H.F. 98 Section 1. Section 99D.7, Code 2011, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 22A. To require licensees to establish a 3 process by which a person who has been voluntarily excluded 4 for life from a racetrack enclosure and all other licensed 5 facilities under this chapter and chapter 99F may, after having 6 been excluded for at least five years, apply to revoke that 7 exclusion. A person shall not have their exclusion revoked 8 unless the application to revoke contains the written consent 9 of the person’s spouse, if applicable. The process established 10 shall include a procedure that would allow any person that has 11 revoked their exclusion to request that the lifetime exclusion 12 be reinstated. A person that has reinstated a lifetime 13 exclusion shall not be permitted to revoke that reinstated 14 exclusion. The state and any licensee under this chapter or 15 chapter 99F shall not be liable to any person for any claim 16 which may arise from this process. 17 Sec. 2. Section 99F.4, Code 2011, is amended by adding the 18 following new subsection: 19 NEW SUBSECTION . 22A. A person shall not have their exclusion revoked 25 unless the application to revoke contains the written consent 26 of the person’s spouse, if applicable. The process established 27 shall include a procedure that would allow any person that has 28 revoked their exclusion to request that the lifetime exclusion 29 be reinstated. H.F. 98 This bill creates a process by which a person voluntarily 1 excluded from gambling facilities may apply to revoke that 2 exclusion. 3 The bill requires that license holders under Code chapter 4 99D create a process to allow any individual, self-excluded 5 from racetrack enclosures and other facilities under Code 6 chapter 99D, to apply for a revocation of that exclusion 7 after at least five years of exclusion. The application to 8 revoke must, if applicable, contain the written consent of the 9 individual’s spouse. The bill further requires that a process 10 will be created so that any individual who applies to revoke 11 their exclusion may have their exclusion reinstated. The bill 12 requires that once an exclusion is reinstated that it may not 13 be revoked at any later time.
