House Resolution 129 - Introduced HOUSE RESOLUTION NO. 129 BY HAGER A Resolution to urge the United States Senate to enact 1 the Farm Dust Regulation Prevention Act of 2011. 2 WHEREAS, there is uncertainty regarding possible 3 plans by the United States Environmental Protection 4 Agency (EPA) to revise the national primary and 5 secondary ambient air quality standards (40 C.F.R. pt. 6 50) as those standards could be applied to particulate 7 matter comprised of blowing dirt and naturally 8 occurring organic material common in rural areas and 9 including dust from farming operations and country 10 roads; and 11 WHEREAS, during the 112th Congress, the Farm Dust 12 Regulation Prevention Act of 2011, H.R. 1633, was 13 introduced, with 121 cosponsors, preventing the United 14 States EPA from proposing, finalizing, implementing, 15 or enforcing any regulation revising the national 16 primary and secondary ambient air quality standards on 17 particulate matter from such dust; and 18 WHEREAS, on December 8, 2011, the United States 19 House of Representatives passed the Farm Dust 20 Regulation Prevention Act of 2011 by a vote of 268 21 voting aye and 150 voting nay, which included aye 22 votes by all of Iowa’s U.S. House of Representatives 23 delegation; and 24 WHEREAS, on December 13, 2011, H.R. 1633 was placed 25 on the United States Senate Legislative Calendar and 26 has received no further action by the U.S. Senate; and 27 WHEREAS, the Honorable Senator Mike Johanns, with 28 -1- LSB 5526YH (3) 84 da/rj 1/ 3
H.R. 129 26 cosponsors, including the Honorable Senator Chuck 1 Grassley, introduced S. 1528, the Senate version of the 2 Farm Dust Regulation Prevention Act of 2011, which on 3 September 8, 2011, was referred to the Committee on 4 Environment and Public Works; NOW THEREFORE, 5 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, 6 That the Iowa House of Repersentatives urges the 7 United States Senate to enact the Farm Dust Regulation 8 Prevention Act of 2011 with all possible deliberation 9 in order to effectuate this important congressional 10 protection against an unnecessary intrusion into 11 rural life and agriculture at a time when the world 12 increasingly looks to the American farmer to produce 13 its food and fiber; and 14 BE IT FURTHER RESOLVED, That a copy of this 15 resolution be delivered to the Honorable Lisa P. 16 Jackson, Administrator, United States Environmental 17 Protection Agency; and 18 BE IT FURTHER RESOLVED, That a copy of this 19 resolution be delivered to the Honorable Senator Harry 20 Reid, Majority Leader of the United States Senate, and 21 the Honorable Senator Mitch McConnell, Minority Leader 22 of the United States Senate; and 23 BE IT FURTHER RESOLVED, That a copy of this 24 resolution be delivered to the Honorable Senator 25 Barbara Boxer, Chairman of the United States Senate 26 Committee on Environment and Public Works, and the 27 Honorable Senator James M.
