H.F. 81 Section 1. Section 297.22, subsection 2, paragraph a, Code 1 2011, is amended to read as follows: 2 a. The board of directors of a school district may sell, 3 lease, exchange, give, or grant, and accept any interest 4 in real property to, with, or from a county, municipal 5 corporation, school district, community college for the purpose 6 specified in section 298.3, subsection 1, paragraph “n” , 7 township, or area education agency if the real property is 8 within the jurisdiction of both the grantor and grantee. 9 Sec. 2. Section 298.3, subsection 1, Code 2011, is amended 10 by adding the following new paragraph: 11 NEW PARAGRAPH . n. Notwithstanding the requirement that 12 a school district have exclusive jurisdiction in all matters 13 within the territory of the school district under section 14 274.1, joint infrastructure projects with one or more school 15 districts or one or more school districts and an Iowa community 16 college for buildings or facilities constructed or leased for 17 the purpose of offering classes under a district-to-community 18 college sharing agreement or concurrent enrollment program 19 that meets the requirements for funding under section 257.11, 20 subsection 3. 21 Sec. 3. Section 423F.3, subsection 3, paragraph a, Code 22 2011, is amended to read as follows: 23 a. If the board of directors adopts a resolution to use 24 funds received under the operation of this chapter solely for 25 providing property tax relief by reducing indebtedness from 26 the levies specified under section 298.2 or 298.18 or for the 27 purpose specified in section 298.3, subsection 1, paragraph 28 “n” , the board of directors may approve a revenue purpose 29 statement for that purpose such purposes without submitting the 30 revenue purpose statement to a vote of the electors. 31 EXPLANATION 32 This bill authorizes the use of revenue from the regular 33 and voter-approved physical plant and equipment levies to be 34 expended for joint infrastructure projects with one or more 35 -1- LSB 1295YH (12) 84 md/sc 1/ 2

H.F. 81 school districts or one or more school districts and an Iowa 1 community college for buildings or facilities constructed 2 or leased for the purpose of offering classes under a 3 district-to-community college sharing agreement or concurrent 4 enrollment program that meets the requirements for funding 5 under Code section 257.11(3). 6 The bill authorizes the board of directors of a school 7 district, by resolution, to use local sales and services 8 tax revenue received under Code chapter 423F for joint 9 infrastructure projects with one or more school districts or 10 one or more school districts and an Iowa community college for 11 buildings or facilities constructed or leased for the purpose 12 of offering classes under a district-to-community college 13 sharing agreement or concurrent enrollment program that meets 14 the requirements for funding under Code section 257.11(3), 15 following approval of a revenue purpose statement, without 16 submitting the revenue purpose statement approving such use of 17 funds to a vote of the electors. 18 The bill adds community colleges to the list of entities 19 that a board of directors of a school district may sell, lease, 20 exchange, give, or grant, and accept any interest in real 21 property to, with, or from if the real property is within the 22 jurisdiction of both the grantor and grantee and it is for a 23 joint infrastructure project with one or more school districts 24 and an Iowa community college for buildings or facilities 25 constructed or leased for the purpose of offering classes under 26 a district-to-community college sharing agreement or concurrent 27 enrollment program that meets the requirements for funding 28 under Code section 257.11(3). 29 -2- LSB 1295YH (12) 84 md/sc 2/ 2
