Section
1.
Section
299A.2,
Code
2011,
is
amended
to
read
as
1
follows:

299A.2
Competent
private
instruction
by
licensed
3
practitioner.
4
If
a
licensed
practitioner
provides
competent
instruction
5
to
a
school-age
child
of
compulsory
attendance
age
,
the
6
practitioner
shall
possess
a
valid
license
or
certificate
which
7
has
been
issued
by
the
state
board
of
educational
examiners
8
under
chapter
272
and
which
is
appropriate
to
the
ages
and
9
grade
levels
of
the
children
to
be
taught.
Competent
private
10
instruction
may
include
,
but
is
not
limited
to
,
a
home
school
11
assistance
program
which
provides
instruction
or
instructional
12
supervision
offered
through
an
accredited
nonpublic
school
or
13
public
school
district
by
a
teacher,
who
is
employed
by
the
14
accredited
nonpublic
school
or
public
school
district,
who
15
assists
and
supervises
a
parent,
guardian,
or
legal
custodian
16
in
providing
instruction
to
a
child.
If
competent
private
17
instruction
is
provided
through
a
public
school
district,
the
18
child
shall
be
enrolled
and
included
in
the
basic
enrollment
19
of
the
school
district
as
provided
in
section
257.6
.
Sections
20
299A.3
through
299A.7
do
not
apply
to
competent
private
21
instruction
provided
by
a
licensed
practitioner
under
this
22
section
.
However,
the
reporting
requirement
contained
in
23
section
299A.3,
subsection
1
,
shall
apply
to
competent
private
24
instruction
provided
by
licensed
practitioners
that
is
not
25
part
of
a
home
school
assistance
program
offered
through
an
26
accredited
nonpublic
school
or
public
school
district.

Sec.
2.
Section
299A.8,
Code
2011,
is
amended
to
read
as

follows:

299A.8
Dual
enrollment.

If
a
parent,
guardian,
or
legal
custodian
of
a
school-age
31
child
who
is
receiving
competent
private
instruction
under
32
this
chapter
or
a
child
over
compulsory
age
who
is
receiving
33
private
instruction
submits
a
request,
the
child
shall
also
be
34
registered
in
a
public
school
for
dual
enrollment
purposes.

If
the
child
is
enrolled
in
a
public
school
district
for
1
dual
enrollment
purposes,
the
child
shall
be
permitted
to
2
participate
in
any
academic
activities
in
the
district
and
3
shall
also
be
permitted
to
participate
on
the
same
basis
as
4
public
school
children
in
any
extracurricular
activities
5
available
to
children
in
the
child’s
grade
or
group,
and
the
6
parent,
guardian,
or
legal
custodian
shall
not
be
required
to
7
pay
the
costs
of
any
annual
evaluation
under
this
chapter
.
If
8
the
child
is
enrolled
for
dual
enrollment
purposes,
the
child
9
shall
be
included
in
the
public
school’s
basic
enrollment
10
under
section
257.6
.
A
pupil
who
is
participating
only
in
11
extracurricular
activities
shall
be
counted
under
section
12
257.6,
subsection
1
,
paragraph
“a”
,
subparagraph
(6).
A
pupil
13
enrolled
in
grades
nine
through
twelve
under
this
section
shall
14
be
counted
in
the
same
manner
as
a
shared-time
pupil
under
15
section
257.6,
subsection
1
,
paragraph
“a”
,
subparagraph
(3).

EXPLANATION
17
This
bill
permits
children
receiving
competent
private
18
instruction
to
qualify
for
dual
enrollment
provided
through
a
19
school
district
and
competent
private
instruction,
including
20
home
school
assistance
programs,
if
the
children
are
of
school
21
age,
rather
than
of
compulsory
attendance
age.
