H.F. 74 Section 1. Section 256.7, subsection 29, Code 2011, is 1 amended by striking the subsection. 2 Sec. 2. Section 256.9, subsections 55 and 56, Code 2011, are 3 amended by striking the subsections. 4 Sec. 3. Section 256.11, subsection 6, paragraph a, Code 5 2011, is amended to read as follows: 6 a. A pupil is not required to enroll in either physical 7 education or health courses , or meet the requirements of 8 paragraph “b” or “c” , if the pupil’s parent or guardian files a 9 written statement with the school principal that the course or 10 activity conflicts with the pupil’s religious belief. 11 Sec. 4. Section 256.11, subsection 6, paragraphs b and c, 12 Code 2011, are amended by striking the paragraphs. 13 Sec. 5. Section 273.2, subsection 7, Code 2011, is amended 14 by striking the subsection. 15 EXPLANATION 16 This bill eliminates the healthy kids Act. The bill 17 eliminates the directive to the state board of education to 18 adopt rules establishing nutritional content standards for 19 foods and beverages sold or provided on the school grounds 20 of any school district or accredited nonpublic school during 21 the school day with the exceptions of the food provided by any 22 federal school food program or through an agreement with an 23 agency of the federal government, foods sold for fund-raising 24 purposes, and foods and beverages sold at concession stands. 25 The bill also eliminates the directive to the director of 26 the department of education to convene a nutrition advisory 27 panel to review research in pediatric nutrition and submit 28 findings and recommendations to be considered when establishing 29 or amending the nutritional content standards for foods and 30 beverages sold or provided in the schools. The bill eliminates 31 the directive to the director of the department of education to 32 monitor school districts and accredited nonpublic schools for 33 compliance with the nutritional content standards; eliminates 34 the provisions requiring minimum specified physical activity 35 -1- LSB 1498YH (2) 84 pf/sc 1/ 2
