLVED, That Rule 61, unnumbered 22 paragraph 5 of the Rules of the House, as adopted by 23 the House of Representatives during the 2011 Session in 24 House Resolution 11, is amended to read as follows: 25 A bill, joint resolution, or nullification 26 resolution for which a public hearing has been called 27 can be voted to the calendar but cannot be debated 28 until after the public hearing has been held. H.R. 130 for which a public hearing has been called is not 1 debated by the house during the session in which it 2 is introduced, the request for the public hearing is 3 deemed to have lapsed upon adjournment sine die of that 4 session. 5 BE IT FURTHER RESOLVED, That Rule 75 of the Rules of 6 the House, as adopted by the House of Representatives 7 during the 2011 Session in House Resolution 11, is 8 amended to read as follows: 9 Rule 75 10 Voting in the House and Duty of Voting 11 Voting on a question put to members on the floor of 12 the house shall not occur between midnight and 8 a.m. 13 on any legislative day except for voting on a motion to 14 recess, defer, or adjourn.
