H.F. 637 Section 1. WORKERS’ COMPENSATION —— COPYING FEES. The 1 workers’ compensation commissioner shall adopt rules providing 2 for an annual increase in the amount allowed in administrative 3 rules in effect upon enactment of this provision, to be paid 4 to a medical provider or its agent for furnishing duplicates 5 of records or reports. The increase shall be made on an 6 annual basis and equal the percentage increase in the consumer 7 price index published in the federal register by the federal 8 department of labor, bureau of labor statistics, that reflects 9 the percentage increase in the consumer price index for the 10 twelve-month period ending June 30 of each year. The amount of 11 the fees allowed for such duplicates shall be published in the 12 Iowa administrative bulletin each year. 13 Sec. 2. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 14 immediate importance, takes effect upon enactment. 15 EXPLANATION 16 This bill requires the workers’ compensation commissioner 17 to adopt rules providing for an annual increase in the amount 18 allowed in administrative rules in effect upon enactment of 19 the bill, to be paid to a medical provider or its agent for 20 furnishing duplicates of records or reports. The increase 21 shall be made on an annual basis and equal to the percentage 22 increase in the consumer price index published in the federal 23 register by the federal department of labor, bureau of labor 24 statistics, that reflects the percentage increase in the 25 consumer price index for the 12-month period ending June 30 of 26 each year. The amount of the fees allowed for such duplicates 27 must be published in the Iowa administrative bulletin each 28 year. 29 Administrative rule 876 IAC 8.9 contains a schedule of the 30 amount allowed for the actual expense to prepare duplicates 31 which is currently an amount not to exceed $20 for 1 to 20 32 pages; $20 plus $1 per page for 21 to 30 pages; $30 plus $.50 33 per page for 31 to 100 pages; $65 plus $.25 per page for 101 to 34 200 pages; $90 plus $.10 per page for more than 200 pages, and 35 -1- LSB 1878HV (3) 84 av/nh 1/ 2
